SUBJECT: Recommendation for Acceptance into Pension Plan
DATE: October 14, 1999
As Trustees of the City of Clearwater Employees' Pension Fund, you are hereby notified that the
employee(s) listed below have been duly examined by a local physician and each has been designated
as a "first class risk". The employment of these individuals brings the number of FTE's as of this
date to 1651.6 out of 1750.0 budgeted positions (including the City Commission).
These employees are eligible for pension membership as noted in the Pension Eligibility Date column
below, and it is the recommendation of the Pension Advisory Committee that they be accepted into
membership.

SUBJECT/RECOMMEN DATION:
Antonia Babski, Human Relations Department; Nicolas Rivera-Ruiz, Human Relations Department, Carol Tresca,
Human Relations Department, and Michael Harrell, Police Department, be allowed to vest their pensions under
Section(s) 2.397 and 2.398 of the Employees' Pension Plan as approved by the Pension Advisory Committee.

SUMMARY:
Antonia Babski, Human Relations Specialist, Human Relations Department, was employed by the City on
April 27, 1988, and her pension service credit is effective on that date.
Nicolas Rivera-Ruiz, Human Relations Specialist, Human Relations Department, was employed by the City on
October 19, 1984, and his pension service credit is effective on that date.
Carol Tresca, Human Relations Specialist, Human Relations Department, was employed by the City on
April 8, 1985, and her pension service credit is effective on that date.
Michael Harrell, Police Officer, Police Department, was employed by the City on
October 22, 1988, and his pension service credit is effective on that date.
The Employees' Pension Plan provides that should an employee cease to be an employee of the City of Clearwater
after completing ten or more years of creditable service (pension participation), then such employee shall acquire a
vested interest in the retirement benefits. Vested pension payments commence on the first of the month following
the month in which the employee normally would have been eligible for retirement.
Section 2.393 (p) provides for normal retirement eligibility when a participant has reached age 55 and completed
twenty years of credited service or has completed 30 years of credited service. Section 2.393 (p) also provides for
normal retirement eligibility when a participant has completed twenty years of credited service in a hazardous duty
position and specifically designates the position of Police Officer as hazardous duty.
Ms. Babski would have completed at least twenty years of service and reached age 55 on April 27, 2008. Her
pension will be effective on May 1, 2008. Mr. Rivera-Ruiz would have completed at least twenty years of service
and reached age 55 on March 20, 2007. His pension will be effective April 1, 2007. Ms. Tresca would have
completed at least twenty years of service and reached age 55 on July 26, 2011. Her pension will be effective on
August 1, 2011. Mr. Harrell would have completed at least twenty years of service as a Police Officer on
October 22, 2008. His pension will be effective November 1, 2008. These requests were approved by the
Pension Advisory Committee on October 14, 1999.

On August 16, 1999, you approved hiring the law firm of Thompson, Sizemore &
Gonzalez to handle the defense of the above case for the Pension Trustees. I am
requesting approval for the expenditure of not exceeding $25,000 to Thompson
Sizemore's for legal services regarding this case.

SUMMARY:
Recommended Plan Changes:
1. Add an ad hoc Cost of Living Adjustment (COLA) of 1.5% for active employees and retirees.
2. Change Average Monthly Compensation from final five years of service to high five years of service.
3. Change plan so that vested employees retiring at age 65 with less than 20 years of service would get a
"normal" retirement instead of an actuarial equivalent or "reduced" benefit.
