DREDGE AND FILL APPLICATION DF-437, FLORIDA DEPARTMENT OF TRANSPORTATION, STEVENSON CREEK BRIDGE, CLEARWATER (DEFERRED FROM MEETING OF JANUARY 16, 1979)- APPROVED: ,WAIVER OF FEES GRANTED Pursuant to legal notice published in the December 4 and 11, 1978 issues of the Clearwater Sun as evidenced by affidavit of publication filed with the Clerk, public hearing was held on Dredge and Fill Application DF-437, Florida Department of Transportation, Stevenson Creek Bridge, Clearwater, deferred from the January 16, 1979 meeting. Deputy Clerk Glen W. Vantrease stated that all interested parties have been notified by certified mail; that no letters in ob- jection have been received; that the State Department of Transportation has requested a waiver of fees; that the hearing was deferred due to a question on an easement ownership; and that the matter is properly before the Authority to be heard. Director of Public Works and Utilities Gene E. Jordan stated that testimony was presented at the public hearing on January 16, 1979; that James Witt of the Department of Transportation and Mr. Lester Dicus, owner of the property where the easement problem occurred, have gotten together and that DOT understands it will have to acquire the property in question from Mr. Dicus before it can enter on to it. The applicant proposes to replace an existing bridge on Alternate U.S. 19 at Stevenson Creek with a larger concrete bridge. The new bridge is to be 116 feet long by 60 feet wide. The minim~~ vertical clearance over ~~e creek will be 6.7 feet. The con- struction wi1.l require the placement of a total of 1835 cubic yards of fill waterward of Mean High Water at four (~) separat7 sites for the bridge approaches. A total of 364 cub~c yards w~ll be d'redged waterward of Mean High I'later and 500 cubic yards dredged landward of Mean High Water at both ends of the proposed bridge. The surrounding uplands are primarily co~ercially developed, with some single family residential development. Stevenson Creek is a natural navigable creek which drains a large area of the Cities of Clearwater and Dun~din. The creek is tidal at the project site. C. Biophysical featurn of specific project sile (and spoil site when appropriate. include identification of bollom tvpes). Four (4) different types of habitat were evident at the four (4) separate fill sites. The area to the northwest of the bridge was characterized by a sandy beach with a small but dense growth of smooth cordgrass and black and white mangroves just west of the fill area. Fiddler craos were aoundant in the cordgrass area. Water transparency was less than 1 foot as are.; :ll t of strong winds and wave action at the tiJUe of inspection. North- east of the bridge L~e bank is seawalled and' no aquatic vegetation was present. No faunal species were seen either. The bottom was sand/shell with some concrete rubble and water transparency was approximately 2 feet. The area to the southeast of the bridge was characterized by a small but dense growth of black mangroves and sparse growths of cordgrass. Part of this growth will be de- stroyed by the proposed filling. Numerous pinfish and grunt were being caught by fishermen in this area at the time of inspection. The bottom was sandy and water transparency was approximately 2 feet. The area southwest of the bridge was sand beach with no aquatic flora or fauna immediately evident. The most significant area to be destroyed is that to the southeast of the bridge. However, this is a relatively small area and the adverse impact resulting from the fill would not be deemed significant. E. In response to the Chairman's call for opponents, Lester Dicus, 1665 Cleveland Street, Clearwater, appeared and stated that: 1. He and his wife own the Sunset Point Hotel located on Lot 1, Sunset Point Subdivision which consists of all land west of a right-of-way on Edgewater Drive (U.S. Alternate 19) and north of the bridge consisting of 453.56 feet fronting on the highway. 2. He does not object to the widening of the bridge which is needed but does object to the proposed placement of the bridge. 3. As a property owner he has not been notified by D.O.T. of its intentions or of the proposed construction of the bridge. 4. His property is within four feet of the present bridge and there is no easement over his pro- perty on the westerly side of the bridge ex- cept for the four feet and that the State does not have title to his land. I I January 16, 1979 5. He has been unable to obtain information directly from D.O.T. but from information furnished by the Coast Guard, the proposed bridge will be over his property. 6. The proposed bridge could be constructed by ex- tending the present bridge 20 feet on the west- erly and easterly sides instead of the proposed 40 feet on the westerly side. 7. The westerly side of U.S. Alternate 19 has several motels whereas the easterly side is vacant land owned by the City of Clearwater and is used as a park. Mr. Jordan stated that Mr. Pickhaver of the State D.O.T. has certified to the Authority that the State has easements or owns all property involved in this permit.
