Comment Period The Environmental Protection Agency proposes to isaue an NPDES permit to this ap~licant subject to the effl~ent limitations and ,pecial conditions , outlined above. These determinations are teutative and open to comment from the public. Public notice of such a hearing will be circulated at least thirty days prior to the hearing. in newspa~ers in the ~eo~a~h1eal area.of the discharge and to those'on the EPA mailing list. c. Issuance of the Permit After consideration of all written comments and of the requirements and polic:1es in the Act and appropriate regulations, and. if a public hearing is beld. after consideration of all comments, statements and data presented at th~ h~~ring, che EPA Regional Administrator will make determinations re~arding permit issuance. If the determinations are substantially unchan~ed from the tentative determinations outlined above, the EPA Regional Administrator will 80 notify all persons subm1ttin~ written comments. and, if a public hearin~ ~as held, all persons participating in tbe bearing. If the determinations are substantially chan~ed, the EPA Regional Administrator will issue a public notice indicating the revised determinations. ~ Unless a request for an adjudicatory hearing ~r legal decision is granted. the proposed permit contained in the" Regional Administrator's determination shall become issued and effective at" ~ ';.::.L.l be the final action of the U. s. Adjudicatory Hearing and/or Legal Decision If the determinations are substantially unchanged. any interested person may submit a request for an adjudicatory hearing and/or leRal decision on the permit and ita conditions within ten daya of the raceipt of the notice described abave. I! the determinations are aubstantially changed. any tDteraated perlon may submit a request for an adjudicatory hearing and/or legal decision within ten days of the date of the public notice or of the deteof becomin~ aware of the determinations, whichever comes first. Such requests will be within the time period if mailed by certified mail within the ten-day period to the Regional Hearing Clerk. All requests must: (i) State the name and address of the person making such request; (ii) Identify the interest of the requestor which is affected by the proposed issuance, denial or modification of the permit contained in the determination of the Regional Administrator; (1i1) Identify any persons whom the request represents; (iv) Include an aRreement by the requestor to be subject to ex- gm~~~tion and cross-examination and to make any employee or consultant of such requestor or other persen represented by the reque.tor available for examination and cross-exami~ation at the expense of such requestor or such other person upon the request of the Presiding Officer, on his awn motion, or on the motion of any party. , , (v) State with particularity the reasous for the request; (vi) State with particularity the issues proposed to be considered at the hearing; and (vii) Include proposed terma and conditions which, in the judgment of the requestor, would be required to carry out the intendment of the Act. The granting of a request will stay only the contested portions of the permit. ,Uncontested provisions of the permit shall be considered issued and effective and the permittee must comply with such provisions. The final Agency decision on the permit provisions contested at an adjudicatory hearing will be made in accordance w1:~ Title 40, Code of Federal Regulations, S~ct1on 125.36 found at, 39 Federal Register 27081, et. seq. .
