The worksession will be held in the Commission Chambers at the City Hall. Lunch will not be provided. The following is an "agenda" of issues to be discussed at this meeting which has been developed by the Central Permitting Department staff. Most of this information is the same as has been previously provided, but several notable changes have been made to the permitted use and conditional use issues (Issues Number 1 and 2 below), so please read those sections carefully. 1. PERMITTED USES. On September consensus was reached that the allowed as permitted uses: ~ Restaurants (4-COP-SRX licensed facilities OR other consumption on premises licensed facilities having 51% food sales, 15%' limit on lounge area, and no package sales). (Examples: Flagship, Frenchies, Arrigatos) 14, Commission following uses and Board should be ~ All restaurant, packaqe sales and nonrestaurant consumption on premises facilities located in a shopping center or reta~l complex up to 15% or 10% gross floor area caps, respectively. (Examples: Mall food courts; Ruby Tuesdays) ~ Packaqe sales uses located in an individual store containing a minimum of 25,000 gross square feet of floor area. (Example: Beer and wine sales in a grocery store) ~ Changes of business ownership for all alcoholic beverage sales facilities. .Given recent concerns about a proposed Walgreens locating in close proximity to Clearwater High School, staff suggests that there be use limitations placed on the first three of the above permitted uses prohibiting their location within 300 feet of a conforming church, school or park use, except in the Urban Center district. For changes of ownership, since' they involve existing facilities, staff recommends that this requirement not be imposed. " '~ ,"t i ,I ". '," Joint Worksession on Alcoholic Beverages November 10, 1993 Page 2 2 . CONDITIONAL USES STANDARDS AND BOARD ASS IGNMENT. Both boards recognize problems with existin~ standards for approval (both conditional use and separatlon distance variance standards), and feel a consolidated approach under the Plannin$ and Zoning Board is the right approach. The Commisslon has considered two proposed sets of standards (see attached Tables A and B). Table A provides the Planning and Z<?nir:g Board wi th f lexibil i ty in cc;>ns ic?-ering tl'~"~af.,.:.:.,.Y.f:,!}J.sP.:.:.,...f.,?:.:t.1 il,li.'.'\111.lliltijl~~~,~g;~~iii~~lff,fiIi1.1 altohbI"l'c'heVerage qUses.....within 300 feet of a conforming church, school or park (except the UC district), but allow the Planning and Zoning Board to consider such uses within 300 feet of a residential zone or a similar use. Table B prohibits consideration of cases which fall within the 300 foot separation requirement, except in three specified circumstances. Sta~f also suggests that new alcoholic beverage uses locating in shopping centers and retail complexes in excess of the respective 15% and 10% floor area "caps" be allowed to be considered as conditional uses. 3. APPEAL MECHANISM. The staff has recommended that appeals of Planning and Zoning Board actions on alcoholic beverages go to the City Commission instead of a State hearing officer. The Planning and Zoning Board would like to discuss this proposal to better understand staff and Commission perspectives. 4 . MEASUREMENT OF LOUNGE AND ENTERTAINMENT AREAS TO DETERMINE QUALIFICATION AS A RESTAURANT. The Planning and Zoning Board has requested clarification of how floor areas will be measured. Concern was expressed that the Flagship Restaurant on Island Estates would not qualify as a restaurant (if it was not licensed as a 4-COP-SRX facility) since it has a large lounge area. Staff would propose that the method of measurement be a three foot radius around any bar or designated entertainment area (such as a dance floor, stage, pool table, dart area, etc.). If movable tables are to be used, and these are located in the vicinity of a designated entertainment area, then this area would be counted as an entertainment area as well. This measurement technique would exempt most of the floor area associated with the Flagship's and similar facilities' lounge areas. 5 . SEPARATION DISTANCE MEASUREMENT. (NOTE: The following is repeated from the June 28, 1993 City Commission agenda item on alcoholic beverages.) How should distance between an alcoholic beverage sales establishment and a conforllling church, school or park use, residential zone, or otl1er alcoholic beverage use be measured? The current procedure is to measure from the nearest point between the structure containing the use and the nearest property line of the other affected property. A ~roperty line to property line measurement would el~minate thlS problem, while creating a more stringent separation requirement for uses located on separate properties. Recommendation: Given general Commission direction that some flexibility should be ~rovided to properties containing more than one alcohol~c beverage use, and that there be greater controls for separating uses on different ~roperties, staff would recommend going to a property llne to property line measurement technique. 6. VARIANCES. (NOTE: The following is repeated from the June 28, 1993 City Commission agenda item on alcoholic beverages.) Issue #7: Should variances be permi tted? The staff originally recommended a conditional use permit standard that no variances be permitted for alcoholic beverage sales uses. The Commission had concerns about possible exceptions that might be desired. For example, the Beachcomber sign variance would not have been allowed had the restaurant received conditional use permit approval under the proposed conditions. Under the proposed conditional use permit standards in Tables A and B, no parking variances would be allowed and perimeter (buffer) landsca~ing consistent with City code would be an automat~c requirement. Recommendation: Given general Commission direction for 'greater controls over alcoholic beverage uses, staff would recommend establishing a standard of approval that no parking variances be permitted. This would allow consideration of other variances, such as, variances to signage, setback, height, and open ,space requirements. . , '7. OTHER ISSUES.
