Pursuant to Section 6.27 of the City of Clearwater Code, when businesses which
have a conditional use for the sale of alcoholic beverages change business
ownership, they are required to seek a conditional use approval for a change of
business ownership. J. and Sophia Karas applied for and were granted approval
for change of business ownership for Wawa Food Mart at 1881 Drew Street. The
Delphi Academy of Florida is appealing the Planning and Zoning Board's approval.
The record as prOVided by the City Clerk's office is attached along with a tape of
the Paz hearing.
Pursuant to Section 36.065, appeals of conditional use decisions regarding the
sale of alcoholic beverages are to the City Commission. The City Commission
must follow all provisions and requirements regarding the conduct of the hearing.
Pursuant to that section, the hearing is conducted as follows:
The Mayor shall set forth at the outset of the hearing the order of the
proceedings and the rules under which the hearing will be
conducted. The order of presentation shall be as follows:
(1) Receipt of the tapes, minutes and exhibits from the Board
(2) Opening statements by the parties
(3) Appellant's case
(4) Respondent's case
(5) Rebuttal by appellant
(6) Summation by respondent
(7) Summation by appellant
(8) Conclusion of the hearing

The Commission has the authority to determine the applicability and relevance of
all materials, exhibits and testimony and to exclude Irrelevant, Immaterial and
repetitious matter. Cross-examination may be permitted. Each side will be
allowed one hour to present their case.
In rendering your decision, you must consider the record and testimony presented
at the hearing before the Board and the hearing before you, relative to the
gUidelines for consideration of conditional uses contained in Section 41,033.
41.0521 and 41.053(23). These sections are attached for your reference.
The burden Is upon the appellant to show that the decision of the Board cannot be
sustained by the evidence before the Board and before you or that the decision of
the Board departs from the essential requirements of law. You shall be guided by
the City's Comprehensive Plan, relevant portions of the Code, and established
case law.
Your determination must include appropriate findings of fact, conclusions of lawI
and decision in the matter of the appeal. The Commission may affirm or reverse
the decision of the Board and may impose such reasonable conditions as the
Board may have imposed. Specifically you may impose conditions and restrictions
necessary to comply with the standards for approval, Uto reduce or minimize by
potentially injurious effect of such conditional use upon other property in the
neighborhood and to carry out the general purpose and intent of th[e] development
code."
While the Commission may allow both the applicant and the respondent to submit
written findings of fact and conclusions of law, it is my recommendation that the
Commission discuss its conclusions and as appropriate make its findings of facts
and conclusions of law. Following the Commission's oral rendition of the order, I
will reduce the order to writing and bring it to the Commission at the next
Commission meeting for approval by the Commission.

(2) For the purposes of this section:
(a) Approval means a ~onditional use approval for the sale of alcoholic beverages
within the city. Every alcoholic beverage establishment lawfully in existence within
the city as of January 21, 1988, the date of adoption of Ordinance No. 4420. shall
be deemed to have such approval, inCluding but not limited to establishments
which predate the adoption of the land development code.
(b) Conviction means a verdict of guilty or any plea of guilty or nolo contendre.
regardless of whether the court sentences the defendant to jail, probation or other
sentence, and regardless of whether or not the court withholds its formal
adjudication of guilt.
(c) Holder of the approval and holder mean the person having the right to operate
an alcoholic beverage establishment within the city. The terms shall also include
any officer1 director or partner, If the holder is a corporatIon or partnershipl and
any employee or agent of the holder if the employee or agent is convicted of a
, crime or found to have violated an ordinance or condition described in subsection
(3) of this sectJon.
(3) An approval shall be subject to special conditions. suspension or revocation as
described in this section if the holder of the approval is:
(a) Convicted of any felony as the result of conduct on or off the premises;
(b) Convicted of any misdemeanor violation of any law relating to assault and battery,
weapons and firearmsl prostltution1 lewdness or indecent exposure, fraudulent
practices, public nuisanCes, obstructing justice, obscene 1i1erature, gambling. drug
abuse prevention and contraIl or offenses concerning racketeering and Illegal
debts1 Including any conduct which Is unlawful pursuant to F.S. chs. 784. 790,
796,800.817,823,8431847,8491893 or 895, as may be amended from time to
time, InclUding but not limited to conviction for attempt or conspiracy to commit
any of the foregoing, as the result of conduct on the premlses;l

