He questioned a suggestion regarding the light duty policy. Staff reported this is being reviewed.

Welcome to the October l1t 1993, Public Information Workshop for the proposed Keene Road project.
The specific: purpose of this workshop is to review preliminary plans for the portion of Keene Road
from Gulf.ta-Bay Bouleyard to Virginia Street. (See Figure 1). The Keene Road project is a highway
design and construction project to extend Keene Road from its current end at Gulf-to-Bay Boulevard
in Clearwater to Alderman Road in Palm Harbor. The project has been divi~ed into, several phases
as follows. Please note that only the phases shown in bold type are the topic of this workshop (Phases
I, IU. Vll).

I ll. PROJEGr OVERVIEW
The Keene Road/C.R. 1 corridor has been an integral part of Pinellas County's long-range highway
plans for over 15 years. The present MPO 2010 Long Range Plan, first adopted in 1984, included
Keene Road as a four-lane divided roadway between S.R. 60 and Alternate U.s. HWY 19. This MFO
Plan has been amended several times since it was first adopted and today (1993) the Keene Road
corridor is still an important part of the overall transportation plan.
Currently the primary north/south travel corridors in central and northern Pinellas County are U.S.
HWY 19, Alternate U.S. HWY 19 and Belcher Road. Collector roadways such as Hercules Avenue
and Highland Avenue supplement this north/south traffic flow. The Keene Road/C.R. 1 corridor
between Gulf-to-Bay Boulevard and Alternate U.S. 19, will provide a major north/south thoroughfare
in northern Pinellas County and will serve as a much needed parallel traffic reliever for Alternate U.S.
HWY 19. Major portions of this corridor already exist as either two-lane or four-lane facilities.
However, several discontinuities and missing segments severely limit the overall effectiveness of the
corridor. The section between Virginia Street and S.R. 580 has just been constructed but the full value
of the roadway will not be realized until the missing segments near Gulf-to-Bay Boulevard, Sunset
Point Road and areas north of Nebraska Avenue are constructed. This roadway project will provide
a 90ntinuous multi-lane thoroughfare between St. Petersburg on the south and Palm Harbor on the
north.
In February of 1987 the Pinellas County Subdivision Regulation Sector Plan,. Traffic Corridor Plan and
Right-of-Way Requirements Plan was adopted. This plan established a lOo-foot wide right-of-way for
,Keene Road between Gulf-to-Bay Blvd. and Alternate U.S. HWY 19. Much of the needed land for
the extension of Keene Road has been dedicated or acquired in accordance with this plan. The
roadway will typically be situated within a 12Q..foot right-of-way, south of Drew Street and within a 100-
foot right-of-way north of Drew Street.
The schematic plans shown here tonight and the Preliminary Engineering Report were based on traffic
forecasts for the northern Pinellas County area using information provided by the County MFO and
data collected by King Engineering Associates, Inc. Traffic forecasts, roadway and intersection designs

were developed using state-of-the-art techniques, and current roadway design standards. The roadway
and intersections were designed to accommodate maximum traffic flows through the year 2015 and to
provide relatively smooth flowing traffic operations. Throughout the study and design, special attention
was given to left turn and right turn storage lanes at intersections to ensure adequate storage area.

The need to minimize additional right-of-way acquisition and construction costs was very important.
Right-of-way cost will be minimized by using areas already dedicated to the County for this project and
construction costs were minimized by analyzing several alignment and construction options.
The schematic plans show that the roadway needs to be a six-lane divided urban facility with curb,
gutter and sidewalks between Gulf-la-Bay Boulevard and Drew Street. North of Drew Street to
Virginia Street, the roadway will be a four-lane divided urban facility also with curb, gutter and
sidewalks throughout (see Figure 2). Full median openings will be provided at acceptable distances
to provide for V-turns and access to side roads. The predominant posted speed limit will be 45-mph
and truck traffic may be restricted to daytime hours.
The typical section (see Figure 2) includes a 20-foot wide grass median and two or three travel lanes
in each direction. The inside lanes will be 12-feet wide and the outside lanes will be 14-feet wide to
accommodate bicycle traffic. Recovery area between the back of curb and the right-of-way is 12 feet
in most areas and will include a sodded area and a sidewalk to accommodate pedestrian traffic.
On display at this meeting are: graphics depicting the Project area; the schematic plans for the
alignment being considered (including right-of-way requirements for the improvements); typical sections
for the roadway; cost estimates and schedules (see Figure 3); and other additional information
regarding drainage and environmental considerations.
Technical staff from the County's Department of Public Works and King Engineering Associates, the

engineering consultant assisting tbe County with this study, are available to ~er any questions you

WHAT HAPPENS NEXT?
At the conclusion of this workshop, all of the comments received will be considered by the PinelIas
County Department of Public Works. Taking into account the public input received and the
documentation developed by the consultant (included in the Preliminary Engineering Report), the
Public Works Department will make a recommendation to the Board of County Commissioners
regarding initiation of the construction documents.

