BACKGROUN 0:
The median income figure for this area is periodically revised by HUD and pub-
lished in the Federal Register. Because HUD requires the City to focus its CDBG
Program to meet the needs of low and moderate income persons and because these
income limits are derived from the median income figure established by HUD, it
is recommended that the City's CDEG Program income eligibility limits be auto-
matically adjusted to recognize future fluctuations in the median income figure
for this area.
The present program income limits were last revised to meet the established
limits of HUD on October 1, 1983. Since that time HUD has published new median
income figures for this area and the revised limits as shown below reflect 80%
and 50% of the currently effective median incone figure. These revised limits
will be in effect if this policy i.s adopted.

RECOMMENDATION:
City Commission approve the Declaration of Restrictions for the subject
property as att.ached, said restrictions to be valid for a period not to
exceed two years from the date of annexation (July 19, 1984).

BACKGROUND:
The property upon which the Landmark Woods subdivision is Vroposed to be
developed was annexed into the City of Clearwater on July 19, 1984 with a
zoning designation o~ RS-7~ (Single-Family Residence). On that date, the
City Commission approved subject to conditions, the preliminary subdivision
plat for Landmark Woods, a single family subdivision containing 64 lots at
a density of 2.8 units per net acre or 2.2 lots per gross acre.
The County Land Use Plan restricts development along this portion 'of the
McMullen-Booth Road corridor to 2.5 units per gross acre. Although the
proposed subdivision of the property does not exceed this limitation, the
RS-75 zoning on the property would allow up to 5.8 dwelling units per net
acre (132 units) or 4.5 units per gross acre whi'ch does exceed the County
Land Use Plan density restriction.
On August 24, '1984, the County examined th~subject parcel and approved the
transfer of jurisdiction to the City of Clearwater at the requested RS-75
zoning, provided the overall density would not exceed 2.5 unit~ per gross
acre. The attached declaration of restrictions prepared by the property
owner has been reviewed by'the:-P.ine.1.l,as County Attorney and a determination
made tha-t';-if ex;ecli~ed, the declara~i~:)n~ would satisfy the density restri-'c- '
tion placed on the.. 't17an~f~rof juri Sdi,:cti'on by the County.
The City Attorney has reviewed the proposed declaration and has determined
that since the restrictions shall apply for a period of no more than two
years, that no undue conflict will result from the City Commission policy
to refrain from being a party to private deed restrictions. The elements
of the Declaration are in accord with the previous City Commission a~-
provals for the annexation and the subdivision plat on the subject
property.

Bayfront Park Improvemont Plan
RECOMMENDATION:
The City Commission approve Ordinance 3757-84 which establishes, a
referendum date and referendum 4uestions to finance improvements to
implement the Bayfront Park Improvement Plan.

BACKGRODND:
The City Commission at a public hearing on September 6, 1984, instructed
staff to, prepare an Ordinance and Resolution for the bayfront parkland
acquisition and improvement referendum to be held on December 4, 1984.
At the Commission's direction, a line item has been included in the budget
for improvements covered by Question 1 to pay for replanting of the medians
on Memorial Cause~ay. In addition to Causeway medians, the uses to which
Question 1 bond funds may be put would allow for rehabilitation and
expansion of recreation and open space faci11ties in those areas lying
generally south of Drew Street and north of Pierce Street.
Park expansion between Jones Street and Drew Street, and west of the
intersection of Pierce Street and Pierce Boulevard, are covered in Question
2. This would allow land to be used for "active and passive parks and
recrea.tion, including concession, support and leisure activity facilities."
'Previous Commission direction had indicated a desire to permit those uses
which would enhance the public accessibility and enjoyment of the park, but
would preclude designation of the eastern portion of the Sand Castle as a
downtown redevelopment opportunity.

The Commission should note that the maximum interest authorized in the
election questions is 14%. This maximum would be expected to be paid only
on those bonds with the latest (30 year term) maturity date. The average
interest, rate for. all of the bonds included in the bond package is expected
to be 10.5%.

BACKGROUND:
The property is located on the east side of Landmark Drive across from the
intersection with Buxton Court. The site contains 7.69 acres M.O.L.
The Land Use Plan classification is Low Density Residential. The request
is for RS-100 zoning with the annexation. Plans are to develop the
property with a single family subdivision.
The abutting property ort the east under the sarna ownership is the subject
of a petition for annexation requesting RM-8 (Single-Family Duplex-
Apartment Residential) zoning. On July 19. 1984. the City Commission
considered a peti tioD ,for annexa-ti~OIt ;for the subject area 'and the adjoining
property., By r.eq.uest of the Ci'ty Commt ssion, the peti ti on was revised to
reflect an area o~_7.69 ~c~es rather.than 9.34 acres to be zoned RS-IOO.
Open space, recreation land and facilities impact fees will be due at the
time the property is developed.
The Planning and Zoning Board reviewed this item on August 7, 1984. Due to