(c)
Convicted of a violation of any ordinance of the city relating to any conduct on the
premises of a kind described In subsection (3)(b} of thIs section, or relating to the
subjects of disorderly conduct or noise pursuant to sections 20.61, 20.62 or 20.11 ;
(d)
Found by the code enforcement board of the cIty to have violated any ordinance
of the city applicable to the alcoholic beverage establishment or the operation
thereof; or
(e)

" (4) In any case in which a conviction or violation described in subsection (3) of this
section is alleged to have occurred, the city commission may take one of the following actions
upon the conclusion of a hearing for which the holder has been given notice and an opportunity
to appear and particIpate:
(a) Continue the approval subject to such conditions as shall be deemed reasonably
necessary by the city commission to ensure compliance with applicable laws and
ordinances;
(b) Suspend the approval for a period of time to be determined by the city
commission, but not to exceed six months; or
(c) Revoke the approval.
(5) The hearings required by this section shall be conducted by the city commission
duting any regular meeting or special meeting called for such purpose. At such hearing, the
holder shall have an opportunity to present evidence on his behalf. to cross examine adverse
witnesses, to be represented by counsel. and to show cause why the approval should not be
continued subject to conditions. suspended, or revoked.
(6) The decision of the city commission shall be deemed a final admInistrative agency
decision, subject to judicial review by common law certiorari in the circuit court for the county.

Sec. 36.065. Appeals to hearing officer or city commIssion.
(1) Purpose and exception.
(a)
It is the purpose of this section to provide an administrative process for appealing
decisions rendered on variances and conditional uses by the development code
adjustment board and the planning and zoning board, or by the design review
board prior to any available recourse In a court of law. In particular, it Is Intended
that such administrative relief be provided in the most professional, objective and
equitable manner possible through the appointment of a hearing officer to
adjudicate matters as provided in this section. The function of the hearing officer
shall be to serve as the second step of a two-step administrative process relating
to variances and conditional uses and to design review. The review of a board
decision by a hearing officer shall not be required if alt affected parties are
satisfied with the board decision, but no party shall be deemed to have exhausted
his administrative remedies for the purpose of seeking judicial review unless the
party first obtains review of the board decision by a hearing officer as provided
in this section.

(2) Applicability. Any party in interest may appeal a decision rendered by a board on an
application for a variance or conditional use to the hearing officer. For the purpose of this
section, the term "party in interest" means the property owner, the city manager or any person
who will suffer an adverse effect to an interest protected or furthered by the land development
code. The Interest may be shared in common with other members of the city at large but shall
exceed In degree the general interest shared by all persons.
(b)
(3) Filing for appeal, The procedure for filing an appeal shall be as follows:
ea) Appeals shall be commenced by filing a notice of appeal with the city clerk within
14 days of the decision of the board.
(b) The notice of appeal shall set forth in detail the basis of the appeal.
(c) At the time the notice of appeal is filed, the city clerk shall require the appellant
to pay a fee in accord with the schedule established by the city commission and
set out in appendix A to this Code,

(d) In any case where a notice of appeal has been filed, the decision of the board
shall be stayed pending the final determination of the case.

(4) Administrative responsibilities. Administrative responsibilities shall be as follows:
(a) The city clerk shall, In concert with the hearing officer. establish a timely date and
hour for the hearing and shall schedule a room at an appropriate location within
the city for the hearing. Should there arise a conflict in the hearing officer's
schedule. the officer shall be empowered to change the established hearing date.
(b) The city clerk shall give notice of the hearing In accord with the requirements
contained in article IV of this chapter. and shall also give such notice to the
parties of the appeal.
(c) The city clerk shall make available to the hearing officer the tape recording of the
proceedings before the board. .
(d) The city clerk shall tape record the hearing.
(e) Following the hearing, the hearing officer shall prepare the written findings and
decision. Copies of the findings and decision shall be mailed by the hearing officer
to each party to the appeal and to the city clerk.