Amend our annual contract with Schlumberger Industries, Owenton, KY, for the purchase of gas
meters and regulators to increase the estimated contract total by an estimated cost of $10,746 to a
new estimated total of $ 77,512
~ and that the appropriate officials be authorized to execute same.
BACKGROUND:
Bid 45-93 covered Clearwater Gas System's annual needs for 11 gas meter & regulator related items
to various vendors for the contract period of 3/5/93 to 3/4/94. Schlumberger Industries was
awarded a contract for six (6) of these items under Purchase Order #1351 in the amount of
$66,766. The other vendors are Key Control, National Meter and Equipment Control. The
Schlumberger Industries' purchase order is the only one that needs to be modified as we are
exceeding our projected annual quantity requirements.
During the first nine (9) months of the contract period, Clearwater Gas System connected a greater
than expected number of large up-scale residential homes with high consumption gas loads. The
majority of these homes had pool and spa heaters that required the use of Size 675 gas meters that
had been originally projected for use on new commercial accounts. The larger gas loads from these
residential accounts are certainly enjoyed; however, the inventory of one (1) inch regulators and Size
675 gas meters for the year has already been exhausted.
Clearwater Gas System needs to purchase 48 additional one (1) inch gas regulators and 18 additional
Size 675 gas meters with connections at an estimated annual cost of $10,746. This amendment
will provide the necessary regulators and meters to connect small commercial and large residential
customers for the remainder of the contract period to 3/4/94. Schlumberger Industries has agreed to
honor the bid prices of the original contract for these additional purchase quantities.

RECOMMENDATION/MOTION: Award a contract for Arcturas Pond/Allen's Creek Dredging
and Weir Replacement project (93-31) to SUNCOAST EXCAVATING, INC. of OZONA,
FLORIDA for the sum of $94,650.00 which is the lowest responsible bid received
in accordance with the plans and specifications,
au and that the appropriate officials be authorized to execute same.
BACKGROUND:
In July of 1986 the ci ty received a permit from the Florida Department of
Environmental Regulation to excavate an area of Allen's Creek known as Arcturas
Pond. This was done for the purpose of providing increased stormwater detention
and silt retention. However, design water elevations could not be maintained due
to the failure of an old existing weir incorporated in the design and located at
the south end of the pond. This failure caused lower water elevations which
deviated the purpose of the pond. This project, as designed, will replace the
failed weir, remove 700 cubic yards of accumulated sediment, construct a littoral
shelf for water quality purposes, provide an area for sediment removal, and
restore the detention capability.
The available balance of $108,628 as of September 30, 1993, in the Miscellaneous
Ponding capital improvement project is sufficient to fund this contract.

Bioassay tests for the Water Pollution Control Division.
RECOMMENDA 110 N/MOTION:
Award a one year contract (11/02/93 - 11/01/94) to Marinco Laboratory, Sarasota, Florida,
for the purchase of bioassay tests for Water Pollution Control Division at a cost of '
$18,600.00, which is the lowest most responsive bid submitted in accordance with
specifications,
~ and that the appropriate officials be authorized to execute same.
BACKGROUND:
The City is required under the terms of the U,S. Environmental Protection Agency (EPA) and
the Florida Department of Environmental Protection (DEP) operating permits to have bioassay
tests run bimonthly on its treatment plant effluents. The frequency of the tests, while
specified in the permits, can be changed via administrative order, or permit reissuance by
either agency.
While the City of Clearwater operates a modern, advanced, state certified laboratory with
significant capabilities, these tests are highly specialized and involve the use of living
organisms. The cost to do the bioassay tests in-house would be prohibitive for the limited
number of tests required. An in-house program would require capital expenditures to
construct a building with a controlled environment. Special equipment would be needed for
rearing, holding and acclimating organisms. These organisms must meet the criteria set by
EPA and DEP for toxicity testing and care must be taken to ensure that test organisms
obtained from outside sources are disease-free. Passing the toxicity tests requires not only
survival of tests species, but also demonstration of adequate growth and reproduction rates
in 'a wastewater effluent environment. Failure to maintain a healthy population of anyone of
the four required test species, could result in a violation of the EPA and DEP discharge
permits. Additional laboratory staff with training in aquaculture would be needed to monitor

