Robert Dickman, Fire Lieutenant, Fire Department, was employed by the City on February 14, 1977, and his pension service credit is effective on June 18, 1977. His pension will be effective April 1, 2000. Based on an average salary of approximately $48,274 per year over the past five years, the formula for computing regular pensions, and Mr. Dickman's selection of the joint & Survivor Annuity, this pension will approximate $30,249 annually. Her pension will be effective May 1, 2000. Based on an average salary of approximately $30,178 per year over the past five years, the formula for computing regular pensions, and Ms. Hamm's selection of the 100% Joint & Survivor Annuity, this pension will approximate $24,807 annually. These pensions were approved by the Pension Advisory Committee on April 13, 2000. Section 2.393 (p) provides for normal retirement eligibility when a participant has completed twenty years of credited service in a type of employment described as "hazardous duty" and further specifically defines service as a Fire Lieutenant and Assistant Fire Chief as meeting the hazardous duty criteria. Section 2.393 (p) also provides for normal retirement eligibility when a participant has reached age 55 and completed twenty years of credited service, has completed 30 years of credited service, or has reached age 65 and completed ten years of credited service. Mr. Callahan and Mr. Dickman qualify under the hazardous duty criteria; Ms. Drysdale qualifies under the age 65 and ten years of service criteria; Mr. Little, Mr. Pyatt, and Mr. Foster qualify under the age 55 and 20 years of service criteria; and Ms. Hamm qualifies under the 30 years of service criteria. M Trustees of the `=a Final Agenda Item # Employees' Pension Plan 5/15/00 Meeting Date: Agenda Cover Memorandum SUBJECT/RECOMMENDATION: Wayne Millen, Police Department, be allowed to vest his pension under Section(s) 2.397 and 2.398 of the Employees' Pension Plan as approved by the Pension Advisory Committee. SUMMARY: Wayne Millen, Police Officer, Police Department, was employed by the City on June 7, 1989, and his pension service credit is effective on that date. He resigned from City employment on April 14, 2000. The Employees' Pension Plan provides that should an employee cease to be an employee of the City of Clearwater after completing ten or more years of creditable service (pension participation), then such employee shall acquire a vested interest in the retirement benefits. Vested pension payments commence on the first of the month following the month in which the employee normally would have been eligible for retirement. Section 2.393 provides for normal retirement eligibility when a participant has completed twenty years of credited service in a hazardous duty position and specifically designates the position of Police Officer as hazardous duty. Mr. Millen would have completed twenty years of service as a Police Officer on June 7, 2009. His pension will be effective on July 1, 2009. SUMMARY: Carol Schmidt, Police Officer, Police Department, was injured on August 19, 1998, in an off-duty vehicular accident. As a result she suffered numerous injuries to her legs and face. The injuries to her legs required several surgeries which have left her with a permanent limp, a limited range of motion, and the inability to walk long distances. As documented in letters from her doctors, an independent medical evaluation performed by Dr. Andrew Wolff, and a functional capacity test performed at Bon Secours Venice Hospital, Officer Schmidt has physical limitations to the extent that she cannot run, jump, squat, or physically interact with perpetrators. The documentation indicates that Ms. Schmidt is permanently disabled from performing all the duties of a Police Officer. Under provisions of the Employees' Pension Plan, if an employee is disabled from her present job but can be reassigned to another position in order to perform meaningful work for the City, the employee is not entitled to a disability pension. The Clearwater Police Department has designated a specific number of positions that are considered to be "permanent" light duty positions for sworn personnel. Officer Schmidt has been assigned to one of these positions. On April 13, 2000, the Pension Advisory CommittQe denied Officer Schmidt's request for a non-job-connected disability based on the fact she can perform the duties of the position to which she has been reassigned. This permanent appointment must be approved by the Trustees of the Employees' Pension Plan in accordance with Section 2.397 of this ordinance. SUMMARY: Job-connected disability pensions are subject to offsets for collateral benefits such as workers' compensation and social security so the pension benefits when combined with collateral benefits do not exceed 100% of the employees' average monthly wage, Recent decisions of the Florida Supreme Court and the First District Court of Appeals have impacted the pensions the City of Clearwater has been paying the retirees named below. These decisions held the annual workers' compensation permanent total supplemental benefits cannot be included in the pension offset calculation. Prior to these decisions the City was including the annual cost of living supplemental benefits in computing the pension offset as were most Florida employers. Including the supplemental benefits resulted in an underpayment of pension benefits to these retirees. The Central Insurance Fund has already been used to pay the benefits for Acker, Hahn, and Rowe to satisfy a mandate from the Florida Supreme Court and avoid additional penalties. Staff recommends further the Clearwater Employees Pension Fund reimburse the Central Insurance Fund $18,453.00 for the payment of pension benefits and interest in Acker, Hahn, and Rowe. All penalties owed as shown above will be paid from the Central Insurance Fund for the reason the penalties are owed because of a Florida Workers' Compensation statute that has impacted the pension fund.
