I recently received in my mailbox a notice (attached), from the City of Clearwater to
consider a development agreement between the City of Clearwater and Spinecare
Properties to allow for the construction of a two story 45,000 square foot medical clinic
rising up to 43 feet above the ground. The hearing before the Community Development
Board will be on Tuesday, June 17th at 1 :00 pm. I will unfortunately be out oftown on
business that day and I'm sure very few homeowners will show up since this is in the
middle of everyone's workday. However, I feel it is important to point out the strenuous
objections to the development by myself and other affected neighbors to a structure that
is very close in design to a structure unanimously voted down by the Planning
Commission about two years ago and is clearly not conforming with existing structures in
the immediate vicinity of the proposed building west of McMullen Booth Road. This
building, if approved, will be approximately 15-20 times the size of most every
residential structure immediately next to it and twice as high. It will not even
conform to the one-story retirement home immediately to the south of this proposed
strucuture. Furthermore, there is a great chance that the scale of the project, and the
potential noise, traffic and medical waste generated from this proposed structure will
immediately and permanently devalue the residential buildings situated next to this
building. Please be advised that I am seeking legal counsel and should my reasonable
and justifiable fears be well founded in fact, then I will strongly consider litigation
against both The City of Clearwater and Spinecare Properties should this Development
Agreement pass in it's present form.
In closing, Mr. Delk, I ask that you consider the thoughts and opinions of ordinary
citizens in all matters, even if they do not appear for hearings such as this. You must be
the voice of the People who do not have the expertise, wherewithal or time to take out of
work and raising their families to engage in a long term fight with others whose job it is
to get projects such as this approved, regardless of the detriment incurred to those around
them. You must be an agent for the People who have entrusted you to protect ordinary
homeowners from developments such as this that clearly have no place in our
community. ,It is your duty as a public servant. As such, I trust you will support the
homeowners in this neighborhood in rejecting this Development Agreement with
Spinecare Properties.

NOTICE OF INTENT TO CONSIDER
A DEVELOPMENT AGREEMENT
Public hearings will be conducted before the Community Development Board of the City
of Clearwater, Florida, on Tuesday, June 17, 2008, beginning at 1 :00 p.m., and before
the City Council on Thursday, July 17, 2008, 2005, beginning at 6:00 p.m. (or as soon
thereafter as the matter may be heard), in City Council Chambers, 3rd floor of City Hall,
112 South Osceola Avenue, Clearwater, Florida, to consider Resolution 08-06 approving
a Development Agreement between the City of Clearwater and Spinecare Properties,
L.L.C. for property located at 3280 & 3290 McMullen Booth Road (west side of McMullen
Booth), Geiger Tract, Lot 1 and Sec21-28-16, M&B22.01(DVA2oo5-00001A).
The Development Agreement will allow for the construction of a two-story, 45,000
square foot (0.423 FAR) medical clinic on a 4.5 acre parcel, with non-residential
off-street parking with an increase in building height from 30 feet to 35 feet for top
of parapet and to 43 feet for elevator/stair tower.
Interested parties may appear to be heard or file written notice of approval or
objections with the Planning Department or the City Clerk prior to or during the
public hearing. Any person who decides to appeal any decision made by the
Commission or Board, with respect to any matter considered at such hearings, will
need a record of the proceedings and, for such purpose, may need to ensure that a
verbatim record of the proceedings is made, which record includes the testimony
and evidence upon which the appeal is to be based per Florida Statute 286.0105.
