Enclosed is a copy of the Temporary Operating Permit for the East Wastewater
Treatment Facility, Permit No. TP52-17073, dated April 13, 1979, issued by
the Department of Environ menta I Regu lation for operation of the Clearwater
East Wastewater Treatment Faci lity. This permit is effective unti I January 1,
1983.
The original permit, sent to the City on April 13, under the specific conditions
listed an incorrect compliance date for completion of construction. This matter
was discussed with Mr. McArthur of DER and the specifi c conditions were corrected
on April 17, 1979, to conform with the requirements of the consent order. The
en closed copy of the Permit contains new pages 3 and 4 of the Permit with the
correct compliance date.
The Operating Permit, now in effect, is in accordan ce with the conditions agreed
upon by the City of Clearwater and DER and no further action is necessary.

hereof and specificaily described as follows:
A temporary operation permit for the Clearwater East 5~0 MGD
activated sludge wastewater treatment plant located at S.R. 60
and Old Tampa Bay with chlorinated effluent discharging to
Old Tampa Bay.
GENERAL CONDr.rIONS:
l~ The terms, conditions, requirements, limita~ions, and restrictions
set fo. ::1 herein are "Permit Conditions", and as such are binding
upon tl.c peymi ttee and enforceable pursuant to the' authority of
Section 403.161(1), Florida statutes. Permittee is hereby placed on
notice that the department will review this permit periodically and
may initiate court action for any violation of the "Permit Conditions"
by the permittee, its agents, employees, servants or representatives.
2. Thi~ permit is valid only for the specific process and operations
indicated in the attached dra\",ings or exhibits. Any unau,thorized
deviation from the approved drawings, exhibits, specifications, or
conditions of this permit shall constitute grounds for revocat5,on and
enforcement action by the department.

3. If, for arty reason, the permittee does not comply with or
will be unable to comply with any condition or limitation specified
in this permit, the permittee shall immediately notify and ~rovide
the department with the following information: (a) a description
of and cause of non-compliance; and (b) the period of non-(~mplinnce,
including exact dates and times; or, if not corrected, the ant.icipatc:
time the non-:- compliance ,is expected to con.tinue, and steps being -
taken to reduce, eliminate, and prevent. recurrence of the non-
compliance. 'l'he permittee shall be responsible for any and all
damages which may result and may be subject to enforcement action
. by the department for penalties ,or revocation of ,thi,s permit.
4. As, provided in subs~ction 403.0,87 (6), Florida Statutes, the
issuance of this permit "does not convey any ves'ted rights or any
exclusive privileges." Nor does it authorizc any injury to public
or pri~ate property oi ahy invasion of personal rig~ts, nor any
infri~gement of federal, state or local laws or regulations.
5. This permit is ieguired to be posted in a conspicuous location
at the work site or source during the entire period of construction
or operation.
6. In ~cGeptirig this permit, the permittee understands and agrees
that all records, notes, monitoring data and other inrorma.tion
relating to the construction or operation of this permitted source,
which are submitted f,o the department, may be used by the u(:partment
as evidence in any en~orcement case arising under the Florida
Statutes or departmen~ rules, except where such use is ~roscribed
by section 403.111, F~S.
7. In the case of an operation permit, permittee agrees to comply
with changes in department rules and Florida Statutes after a
reasonable time for compliance, provided ho\'lcver the permittee docs
not waive any other rights granted by Florida Statutes or ,department
rules.
B. This permit does not .relieve the permittee from liability for
harm or injury to human health or welfare, animal, plant, or aguatic
life or property and penalties therefore caused by the construction
or operation of this permitted source, nor does it allO\v the
permittee to cause pollution in contravention of Florida Statutes
and department rules, except where specifically authori7.cd by an
oroer fro@ the department granting a variance or exception' from
department rules or s~ate statutes. '

WHEREAS, the City Commission of the City' of Clearwater is desirous
of authorizing the City Manager to approve such permits in conjunction with the
construction and operation of a public wastewater treatment f~cility;
NOW, THEREFORE, BE IT RESOLVED.BY THE CITY.
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:

officially authorizes the City Manager to approve and execute on behalf of the