PART IV
Whole Effluent Toxicity Testing Program
As required by Part -I- of this permit, the p~rrnittee shall initiate
the series of tests described below beginning" in October'1993, to
evaluate whole effluent toxicity of the discharge from outfall 001.
All test species, procedures and quality assurance criteria used,
shall be in accordance with Short-term Methods for Estimating the
Chronic Toxicity of Effluents and Receivinq Waters to Freshwater
Orqanisms~ EPA/600/4-89/001, and Methods for Measurinq the Acute
Toxicity of Effluents to Freshwater and Marine OrQanisms, .'
EPA/600/4-90/027, or the most current edition(s). The
dilution/control water used will be a moderately hard water as
described in EPA/600/4-90/027, Table 6 (or the most current
edition). A standard reference toxicant quality assurance test shall
be conducted concurrently with each species used in the toxicity
tests and the results submitted with the discharge monitoring report
(Or.LQ,,)-;'---Alternatively;- if monthly QA/QC reference toxicant tests_ are
conducted, these results must be submitted with the D~ffi.

Test. These tests shall be concucted using a cont=ol (0%
ef fluent) -and one test' concentration consisting of 97.5%
effluent (equivalent to the Receiving Water Concentraticn
(RWC) of the effluent in the receiving water at critical
conditions). Unacceptable ch=onic toxicity will be
demonstrated if either test results in a no observable
effect concentration (NOEC) less than 97.5% effluent. All
test results shall be statistically analyzed according to
A~pendix H, EPA/600/4-89/001, or the most current edition.

paragraph 12.10 or Section 10, paragraph 11.11,
EPA/600/4-89/001 (or the most current edition), that test
shall be reDeated. A chronic test will be considered valid
only if the~ acceptability criteria referenced above are met.
If 100% mortality occurs in the RWC test concentration prior
to the end of the test and control mortality is acceptable
at that time, that test (including the control) shall be
terminated with the conclusion that the sample demonstrates
unacceptable chronic toxicity.

The permittee shall also conduct a 48-hour acute static
toxicity test on the daphnid (Ceriodaohnia dubia) and a
96-hour acute static-rene~al toxicity test on the fathead
minnow (Pimeohales prornelas) using ~ test concentration of
100% effluent. Unacceptable acute~oxicity will be
demonstrated if more than 50% lethality of either test
species occurs in the 100% effluent sample prior to the end
of the test.
For each set of tests conducted, a fresh 24-hour composite
. sample of final effluent sh~ll be used at pay 1 of both, the
daphnid and the fathead minnow tests and at Day 3 of the'
fathead minnow test. For the fathead,minnow test, feeding
and solution renewal shall be done at 48, hours with a
portion of the original sample that has been kept'
refrigerated. If c~ntiol'mortality exceeds 10% for either
species, the test for that species (including~the control)
shall be repeated. An acute test will be considered valid

entered on the DHR for that species. If the NOEC of a

4. a.. If unacceptable chronic toxicity (a NOEC less than 97.5%
effluent in either test) and/or unacceptable acute toxicity
(greater than 50% lethality of either test species in 100%
effluent) is found in a "routine" te,st, the permittee shall"
conduct two additional toxicity tests based on the type of
unacceptable toxicity found (i.e., chronic and/or acute
tests, as appropriate), on the specie(s) indicating
unacceptable toxicity. For each additional test, the sample
, collection requirements and test acceptability criteria
,~ specified in Section l(b) and/or 2(b) above, as appropriate,
' ~must be met for the test to be considered valid. The first
test shall begin within two weeks of the en~ of the '.
"routine" test and the second test shall be conducted two
weeks later. If either or both of these tests are invalid,

of Effluents to Freshwater and Marine Organisms, EPA/600/4-90/027, or
the most' current edition. The control water and effluent used wil~
be adjusted to a salinity of 20 parts per thousand using artificial
sea salts as described in EPA/600/4-90/027, Section 7 (or the most
current edition). In addition, for the inland silverside test,
feeding and solution renewal shall be done at 48 h9urs with a portion
of the original sample that has been kept refrigerated. A standard
reference toxicant quality assurance test shall be conducted
concurrently with each species used in the toxicity tests and the
results submitted with the discharge monitoring report (D~ffi).
Alternatively, if monthly QA/QC reference toxicant tests are ,
conducted, these results must be submitted with the D~Lq.

