Welcome. We are glad to have you join us. If you wish to speak, please wait to be recognized, then state your
name and address. Persons speaking before the City Council shall be limited to three (3) minutes unless
otherwise noted under Public Hearings. For other than Citizens to be heard regarding items not on the Agenda, a
spokesperson for a group may speak for three (3) minutes plus an additional minute for each person in the
audience that waives their right to speak, up to a maximum of ten (10) minutes. Prior to the item being
presented, please obtain the needed form to designate a spokesperson from the City Clerk (right-hand side of
dais). Up to thirty minutes of public comment will be allowed for an agenda item. No person shall speak more
than once on the same subject unless granted permission by the City Council. The City of Clearwater strongly
supports and fully complies with the Americans with Disabilities Act (ADA). Please advise us at least 48 hours
prior to the meeting if you require special accommodations at 727-562-4090. Assisted Listening Devices are
available. Kindly refrain from using beepers, cellular telephones and other distracting devices during the
meeting.

NOTICE AND AGREEMENT WAIVING SPECIAL MAGISTRATE PROCESS
COME NOW the parties, through their undersigned counsel, and file this Notice and
Agreement Waiving Special Magistrate Process. The parties hereby agree as follows;
1. The only disputed issue at impasse ("Issue") is the amount of general wage increase
("OWl") for October 1,2007, through September 30,2008, within Article 9, Section 1 from the
parties' expired collective bargaining agreement ("CBA").
2. The right to have the Issue considered by the special magistrate is hereby waived, and
the parties will proceed to resolution of the Issue by the legislative body of the public employer
("City Council") pursuant to ~44 7 .403, Florida Statutes, without a recommendation from the Special
Magistrate.
3. The amount of OWl, if any, to be paid to the bargaining unit for October 1,2007,
through September 30, 2008, will be the sole issue taken up by the legislative body through this
impasse resolution process. The parties agree that all of the other provisions contained in the parties'
contract which expired on September 30,2007, will be taken to ratification along with the OWl
resolution by the City Council to be effective for the October 1,2007, through September 30,2008,
contract year through the ratification process outlined in ~ 447.403 Florida Statutes.
4. The parties will cooperate in scheduling and arranging procedures for the City
Council's public hearing to resolve the Issue.
5. The parties will notifY Special Magistrate Terrill his services will not be needed in
this matter.
6. After the City Council resolves the Issue, the parties will comply with the ratification
process outlined in ~447.403(4)(e), Florida Statutes, over the CBA and OWl Issue resolution.
7. Undersigned counsel have the full authority of their respective clients to execute this
agreement and thereby bind the parties to the tenns of this agreement.

There is no higher priority for us as stewards of the public trust than to provide quality Public
Safety protection to our citizens. You as well as previous City Councils and Commissions have
devoted a significant percentage of the City's resources to public safety infrastructure,
equipment, and employee compensation, and that continues even in these challenging economic
times. It goes without saying that we all have the utmost respect and admiration for our Fire and
Rescue personnel, as well as our Police officers.
BARGAINING mSTORY
As you are aware, the City commenced collective bargaining with the IAFF in May 2007 in an
attempt to reach agreement on a new labor contract to replace the one that would expire in
October 2007. Between May of 2007 and June of 2008, the City and Union engaged in 19
negotiating sessions, with each party proposing a number of significant changes to the existing
contract. Unfortunately, after all that time, the parties were able to reach a tentative agreement
on only a handful of issues of much lesser importance.
The City entered this set of contract negotiations with four primary management objectives:
. Provide for the ability to schedule employees outside of their standard work schedule
with no overtime guarantee when reasonable notice is given (just as we do with other
employee groups)
. Clarify the City's right to assign on-duty employees to any station, apparatus, training, or
other assignment (just as we do with other employee groups)
. Clarify the City's right to require employees to perform the duties of related, lower-level
job classifications
. Establish requirements for the maintenance of EMS certifications as a condition of
continued employment, and provide measures for addressing the loss of such
certifications
The Union's position on each ofthese objectives:
. Not interested in being mandated to work any hours outside of the established work
schedule for straight time, even though the law specifically allows for this
. Reinstitute a prior "bid" system that severely limited the department's ability to manage
overtime costs, with the ability to reassign employees "by mutual consent" only.
(Significant reductions in overtime costs over the last two years can be attributed in large
part to the implementation of the current transfer request process (see exhibit A))
. Preclude employees from being assigned the duties of a lower level job classification
unless they also receive additional compensation
. Not interested in the City's proposed changes to EMS requirements because they involve
"a lot of changes for the membership"