The hearing officer's determination shall include appropriate findings of fact,
conclusions of law and decision in the matter of the appeal. The hearing officer
may affinn or reverse the decision ofthe board. and may impose such reasonable
conditions as the board may have imposed.

together with an application fee according to the schedule established by the city commission

(a) Current and proposed parking. pedestrian access. and vehicular ac~ss on the
site. and ingress and egress to the site;
(b) Current and proposed locations, setbacks, uses and gross floor area of buildings
and structures on the site;
(c) Current and proposed height of buildings and structures on the site;
(d) Current and proposed fences and landscape buffering, and perimeter and interior
parking lot landscaping on the site;
(e) Current and proposed site lighting on the site;
(f) Type and general location of the natural features on and immediately adjoining
the site. including significant natural vegetation and areas covered by tree canopy,
as well as regulated natural features such as wetlands, wetland buffers/setbacks,
natural drainageways or streams, waterbodies. mangroves. and designated
specimen and historic trees;
(g) Adjoining properties and the principal use(s) of these properties; and
(h) Such other ;nfonnation as the code administrator may require.
Any supplementary information. exhibits, plans or maps which are to accompany and
constitute part of the application shall be submitted to the code administrator at the time of filing
of application. Twenty copies of all such documents shan be required for dfstributional purposes.
Any amendment to a site plan approved by the planning and zoning board as part of a
conditional use permit involving increases in the intensity of use (as measured by residential
density or nonresidential floor area ratio), increases in structure height, or decreases In setbacks.
open space, or buffering shall be considered by the board as a modification to the conditional
use permit. Other amendments may be considered minor amendments and may be approved
by the development code administrator, unless determined by the code adminrstrator to be
appropriate for board action.
Sec. 41.032. Review procedures,
(1) The development code administrator shall, upon detennination that a conditional use
appllcatlon complies with all applicable submission requirements. receive the application and
instruct the city clerk to schedule it for public hearing by the planning and zoning board and give
notice of such hearing in accord with the requirements contained in article IV of chapter 36.
(2) The planning and zoning board shall consider the application and render a decision
at the conclusion of the public hearing unless the board detennines that action must be deferred
to allow for additional input and review.

A conditional use shall be approved by the board only upon detenninatlon that the

Sec. 41.035. Certiflcato of occupancy/use.
Prior to the initlation of any approved conditional use, a certificate of occupancy/use shall
be procured from the building official in accord with the' provisions contained in section 36.061.
In approving any conditional use. the planning and zoning board shall specify the period of time
for which such certificate may be procured. The board may, upon written request, grant
extensions to such time allotments not exceeding six months each without notice or hearing.

It is the purpose of this division to establish general and specific standards for the
planning and zoning board to consider when evaluating any application for a conditional use.

(1) The use shall comply with the land use plan and all applicable terms contained
In this development code, the building code, and this Code of Ordinances.
(2) Acceptable Ingress to and egress from the site shall be provided in a manner
and location which ensure optimum vehicle maneuverability and vehicular and
pedestrian safety. The number of ingress and egress drives shall be the
minimum necessary to provide reasonable access to the site.
(3) Noise generated from the use shall not unreasonably diminish the use,
enjoyment or value of surrounding properties.
(4) The direction and glare of lights from both motor vehicles and illuminating
fixtures on the site shall not adversely affect the use. enjoyment or value of
surrounding properties.
(5) Sufficient landscaping and screening shall be provided to diminish noise,
reduce glare and buffer high activity areas and objectionable views, including
but not limited to trash disposal facilities. such that the use will not adversely
affect the use, enjoyment or value of surrounding properties.
(6) Sufficient area shall be afforded for parking in accord with section 42.34.