The p~~hlittee shall conduct 48-hour acut~ static toxicity
tests using the mysid shrimp (Mvsidoosis bahia) and 96-hour
acute static-renewal toxicity tests using the inland
silverside (Menidia bervllina). All tests will be
conducted on four separate grab samples collected at
evenly-spa~ed {6-hr) iritervals over a 24-hour period and
used in four separate tests in order to catch any peaks of
toxicity and to account for daily variations in effluent
quality.

If control mortality exceeds 10% for either species in any
test, the testes} for that species (including the control)
shall be reoeated. A test will be considered valid only if
control mortality does not exceed 10% for either species.
If, in any separate grab sample test, 100% mortality occurs
prior to the end of the test, and control mortality is less

shall be terminated with the conclusion that the sample
demonstrates unacceptable acute toxicity.

The toxicity tests specified above shall be conducted once
every two months until 6 valid bimonthly tests have been
completed, and once every 6 months thereafter for the
duration of the permit, unless notified otherwise by EFA.
These tests are referred-to as "rout:.i,ne" tests.
b. Results from "routine" tests shall be reported according to
EPA/600/4-85/013, section 13, Report Preparation (or the
most current edition), and shall be subrnitted,as an ,
.attachment to the DMR. Such results are to be entered on
the DMR in the following manner: if less than 50% surviva~
of a test species occurs in any of the, four separate grab '
sample tests, '<100%' should be entered on the DMR for that
species. If 50% or greater survival occurs in all four
separate grab sample tests, '>100%' should be entered.

If unacceptable acute toxicity (greater than 50% lethality
of either test species in any of the four separate grab
sample tests within the specified time) is found in a
"routine" test, the permittee shall conduct three,
additional acute toxicity tests on the specie(s) indicating
unacceptable toxicity. For each additional test, the
sample collection requirements and test acceptability
criteria soecified in Section 1 above must be met for the
test to be~considered valid. The first test shall begin
within two weeks of the end of the "routine" tests, and
shall be conducted weeklv thereafter until three
additional, valid tests ~re completed. The additional
tests will be used to determine if the toxicity found in
the "routine" test is still prese'nt.
b. Results from additional tests, required due to unacceptable
acute toxicity in the "routine" tests, shall be submitted
in a single report prepared according to EPA/600/4-90/027,
Section 12, Report preparation (or the most current
edition) and submitted within 45 days of completion of the
third additional, valid test.
4. All tests shall be conducted using a control (0% effluent) and
one test concentration of 100% effluent. For those tests
conducted prior to the effective date of the total residual
chlorine limit, samples of 100% effluent which have been
artificially dechlorinated must be used. For those tests
conducted after this date, samples of 100% final effluent must
be used.

a. The permittee ~ha11 initiate the series of tests described
below within sixty (60) days of the effective date of this permit
to evaluate wastewater toxicity. The permittee shall conduct 96
hour static renewal acute toxicity screening tests on the test
gn~~tpR.' CeriadaQhn~a dubia and pimephales prom~~as, once every
two months (bi-monthly) on samples of 100% whole effluent. Such
static renewal tests will be conducted on four separate grab
sarnpres of 100% whole effluent . Such static renewal acute
to~iclty screening tests will be conpucted on four separate grab
samples of 100% final effluent collected at evenly spaced (6-hour)
intervals over a 24-hour period'and used in four' separate acute
toxicity screening tests in order to account for daily variations
- in effluent quality.
Once the permittee has demonstrated to the satisfaction of the
Departm~nt that there are no effluent toxicity peaks and no
,diurnal toxicity variations resulting in violations, the frequency
of the above described requirement for bi-monthly testing may be
changed to become once every 6 months thereafter for the duration
of the permit, unless notified otherwise by tlle Department.
b. If control mortality exceeds 10% of either species in any
test, the test(s) for the spe~ies (including the control) shall be
repeated. A test will be considered valid only if control
mortality does not exceed 10% for either species. If, in any
separate grab sample test, 100% mortality occurs prior to the end
of the test, and control mortality is less than 10% at that time,
that test' (including the control) shall be terminated with the
conclusion that the sample demonstrates unacceptable acute
toxicity. .