In addition, the Union proposed the following significant changes to the contract:
. Provide for inclusion of a daily schedule with the following requirements:
oM-F "work period" hours from 0800-1700
o Coffee break from 0930-1000
o Lunch break from 1100-1300
o All time after 1700 considered "down" time (i.e., run calls only)
o Saturday, Sunday, and Holidays considered "down" days after vehicle and
equipment inspections
o Night drills for training between 1800-2300 limited to 3 hours and to only two
times per year
o Adjust scheduled "work" time to be offset by time spent performing any required
work other than running calls during periods of "down" time
. Require that minimum qualifications to Act in a higher level classification be in
accordance with the job description rather than current practice of Department
proficiency assessment
. Limit promotional selections to top 5 score groups rather than current practice of an open
eligibility list
. Eliminate current Benefits Committee recommendation process and require bargaining of
health insurance (no Union proposal provided other than "re-opener")
BARGAINING PROPOSALS
As recently as January 2008, the City was proposing a three year contract with the offer of a 3%
general wage increase in each year of the contract, an abbreviated merit step plan that would
shorten the time to progress from the pay range minimum to maximum, and improvements in
other incentive pays contingent upon the City achieving its organizational objectives. However,
following the passage of Amendment One, and considering the budget reductions to be imposed
and the potentially greater budget challenges that lie ahead, management realized this three-year
contract offer was no longer tenable and withdrew the offer in January 2008. Notably, the Union
never sought to take this City proposal to a formal ratification vote, even though the City asked
the Union to do so. The City subsequently presented two new proposals. The first was a three
year proposal providing for a 2% general wage increase in the first year of the contract in return
for the City achieving its operational goals with re-openers in the second and third year of the
contract to negotiate the general wage increase, merit increase, and other monetary issues. This
proposal was determined to better address the current fiscal climate while still maintaining the
City's organizational priorities. The second proposal was for a no-change contract, to include no
changes to any compensation. This second proposal was in response to the Union's proposal for
a no-change contract that would include a 4% general wage increase.

By June 2008, the parties had reached a point where little or no progress was being made at the
bargaining table. The City came to the realization that its expectation for reaching a long-term
agreement or any agreement was negligible, and the City chose to declare impasse. Faced with a
potential repeat of the scenario that had played out in the prior set of negotiations with IAFF
whereby the parties went nearly three years without a contract, the City opted to attempt to move
the process forward by allowing the City Council to resolve the first year of the new contract
through the impasse procedure and return to the bargaining table to renew negotiations over the
more significant outstanding items.
The sole issue before the City Council today is what amount, if any, should be provided to the
members of the IAFF in the form of a General Wage Increase.
UNION'S POSITION
The Union has taken the current position that the City should provide a 3% general wage
increase. They have argued the increase is deserved because our Firefighters and Fire Medics do
an exemplary job in providing a critical and irreplaceable service that our citizens demand and
expect; that the City budgeted for an increase in that amount and to not provide it would be
unfair; that the City has awarded raises to its other Union-represented employees and non-
represented SAMP employees in this fiscal year; that not providing an increase would negatively
impact the City's ability to recruit and retain quality employees in our Fire and Rescue service;
and that while a number of their members will receive a merit step increase of varying amounts
for this fiscal year, some will receive no increase at all.
CITY'S RESPONSE
The City's position is that the general wage increase should be 0%. This in no way reflects the
value the City places on these or any other employees, and the City agrees with the Union that
our Fire and Rescue personnel do an exceptional job, but it does clearly indicate the value the
City perceives in a contract for which the City would realize no reward for more than a year of
effort. While it is true that funds were budgeted in the event a general wage increase is deemed
warranted, there is no obligation to provide such, and the City's expectation is that the general
wage increase should be considered in the context of the entire set of issues being negotiated,
both economic and non-economic. A one-year, no-change contract achieves none of the goals
the City wished to attain in this round of negotiations, and since this new agreement will be in
effect only until Sep 30th of this year, the parties would immediately return to the bargaining
table. In addition, the awarding of a general wage increase to the Union by the City with no
other changes to the contract clearly neglects the "give and take" contemplated by the collective
bargaining process. A one-year contract with no changes would move the negotiation process
forward, allowing the parties to negotiate in the current year and not for any time passed.