3. Provision of buffers v perimeter landscaping shall meet or exceed
the standards of section 42.27 to the extent allowed by site design.
4. Site design - the applicant shall specifically demonstrate that the
site design, as detennlned by such factors as building orientation,
outdoor seating, outdoor loudspeakers, parking location, buffers,
site lighting, and access and loading area design and location, is
compatible with surrounding uses; and
(e) All occupational license approval standards, including the police
department background check of the applicant, shall be met prior to the
Issuance of an occupational license of the use; and
(f) In beach commercial and resort commercial 20ning districts, the use shall
only be permitted in delicatessens, or in shopping centers or hotels/motels
consistent with the provisions of section 41.071, except that expansion of
alcoholic beverage sales area and changes of business ownership for
existing nonconforming package sales uses may be considered. Not more
than five percent of the gross floor area shall be devoted to the sale or
display of packaged alcoholic beverages In delicatessens; and
(9) In the North Greenwood commercial district. no new package sales uses
shall be allowed, but expansion of alcoholic beverage sales area and

The basis of our appeal is as follows:
1) It is against the Pinellas County Land Development Code 138-
1332 (e) Prohibition of dispensing near churches or schools
stating "The dispensing of alcoholic beverages by any business
establishment shall not be permitted from any building or
structure within 750 feet, measured in a straight line, from the
nearest point of any such building or structure to the boundary
of any tract of land on which a church or school is located.1I

We have measured the distance between our school and the Karas'
store and found it to be approximately 150 feet which legally
disqualifies them from selling alcoholic beverages.
2) , OUr school is located right next to the above store. We
have almost 140 students from ages 2-16 at our school. Skycrest
Elementary is located right behind us and they have about 500
students there.
3) The sale of beer and wine will encourage people to purchase
such and drink them in the vicinity of the store, which not only
sets a bad example for our students, but also poses a risk to
them if someone should get intoxicated, wander onto our school
grounds and possibly accost our students.

4) People will be encouraged to purchase alcohol and consume it
while they are taking care of their laundry in the laundromat
next ,door.
S) We have 'already noticed suspicious-looking individuals near
or at the laundromat, which would only intensify with the sale of
alcohol right next door.
6) It simply is inappropriate for such sales to occur in the
vicinity of any school, especially when it is as close as in this
case!
Please take this appeal under very serious consideration, since
it concerns. the safety of a'lot of children in our'Clearwater
corranunity.

the nearest residential zoning district to the closest
portion of the building or structure; except that,
in a multitenant or multiuser building, such as a
shopping center, such distance requirement shall
be measured from any residential district

that a building or structure located on a bona fide
golf course or country club premises, in which al.

within the boundaries oCthe golf course or country
club and shall be located not less than 200 feet
from any residential st.rocture. The dispensing of
alcoholic beverages for on~premises consumption
in cortiunction with a bona fide restaurant may be
permitted by the board of adjustment as a special
exception within the 150 feet distance as required
herein (see section 138.240(20)).
(d) Dispensing for on-premises consumption by
social clubs, or veterans, fraternal, benevolent, civic
or other organization described in F.B. ~ 561.20(7).

or school is located or which has received legal
authority to locate. This subsection shall not be
retroactive; and the subsequent erection of a
church or school within such distance of a legally
authorized business establishment shall not be
cause for the revocation or suspension of any
penn it, certificate, or license, or cause for denial }
of any permit or certificate thereafter requested
for that use.

one time or at short duration fundraisers, special
events. promotions, etc., shall be exempt from the
provisions of this section, except for the unifonn
closing hours established in subsection (0 of this
section, under the following conditions:
(1) Sale or dispensing shall be for a maximum
of three days only during any six-month
period.

Mr. Hilton presented written background information, stating staff felt conditions support
the request and recommended approval with two standard conditions.
Robert Veurink, the owner/applicant was present the address the board. No verbal or
written support or opposition was expressed.
Member Mazur moved to approve Item C4, CU 96.56, subject to the following
conditions: 1) The applicant shalf obtain the requisite building permit(s) and certificate of
occupancy within six months from the date of this public hearing; and 2) All site lighting
shall be equipped with a 900 cutoff mechanism, with the light being directed downward
and away fr.om adjoining residential properties and street rights.of~way prior to issuance of
the requisite occupational license. The motion was duly seconded and carried
unanimously.
C5. J & Soohia Karas (Convenient Store) to permit package sales of beer and wine (change
of business ownership) at 1881 Drew St., Skycrest Unit 5, Blk F, Lots 1 & 2, zoned
CG (Commercial General). CU 96.57
Mr. Hilton presented written background information, stating a similar request was
approved in February, 1996. A new application was necessary due to a death in the family.
Staff did not feel the request will negatively impact the school within 500 feet of the subject
property. as the busj~ss has operated for many years. Staff felt conditions support the
request and recommended approval with four conditions.
Raid H. Snan, authorized representative, said the grocery store has existed more than 30
years in the present location. He is the on site manager, and plans no changes.
No one spoke in support or opposition to the request. One letter in opposition cited
concerns with beer and wine sales ;n proximity to a private school.
Member Bickerstaffe moved to approve Item C5, CU 96.57, subject to the following
conditions: 1) The applicant shalf obtain the requisite building permit, certificate of
occupancy and occupational license within six months from the date of this public hearing;