c. If any such bi-monthly acute toxicity screening test
indicates that 'unacceptable toxicity (less than 80% survival of
test 'organisms in 100% effluent). is found in any sample of
effluent, additional (definitive-acute static renewal toxicity
testing inVolving the, determination of 96-hour LeSO values with
95% confidence limits will be required. A minimum of three (3)
such 96-hour additional tests are required to be conducted within
30 days from the date that any screening test indicates the
presence of toxicity. Preferably, the first of these additionul
teste shall be initiated wi thin seven days 'of a' failed screening
test. The second test shall be initiated at least seven (7) days
after completion of the first additional test. Such tests shall
be conducted using that test species which exhibited the most
toxic response in the screening tests above, and 'shall be taken at
the same time of day and day of the week during which the greatest
toxicity was exnibiteu.

COMMISSION RULES
RULE 1
A quorum for the transaction of business by the City Commission shall consist of
three (3) Commissioners. Presiding officer of the City Commission shall be the
Mayor-Commissioner. In case of his absence, the Vice Mayor shall assume those
responsibilities, and if both are absent, the senior Commissioner in years of
service shall preside. The presiding officer shall preserve order. He may call
to order any member of the Commission who shall violate any of the rules; and,
when in the chair, he shall decide all questions of order, subject to a majority
vote on a mot ion to appea 1. The cha ir s ha 11 recogni ze all Commi ss ioners who seek
the floor under correct procedure. Normally, members of the public shall be
allowed to speak, but they shall be limited to three (3) minutes speaking time
per issue. All questions shall be stated and put by him, and he shall declare
a 11 votes.
RULE 2

The City Clerk shall make correct minutes of the proceedings of each Commission
meeting, and shall furnish copies of the minutes of each regularly scheduled
meeting to the Mayor-Commissioner and to each Commissioner at least twenty four
(2q) hours prior to the next regulJr meeting. Copies of the minutes of a reqular
daytime meetinq shall be furnished at least seven da~s, when possible, prior to
the next reqular daytime meetina, and copies of the minutes of a reqular niqht
meetinq shall be furnished at least seven days, when possible, in advance of the
next reqular niaht meetinQ. Such minutes shall stand confirmed at the regular
meeting of the Commission without the reading thereof in open meeting unless some
inaccuracy or error be pointed out by some member of the Commission present, and
in such event, an appropriate correction shall be made. Upon request, the City
Manager will cause the City Clerk to provide any Commissioner with transcribed
, excerpts of tapes of City Commission wopkshops or regular or spcci31 meetings.

'All motions shall be made and seconded before debate. Every ordinance shall be
'read at two (2) distinct Commission meetings before it is passed, except when it
is designated an emergency and receiving a 2/3 vote of ' the Commission. Such
emergency ordinance shall remain effective for ninety days after effective date.
All resolutions, ordinances and contracts require three (3) affirmative votes for
passage.

(1) The City Commission shall meet on the first and third Thursdays of
each month at 6:00 p.m. in its chamber ("reQular nioht meetinos"), and on the
Mondays before the first and third Thursdays at 9:00 a.m. or at such other time
as shall be announced not less than 24 hours in advance ("reoular daytime
meetinos"). Special meetings may be held on call of the Mayor-Commissioner, City
Manager or any two of the members and, \vhcnever possible, upon no less than 24
twenty four (21) hours public notice to the public and to the members of the Citv
Commission.
(2) Aqenda items may be scheduled for a reqular daytime meetinq or a
reqular niqht meetinq, except that items requ;rinq a public hearinq shall be

(3) Except for items advertised for public hearing, items may be removed

Minutes shall be taken and distributed by the City Clerk. Only staff members
shall be included in the work session discussion unless prior arrangements are
made through the City Manager.
(4) A regular meeting or special meeting shall conclude at approximately
midnight unless the time of adjournment is extended by the unanimous consent of
the members of the Commission in attendance. The Mayor shall adjourn the meeting
upon the conclusion of the item of business which is under discussion at
midnight. Wit the unanimous consent of the members of the Commission in
attendance, the meeting may be extended for such time as is necessary to discuss
and act upon any of the remaining items of business on the agenda as the members
may agree. Uncompleted agenda items shall be automatica lly postponed to the next
regular meting and included on the appropriate agenda unless such items are
placed upon the agenda of a later regular meeting or a special meeting, as a
majority of the members in attendance may agree. Notwithstanding the foregoing,
the setting of meeting dates, the scheduling of uncompleted agenda items for a
regular or special meeting, and a motion to adjourn shall be in order regardless
of the time of night.