OTHER EMPLOYEE GROUPS
It is not disputed that the City has awarded raises of various amounts to other employee groups
during this fiscal year. However, the only other employee groups to receive a general wage
increase are our sworn Police personnel. In these cases however, it is important to realize that
the general wage increases were included in agreements reached through the collective
bargaining process at the negotiating table and that contemplated the full range of economic and
non-economic issues of interest to each party. Our other employee groups, those represented by
Communications Workers of America and our non-represented SAMP employees, did not
receive a general wage increase and were provided only a merit increase this year. The CW A
employees received approximately a 4% merit increase that, as with the FOP, was agreed upon
within the full scope of the collective bargaining process. The SAMP employees, who are not
organized, were provided a 3.95% merit increase by the City Manager with the understanding
that there is currently no obligation to negotiate this pay raise in the context of their overall
wages, benefits, or other terms and conditions of employment, to include any changes the City
might wish to implement with respect to its organizational objectives. In fact, the City Manager
has indicated the SAMP pay increases will be less in the coming year, and management
personnel will receive no increase at all; a reflection of the times.
IAFF MEMBERS ARE WELL COMPENSATED
By comparison, as a group our Fire and Rescue personnel have been the most richly rewarded of
any City employees over the three years comprising the duration of the recently expired contract.
An IAFF member who came to work for the City at the beginning of that agreement (2004) has
received a 30% increase in pay the first three years of employment. Even an IAFF member who
was at the maximum of the pay range at the beginning of the contract received a 15% increase in
pay during that time period. Similarly situated FOP members received 27% and 12% increases
respectively, and CW A and SAMP employees received approximately 12% over the same time
period. And yet, the Union would not argue it is unfair that they have received greater pay
increases than other employee groups in those years. In addition:
. Even though the expiration date of the current contract has passed, the contract remains
in effect until a new agreement is reached. As such, the City is still obligated to maintain
all provisions of the contract that do not contain a specific end date. This includes a
number of monetary enhancements, among them the merit or so-called step increases, the
annual Personal Resource Allowance, and other Special Team and EMS incentive pays
the IAFF continues to receive.
. Even without the application of a general wage increase for this fiscal year, our Fire and
Rescue personnel would continue to be compensated more than adequately. In 2007, the
average annual compensation for a Firefighter was $49,000 and for a Lieutenant was
$76,000 (see exhibit B of your handout). While end-of-year data is not available just yet
for this fiscal year, these numbers can be expected to be higher with the application of
additional step increases. In addition, the City's annual pay rates for entry-level
Firefighters and Fire Medics continue to be competitive with those of corresponding
agencies in our local operating area (see exhibit C of your handout). Even so, the City
believes that any potential adjustments that might become necessary can be achieved
upon the resumption of negotiations.