14 N Lincoln Ave, Padgett's Estates Sub, Lot 1, and part of Lot 2, zoned
UC(EHEastern Corridor). CU 96-58
Mr. Hilton presented written background information, stating the subject property has been
used for outdoor storage of recreational vehicles for many years. Conditional use approval is
needed to store boats 28 feet or less. Staff indicated the proposed use may be compatible
with surrounding properties if recommended conditions are met regarding screening, fencing
and stormwater retention. Discussion ensued regarding imposing a six month time limit for
conditions 1t1 through 115.
Art Glatt, representing the property owner, indicated he did not know opaque fencing was
required when he recently obtained his fence permit. He spent several thousand dollars one
month ago, enclosing the subject property with six foot chain link fencing. He expressed
concern with staWs recommendation to remove the chain link fencing and asked if opaque
material can be added. He submitted nine photographs showing conditions on and around the
subject property.
Board members expressed concern with the unaesthetic appearance of the fencing and
view presented by outdoor storage on the subject property. Discussion ensued regarding the
need for a. dense landscaping buffer to screen the perimeter. Ouestions were raised regarding
stormwater retention requirements. One member argued with code requirements for payment
of a fee in lieu of stormwater retention. In response to a question, Mr. Glatt said his request is
for outdoor storage only. Retail sales are part of the category he does not intend to pursue.
One person spoke in support of the application, stating he parks his big trucks on the
subject property. The fence is needed for security, but making it opaque gives criminals more
places to hide. One letter in opposition cited a concern the requested conditional use would
contribute to the "downward'" quality of the property
Discussion ensued regarding pros and cons of opaque fencing. Some members disagreed
with the logic of requiring payment of cash in place of stormwater retention and asked staff to
investigate the code. Mr. Hilton explained, when it is geographically impossible to build
necessary retention on a site, the applicant pays the City to build necessary retention farther
downstream. Ms. Dougall-Sides said, if retention is required by code, the applicant must
comply regardless of any conditions imposed by the board.
Board members stressed the need for a dense landscaping hedge outside the fence, if the
chain link remains. Certain members debated types of landscaping materials to require. One
supported oleanders, one did not. Some felt the recommendation should be left to City'
Environmental staff.

THIS ASSIGNMENT AND MODIFICATION OF LEASE is enfered into this 3 C!:!.

day of September, 1996, between JACQUE Y AMAN, hereinafter" Assignor," HAZIM
AL NA TOUR, hereinafter "Assignee," and. SOPHIA KARAS, hereinafter lIussor,. and
joined by RAED SNAN, ~ereinafter "Guarantor," regarding that certain Business Lease
dated August 9, 1995, for the premises known as 1881 Drew Street, Clearwater, Florida.
For good and valuable considerations, receipt whereof are hereby acknowledged,
and in consideration of the covenants set forth below, the parties agree as follows:
1. The subject Business Lease is modified by adding the [oHowing provisions: "No
modification or alteration to the leased premises shall be made unless the Lessee first
obtains the Lessor's written approval. Any request by the Lessee for approval of a
modification or alteration to the premj~es shall be accompanied by a sketch or plan of the
proposed modification or alteration. All modifications or alterations to the premises, if so
approved by the Lessor, shall be performed by licensed contractors also approved by the
Lessor. All contractors performing any modifications or additions to the leased premises
shalt, before 'commencing work, sign a waiver of any contractor's ljen rights regarding
the leased premises."
2. Assignor hereby grants, transfers and assigns to Assignee, all of Assignor's
right, title and interest in and to that certain Business Lease dated August 9, 1995, for the
real property and business premises at 1881 Drew Street, Clearwater, Florida, including