shall be delivered by the most economical method to the chairman of such

No Commissioner shall vote in his official capacity on a matter in which that
Commissioner has a direct or indirect personal or financial interest, or which
inures to his special private gain, or to the special gain of any principal by

meeting the nature of his interest and within fifteen (15) days after the
Commission meeting file with the City Clerk a Form 4 to describe the nature of
his interest in the matter. The Form 4 shall be received by the City Clerk and
incorporated into the minutes of the meeting.

During a recent meeting with Bill Baker in attenda.I1ce, we were discussing how to have fresh
water supplies for the City of Clearwa.ter. During that conversation, it was brought up that the
fresh water effluent that is being put into Tampa Bay, is a possible source of fresh. water -
through the conversion, first,of maldng it blackish water I and then using a reverse-osmosis plant
to convert it back into potable drinking water.
I don't know whether this is a valid thing that we s.hould start studying, or whether we should
just be studying building desalinization plants. etc.
A fresh water supply for the citizens of Clearwater is an issue that requires long-term planning.
It should be done in cooperation with the County aIld with Swiftmud. but I believe the City of
Clearwater has the responsibility to its citizens to not sit idly by, waiting for the County 01
Switfmud to see to it we have plenty of drinking water.
I would like the City Commission to develop an Ad Hoc Committee to study all levels of this
problem and bring to the Commission possible solutions. I understand that former
Commissioner Lee Regulski is interested in this issue. and also citizen activist, Roy May. There
are, I am sure, some other citi2ens who are interested in this issue. I would like this Committee
to be composed of five citizensl one from each of the Commissioners and the Mayor as their
Iepresentatives. Please put on the Agenda the creation of such a Committee, and then we can
determine whcth.cr or not there is su'pport for this issue.

Have we ever established a polley where there is a maximum number of items one individual
may check out at a time, and that there is a maximum number of items that they can have totaUy
checked out at anyone given time?
In reviewing the circulation list, it sbows some abuse. That abuse can be easily corrected by
creating a polley for what can be checked out; what period of time it can be checked out for;
,how many items can be cl1ecked out at a given time, and how many total items can that
individual have at a given tim.e. That would keep them from going evety other day to check out
another item until they have 100 items checked out and in their possession.
I believe this should be discussed from a policy point of view by the Commission.

The Clearwater Public Library System has not had a
limit on the number of library materials which could be
checked out on one library card for, at least, the last
twenty years. Some of the staff seem to remember a limit
of four books on a subject in the early 1970's.
We surveyed the surrounding public libraries and
found the following results:

At Tuesday's budget session, commission Thomas again
requested statistics on how frequently individuals check
out library materials. For confidentiality purposes, we
do not keep materials records tied to individual library
customers after the materials are returned; therefore,
statistics representing library usage over time are not
available.
Perhaps his concerns can be addressed, though, with
the attached data, which looked at all materials which
were out on patron cards on a given date. We ran a
statistical analysis on September 1, 1993 (a "slow" time
of year), which showed that, on that date, 54,249 library
materials were checked out on 17,284 library cards (an
average of 3.14 per borrower.
Of that 17,284 library patrons, 151 had more than 25
items checked out on their cards. Of that 151 "large
users", 118 were Clearwater residents, 23 were non-
residents, five were city employees, two were temporary
residents, and three were internal library codes.
A further breakdown showed that only one customer
had more than 100 items checked out at this time. This
person was a Clearwater resident, a school teacher, and
the books were children's materials checked out from the
Main Library.
Five customers had 50-99 items checked out at one
time. Four were school teachers who had checked out
children's materials from the Main, Countryside, and East
Branches. The other \vas a Clearwater nursing home, which
is served by our Red Cross volunteers.

Also included in the 25-49 category are some library
internal use cards (storage, mending, processing) and
some "dead" files which are patrons who had long overdue
books when the computer system was implemented in 1985.
Perhaps a more reliable indicator of potential non-
resident usage if/when Clearwater joins the pinellas
Public Library Cooperative will be a statistical analysis
of the circulation patterns of those surrounding
libraries which are co-op members. I am now compiling
that report and will have it ready for the Budget
Advisory Committee's meeting on September 30.