RECRUITMENT AND RETENTION NOT AN ISSUE
Contrary to the Union's position, the City believes that approving the City recommendation will
not negatively impact the department or our ability to recruit and retain employees.
. The City is not experiencing any recruiting issues for Fire and Rescue personnel. We
consistently maintain anywhere from 150 to 200 applicants on file (see exhibit D of your
handout). In addition, we are able to accomplish this with only minimal recruiting
efforts, typically limited to posting the job announcement on our City web page.
. Our turnover rates in the Fire and Rescue Department do not indicate any cause for
concern (see exhibit E of your handout). Retirements and the separation of probationary
employees are within acceptable limits. Voluntary resignations are also within
acceptable limits, and we have seen no trends that would indicate the absence of a general
wage increase for one year would have a significant negative impact on that.
Interestingly enough, during the years 2002 to 2005 when the City and IAFF were in
protracted negotiations for almost thirty months with no general wage increase applied
during that time, our turnover remained consistently low.
STEP PLAN SHOULD NOT BE AN ISSUE
The step plan as it currently exists is a series of merit based pay increases that are contingent
upon receiving a satisfactory annual performance review. It provides for a 5% annual wage
increase during the first five years of employment, and a 2 'l'2 % wage increase in alternating
years during the sixth thru 17th year of service. Once an employee advances through all of the
steps, the only base pay increase he/she receives is whatever general wage increase the parties
negotiate.
The Union would argue that not granting a general wage increase will disadvantage a number of
their members because the structure of the merit based step plan will cause some of them to not
receive any raise at all. While it is true that some employees would receive no raise, it is
debatable whether this amounts to those employees being disadvantaged.
This step plan was not designed to provide for an increase every year. It is a traditional pay
acceleration model intended to bring employees more quickly to the pay range midpoint by
providing for significant increases in the first five years (25% in addition to any general wage
increase) when the employees are in a steep learning curve, and with more gradual increases over
the subsequent 12 years when they are expected to have achieved a high degree of proficiency.
As with most fixed pay ranges, it contains a maximum rate of pay that may not be exceeded.
There are currently 23 employees in the bargaining unit who have already attained the maximum
step and as such have garnered the benefit of pay increases totaling 42.5% over and above any
general wage increase they may have received throughout their career. There are an additional
39 employees who are in between steps this fiscal year, and who have all realized no less than a
25% increase in pay over and above any general wage increases they have received since coming
to the City.

The City understands that providing for no general wage increase will result in this group of
employees receiving no pay raises for the year. However, to provide any additional pay increase
to only these employees would not be consistent with the design of the step plan, as its current
makeup contemplates that there will be years when some employees will receive greater pay
increases than others. In addition, a modification of the step plan that would mitigate the issue
has been the subject of numerous discussions at the bargaining table, and is included in the
City's most recent three-year proposal.
CONCLUSION
Historically, public sector employees have come to expect annual wage increases and
governments' focus on remaining competitive and maintaining a quality workforce for the most
part has supported that perspective. However, the current budget realities compel us to reassess
the manner in which we approach increases in employee wages and benefits, and require us to
look for opportunities to balance employee costs with the expectations and demands of our
taxpaying citizens. As such, future wage increases and/or benefit enhancements must be viewed
in accordance with the ability to manage our departments efficiently and cost effectively. This
issue is at the core ofthe operational objectives the City hoped to achieve in this set of
negotiations.
The last few years the City has experienced a significant reduction in general fund revenues and
a corresponding reduction in staff and City services, and we anticipate this trend to continue in
the coming years. When we consider that almost seventy percent of our general fund
expenditures goes to providing for employee pay and benefits, controlling the escalation of these
costs must be addressed if City services are to be preserved.
The collective bargaining process contemplates that each side engage in a "give and take" over a
broad range of issues, with the hope and expectation that each party will come away from the
process with an agreement that may not include everything desired, but is one that both parties
can live with. The IAFF perspective is that after a lengthy period of unproductive negotiations,
the City should be willing to provide a general wage increase without any consideration of the
City's goals and objectives. The City does not believe that the approval of a general wage
increase in any amount with no other corresponding changes to the agreement is consistent with
the spirit of the collective bargaining process. The City asks that you agree with its position in
this matter at impasse, moving the process forward to the current year for continued negotiations,
and return the parties to the bargaining table where the matter may be resolved in a more
appropriate manner.
