I I SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT IN RE: CITY OF CLEARWATER NORTHEAST INJECTION FACILITY Well Construction Permit Applications Nos. 76-1-007 and 76-1-008 In Pinellas County, Florida ) ) ) ) ) ) ORDER NO. 77-2 ORDER GRANTING PERMIT PURSUANT TO HEARING BEFORE GOVERNING BOARD This Matter came on to be heard by The Governing Board of Southwest Florida Water Management District. at a public hearing held on January 5,1977. Said public hearing. being duly and properly noticed, was conducted at Southwest Florida Water Management District Headquarters, and all parties hereto were present or given the opportunity to be present, and together with the general public, were given an opportunity to present testimony and evidence. The Board, having reviewed the application and all documents in the File of Record, having heard testimony, and having received and examined all documentary evidence, makes the following FINDINGS OF FACT 1. City of Clearwater, hereinafter called CLEARWATER, presently owns approximately 4 acres of land in Pinellas County and proposes to construct one (1) test well and one (1) monitor well on this property. Pursuant to Chapter 373.106, Florida Statutes. and Chapter l6J.2, Florida Administrative Code, Clearwater has made application (Application Nos. 76-1-007 and 76-1-008) to the Southwest Florida Water Management District ,for Well Construction Permits to authorize the construction of two (2) wells in Section 16, Township 29 South, Range 16 East in Clearwater, Pinellas County, Florida. (a) One application is for construction of a monitor well in connection with the Clearwater Northeast Effluent Disposal Well Investigation. This well will be eight (8) inches in diameter and will be approximately 1,200 feet deep with 900 feet of casing . (b) The other application is for the construction of a test injection well in connection with the Clearwater Northeast Effluent Disposal Well Investigation. This well is to be ,) .) .n '\:) OJ . " r ~~) '..... I I 16 inches in diameter and will be approximately 1.200 feet deep with 900 feet of casing. 2. The wells are designed to test the viability of injecting 13 million gallons per day of advanced treated sewage plant effluent in~o a postulated highly transmissive saline zone of the Floridan Aquifer as a means of disposing of such effluent in an environmentally acceptable manner. 3. Long term disposal of waste water by injection into underlying aquifers is largely untried. Such activity is a temporary solution, at best, for disposing of unwanted materials and may result in permanent damage to the water resources or in irretrievable loss of water which might otherwise be used to recharge depleted ground and surface water, as well as by industry, agriculture and public water supply systems. 4. It has not been adequately demonstrated that the deep well injection as proposed will not result in significant adverse effects upon the water resources of the District because: a) The rate and direction of movement of the injected fluid cannot be accurately determined with the data available to da te . b) The response of the hydrologic system to injection stress cannot be accurately determined with the information available to date. c) The effects of the proposed injection upon the advance of salt water into fresher water zones of the aquifer cannot be accurately determined with the data available to date. d) The effects of the possible migration of injection fluid upon the water quality of usable portions of the aquifer, particularly with reference to viruses, cannot be accurately determined with the data available to date. 5. The adequacy of any proposed facility can best be evaluated by means of a comprehensive monitoring program conducted while the system is subjected to heavy stress over an extended period of time. Such monitoring can be designed and constructed to determine the rate and direction of movement of the injected fluid, the response of the hydrologic system to injection -2- I I stress, the effects of injection upon the advance of salt water into fresher water zones, and the changes in water quality of the injected fluid with migration through the aquifer. 6. It is the recommendation of the staff that the hearing on this application be continued until such time that additional information is available to the Board. In the interim, the staff recommends that the District grant to the City of Clearwater a permit .to construct a test hole for the purpose of obtain- ing data for engineering and/or for geological exploration, but not for the purpose of either producing or disposing of water. In connection with obtaining this data, this will include hydrologic information and it may necessitate withdrawal and/or injection of water in order to determine hydrologic coefficients and geologic characteristics but is not for the purpose of producing or disposing of water per se. 7. It is necessary that a program for testing and monitoring be designed, approved and completed before the Governing Board can give express consideration for granting written permission for construction to begin on any project involving the intentional introduction of water into an underground formation as contemplated by Section 373.106(1), Florida Statutes. 8. It is the staff's recommendation that a permit be granted for con- struction of a test hole and monitor well. Nothing in this permit shall be con- strued as a grant of authority or otherwise considered as written permission to begin construction of a project involving the intentional introduction of water into an underground formation. However, it is conceivable that at sometime in the future, the Board may consider a conversion of this test facility into an injection facility suitable for such a project. The mere fact that it is conceivable to make such change should not be construed as granting permission under Section 373.106(1), Florida Statutes. In accordance with the foregoing. and in consideration of applicable laws and regulations, the Board makes the following CONCLUSIONS OF LAW The parties, while properly proceeding under Chapter 373, F.S., and the Rules promulgated pursuant thereto, have presented sufficient and documentary evidence for the Governing Board of the Southwest Florida Water Management District to adequately evaluate this application, but with the con- dition that additional testing must be performed in order to determine the -3- I I adequacy of the proposed construction and subsequent injection on the natural resources of the area. Wherefore, upon consideration, it is ORDERED 1. That the Executive Director of Southwest Florida Water Management District, or a duly del~gated member of his staff, is authorized and directed to issue Permits to construct a test well and a monitor well pursuant to the above numbered applications in substantially the form and subject to the terms and conditions set forth in Exhibits "1" and "2" attached; . and the hearing shall be continued to each of the Board's regular meetings, and special meetings called for this purpose. until terminated.