This is an event to promote community awareness with special
emphasis on the new countryside Community Center. The event is to
be held at Misty Springs Park.
Mayor Garvey, Commissioner Fitzgerald, and Commissioner Berfield
attended our first. The approximate 600 attendees were delighted
with this event and hope to expand this to 3,000. There are 364
families encompassing the Countryside area that requested an
interest in the Countryside Day Second Annual Event.
We are requesting $10,000 in order to fund this informative
community event that will promote and inform the entire community.

Dear Mr. Wright:
As you are aware, I have been retained by Frank Malowany, as
president of Snell Isle Properties, Inc., for the purpose of
consummating a fee agreement between the City of Clearwater and
Snell Isle Properties, Inc.
Mr. Malowany has no desire to be a consultant to the City of
Clearwater, nor does he expect to have an exclusive agreement with
the City of Clearwater to sell or lease said Maas property. ~rr.
Malowany has been approached by certain out-of-state investor
groups / developers, who have expressed desire in developing a
significant parcel of real estate for retail and/or other
commercial uses. Presently, Mr. Malowany is checking sites of
coastal property throughout the State of Florida. However, the
Maas property fits the description and requirements of his "group",
and it happens to be in our own back yard. Qui te simply, Mr .
Malowany has the desire and ability to introduce his investors to
the City of Clearwater, which could prove to be valuable to the
City of Clearwater. 'However, my client desires to be paid a fee
for his services. At the present time, this out-of-state group
I have seen the minutes from the August 2, 1993, meeting of the
City Commission, and I believe that there was some confusion among
the Commission members as to the intent and purpose of said
Agreement. From the comments of Commissioner Thomas and
Commissioner Deegan, I am of the impression that the Commission
believed this Agreement to be some type of "exclusive" broker or
consultant agreement.

knows nothing about the City of Clearwater, and they remain unaware
of the potential for development of the Maas property.
Under the "Fee Agreement II. as previously proposed, the City remains
open to "talk with anyone having a proposal". So too, the City
could take one look at my client's i.nvestor group, and discard the
whole idea. However, should my client be the one to procure the
developer which is ultimately selected by the City of Clearwater to
develop the Maas real property, then my client should be entitled
to compensation. Mr. Malowany will not work for free, and I doubt
that this development group will become aware of the Maas site by
any other means. In any event, it is a "no risk - no lose"
proposition for the City of Clearwater.
The agreement, as previously submitted, was simply a proposal and
remains subject to some negotiation. I request that the City of
Clearwater revisit my client's proposal, and further request an
opportunity for my client to address the City Commission at an open
forum. Kindly advise.

parking enforcement officers to issue tickers without said training. I would Ilke to
suggest that we include in our package For the upcoming legislative session that a
similar provision be ma.de in the state law to pennit code inspectors to issue tickets
for code violations.

Removal' of Certain Dunes on Clearwater Beach

The Public Works Department has for some time been concerned with the problem of the
removal of wind-blown sand from the parking lots and ether publio facilities at Clearwater
Beaoh. After each storm, as well as when normal wind-driven sand accumulates, we must
gather and remove sand from public facilities at the beach. In the Spring of 1990 we
dredged 4,000 cubic yards of saod whioh had accumulated in the Clearwater Harbor cove
adjaoent to Coronado Drive (where the pirate ship docks). We believe that oertain sand
dunes along the beaoh adjacent to our facilities are significant contributors to thIs ccn,stant
maintenanoe problem. It is our desire and Intention, with your permission of course, to '
properly seek a permit for the removal of these dunes I

It Is our Environmental office's assessment that the use of the property maintenance
consideration is the best strategy for obtaining the necessary permits for the removal 'of
the dunes. We believe that we can take the palm trees and sea oats out, remove or
spread the sand on the beach, and replace the trees and oats in their exaot previous
oonfiguration. It mayor may not be a .,ermit requirement that the dunes be mitigated by
re-establlshing a like number in a location less sensitive to sand accumulation impacts.
Our Environmental offioe would apply to'the Florida Department of Environmental
Protection for the permits on the basis of the dunes' Interference with the maintenanoe of
PIJ~lic faoilities, and our Infrastructure crews would accomplish the work. I believe we can
,handle this In-house and within our existing budgets. We do not believe that the existence
of the dunes In this particular circumstance has been a major contributor to the accretion
of the b~BCh, nor wo'uld thei,r removal have a negative effect on the ~each's stability.
The dune olusters arG in three locations. those located approximately midway between the
Adams M~uk Hotel and the South Beach Pavilion, Immediately adjacent to our parking lot;
those located approximately opposite the swimming pool end parking facilities immediately
south of the Holiday Inn Surfsidei and those located adjaoent to our north parkIng lot near
the Rookawav Pier.