BACKGROUND:
The property is located on the west side of McMullen-Booth Road across
from the intersection of Mease Drive. The site contains 4.13 acres M.O.L.
The Land Use Plan classification is Low Density Residential. The request
is for RM-8 zoning with the annexation.
The abutting property on the west under the same ownership is the subject
of a petition for annexation requesting RS-100 (Single-Family Residence)
zoning. A petition for annexation was submitted to the City Commission on
July 19, 1984. requesting. considera~tion for RM-8 zoning on an area which
contained 6nly ~~~&'acres. By reques~Df,the City Commission, the
applicant revised ~i.slpetition to request an RM-8 district which contains a
, minimum of four acres as required by Code.
Open s~ace, recreation land and facilities' fees will be due at the time the
property is developed.
It should be noted that the County Land Use Plan restricts development
along this portion of McMullen-Booth Road to a maximum of 2.5 residential
units per gross acre.' An'amendment to the County Plan will be required if

BACKGROUND:
The property is located north of Drew Street, east of Weber Avenue and
Tulane Avenue. The site contains 13.07 acres M.O.L.
The Land Use Plan classification is Public/Semi-Public with a zoning
designation of lSP on the majority of the subject area with the northeast
corner being classified Low Density Residential and zoned RS-50. The
request is to amend the Land Use Plan to Medium Density Residential and the
Zoning Atlas to RM-12 over the entire property.
The property is owned by the Skycrest Baptist Church and had at one time '
been considered as a site for relocation of the church and school facil-
ities. Plans are for the relocation to occur at the intersection of Drew
Street and Belcher Road rather than to the subject property. ,The church
proposes to sell the subject area for private residential development.

'l'he Plan-ning and-Zoning Board on Sept"ember 4, 1984 recommended by a vote of
4 to 2 to approve- ,the ,L~nd, Use Pl an amendment to Medi urn Densi ty Resi dential

a vote of 6 to 0 that consideration be given to an RPD (Residential Planned
Development) zoning over the entire property and that density of the RPD
take into consideration traffic generation with consideration of the
neighbors to the east. Staff notes that an RPD zoning cannot be approved
by the City Commission without the submission of a site plan for the
property.
A request has been submitted by a neighboring property owner that con-
sideration of this item be continued.

The City Commission of the City of Clearwater
SUBJECT:
Zoning Atlas Amendment from RS-200 (Single-Family Residence) to RPD 7.5
(Hesiaential Planned Development) for Lot 12, Pinellas Groves Sub., SE 1/4
of Sec. 19-29S-l6E and Communit~ Impact Statement with Addendum,
Preliminary Subdivision Plat and Final Master Site Plan for Chimney Svrings
(Villella, Bellows) Z-84-31, PSP 84-13.
RECOMMENDATION:
A. City Commission deny the requested rezoning to RPD 7.5 and approve a
rezoning to RPD 6.5 on the subject property; and direct the Clty
Attorney to include this in an ordinance.
B. City Commission,approve the Community Impact Stateme~t with Addendum'
for Chimney Sprlngs.
C. City Commission grant a variance to the subdivision regulations which
reguire that all ulatted lots be served by a public or private street
WhlCh meets City standards and approve the preliminary subdivision plat
for Chimney Sprlngs subject to the following conditions:
1. A private covenant be filed with the plat stating that no
development will occur on Tracts A, B, and C;
2. Individual ownership documents yrovide for common ownership and
maintenance of Tracts A, Band C'and the private roadway;
3. A private covenant be flIed with the plat to preclude parking of
any motor vehicle, recreational vehicles, or boats on the street
surface;
4. The final plat be recorded within six months from the date of
final ordinance reading of the RPD zoning.
D. City Commission approve the final RPD master site plan for Chimney
Sprlngs subject to the following conditions:
1. The retention pond be designed to drain dry in 24 hours as
required by the Public WorRs Department;
2. Perimeter easements be granted as shown and easements be given
over the water lines up to and including hydrants and meters;
3. Open space and recreatIon land fees be paid prior to
certification of the final master site plan;
4. The requisite initial building permitfs) be procured within six
(6) months from the date of flnal ord nance reading of the RPD
zoning and all requisite certificate(s) of occupancy be procured
within two (2) years from the date of Issuance of, the inltial
building permlt. .

BACKGROUND:

The property is located on the north side of Nursery Road approximately
1,200 feet west of U.S. 19. The site contains 5.1 acres M.O.L. and is
developed with a single family house and a horse stable.
The Land Use Plan classification is Low Density Residential with a zoning
designation of RS-200. The application was submitted for a Zoning Atlas
amendment to RPD 7.5. Subsequent adjustments to the master site plan
submitted with the rezoning request have resulted in a 25 unit, zero lot
line single family ~roject resulting in a net density of 6.41 units per
acre. Toe recommendatlon is for approval of a zoning of RPD 6.5 to limit
site development to 25 units.
The Resource Development Committee on August 23, 1984 recommended approval
of the preliminary plat and site plan subject to conditions which have
been met or are reflected in the recommenaation.
The Planning and Zoning Board on September 4, 1984 recommended by a vote of
6 to 0 to approve the Zoning Atlas amendment to RPD 6.5. The Board
recommended by a vote of 4 to 2 to approve the prel~minary plat and final