any interest of Assignor in and to any security deposit or deposits paid under the said
Business Lease.
3. Lessee shall be penniued. subject to the other provisions of the Business Lease,
, to install a walk-in cooler with customer access doors of an approximate dimension of 6
feet wide. twenty six feet long and eight feet high. The subject cooler shall be the
property of the Lessee contingent upon the following: the Lessee shall give the Lessor
written notice at least fifteen days in advance of the removal of the subject cooler: the
Lessee shall be required to remove any struclUre or (raming (or (he cooler prior to its
removal: the Lessee shall be responsible and shall repair any damage to the leased
premises by virtue of the removal of the cooler and the cooler structure and framing.
4. In the event the Lessee elects (0 use either or both of the coolers located in
structures on the south side of the building, the Lessee shan be responsible to put and
, maintain said coolers in good working order, and shall further be responsible for the
upkeep, maintenance, repair and replacement of the entire structures in which said coolers
are located. inclUding, but not limited to the roofs of said structures.

5. This Modification and Assignment of Lease shall not act to release Assignor
from full perfonnance of all of the covenants and obligations under the subject Business
Lease, and the Assignor shall continue to remain obligated on the subject Business Lease,
as modified, as if Assignor had not assigned his interest.

6. Guarantor hereby guarantees to the Lessor, her heirs, executors, administrators,

successors an~ assigns, as the case may be, the payment by the Lessee of the rent fixed in
the subject Bl!siness Lease, the payment by Lessee of all other sums fixed in the Business
Lease, and th1 performance by the Lessee of all of the lenns and provisions of the

Business Lease. Guarantor hereby acknowledges that the entry of this Modification and
Assignment of Lease by the Lesssor is consideration flowing to and received by the
Guarantor, and Guarantor is estopped from asserting or claiming lack or absence of
consideration as a defense to any of Guarantor's obligations hereunder. Guarantor
expressly agrees that the waiver of any or all rights of the Lessor against Lessee arising
out C)f defaults by the Lessee or otherwise shall not in any way modify or release the
obligation of Guarantor. Guarantor expressly waives notice of all defaults.
7. All of the terms and conditions described and set forth in the subject Business
Lease shall remain in full force and effect; however, should the provisions of this
Modification and Assignment of Lease conflict with the provisions of the Business Lease,
the provisions of the Modification and Assignment shall prevail.
8. The Effective Date of this Modification and Assignment of Lease shall be
September 1, 1996.
9. The parties acknowledge that Assignee has paid to Lessor the sum of $250.00
for cost of a credit check and for contribution towards the legal fees incurred by Lessor in

STAFF COMMENTS:
This Is a request for conditional use approval for package alcoholic beverage sales including beer
and wine (2-APS). A similar request came before the Board, and was approved on February 6,
1996. This particular change In business ownership emanates from a death In the familv. this
request appears to be appropriate, as the store has been In operatfon for many years.
The proposed hours of operation are: Monday - Friday 7:00a.m.-10:00p.m.; Saturday's 8:00a.m. -
10:00p.m.; and Sunday's 8:00 a.m. ~ 9:00 p.m. Although the store Is located within 500 ft. of
Skycrest Elementary School, the business should not negatively Impact the school or Its
surrounding propertles. The Clearwater Pollce Department reports no significant problems at this
site.
STAFF SUPPORTS THIS REQUEST SUBJECT TO THE FOLLOWING CONDITIONS:
1. The applicant shall obtain the requisite building permit, certificate of occupancy and occupational
license within 6 months of the date of this public hearing.
2. Any site lighting shall be equipped with a 90 degree cutoff mechanism, with the light being
directed downward and away from adjoining residential properties and streets rights-of-way
prior to issuance of the reqUisite occupational license.
. 3. The hours of operation shaU be Monday - Friday 7:00a.m.-10:00 p.m.; Saturdays 8:00 a.m. -
10:00 p.m.; and Sundays 8:00 a.m. - 9:00 p.m.
4. The business owner shall keep the property free of trash and debris on a daily basis.