It has become apparent to me that members of the City Commission are becoming involved
in administration of the city through the continual directives sent to the City Manager or
directly to Department Directors. The most recent correspondence is on September 15 from
Commissioner Thomas concerning Flooding on Harbor Drive; September 15 from
Commissioner Thomas concerning Non-smoking policy in city vehicles; and September 17
from Commissioner Deegan concerning direct debit billing by the Clearwater Utilities
Departmen 1.
I request that all directives to the City Manager or others by individual Commissioners be
agendaed and approved by the majority of the City Commission at a City Commission
meeting.
I believe that it is imperative that we "all tl be part of the team and should agree upon
directives to city staff.

fislling pier to replace the removed) old causeway bridge. The minutes of the Marine Advisory
Board reflect a unanimous vote for the construction of a fishing pier at the east end of the
mmi;na.
Funding for the pier could come from "Penny for Pincl1as" or "unappropriated Federal Funds".
Mr. Held estimated the cost of the project to be $40,000 to $50,000. Construction of the pier
could be provided by City employees.

This is in response to Commissioner Thomas' request for followup information, including
a resurvey of the land uses, concerning the N. Fort Harrison Zoning Study.
Commissioner Thomas had one question in his memorandum - whether Ordinance No.
5309-92 allowed nonconforming residential structures to be rebuilt in the existing footprint.
That ordinance addressed a zoning change only, revising the zoning of a portion of the
study area from RM-8 to RS-8 (from multifamily to single family). The Commission did act
to exempt certain properties on the north side of Venetian Way from the rezoning, thereby
allowing them to remain zoned for multiple family.
The Commission recently adopted Ordinance No. 5411-93 that allowed reconstruction of
nonconforming single family residential uses.2!J.ly. At the conclusion of the discussion and
action on the N. Fort Harrison Zoning Study, the Commission directed staff to research the
potential effect of a similar regulation for multifamily structures. We anticipate providing
the Commission with a report on this within 60 days.
Commissioner Thomas also requested that the N. Fort Harrison area be resurveyed to
determine the accuracy of the material that the staff presented at the City Commission
meeting. As this is a potentially lengthy survey, I anticipate that it will violate the "Eight
Hour" Rule. Also, the resurvey may not be necessary if the code is changed to allow
nonconforming residential uses to be reconstructed. Consequently, I am requesting
permission to delay this study until we are able to present the Commission with our findings
concerning the addition of multiple family uses to the nonconforming use regulation section
covered by Ordinance No. 5411-93, or until the Commission directs that the resurvey
should be an immediate priority work task.

Attached is a letter that I received and feel that it is important to share Mr. Schoenherr's
thoughts with the Commission. The Commission spent a lot of time and effort on this particular
item at the September 16, 1993 Commission Meeting. I believe that I suggested that the City
allow all existing dwellings to be rebuilt to their original specifications in case of a disaster!

Another comment in Mr. Schoenherr's letter referenced a map that the City used at the above
mentioned Commission Meeting. I recall that another gentleman indicated that the map was
incorrect, that the map in fact did not display all of the duplexes/rental property. I also recall
that the Mayor suggested that perhaps they were Ulegal properties and, that was why some
properties were not indicated as rentals.

1.) If North Fort Harrison were allowed to be supported and
changed, the housing behind it would change acoordin.gly. I
tried for 7 Months to open up my business on North Fort
Harrison in what was at that tiMe a vacant building for a
years. My criae La that I was 2 parking spaces short for .Y
~etail use. The building reaalned vacant for 6 .ore aontbs
before beoo~lng a pawn shop and olosing down 1 year later. My
business is still operating and suocessful. If North Fort
Harrison would only be allowed to suooeed it only follows
that the dumpy duple~es behind it would be bought up and
either ~estored or torn down and ~ebul1t 1nto properties
whose rente could now be supported by the suooessful buslnes&
interests that would like to invade this wonderful area.

triplex of Modern units. The cost would have netted to me

have been that the present building is an eyesore and the new

and prosperity which we are all trying to achieve far this
