1. Application has been made to the Department of the Arrr{f by the Kiwanis
Club, Clearwater, Fla., for an extension of time to 31 December 1951 to co~
plete work under permit issued to it on 28 April 1945, to maintain an exist-
ing pier and to construot an extension thereto, in Clearwater Harbor, westerly
shore, at Clearwater Yaoht Club Point, immediately south of Clearwater Street,
Clearwater Beach, Fla. Due to the recent emergency this work has not been
commenoed. The parmi ttee is therefore requesting an extension of time in

2. Plans of this work may be seen at ti16 office of the District Engineer,
Corps of Engineers, 575 Riverside Avenue, Jacksonvi lIe, Fla.., and at the offioe
of the Engineer in Charge, Tampa sub-offioe, Corps of Engineers, Post Offioe
Building, Tampa, Fla.
3. It is not proposed to hold a public hearing on this application. Any-
one desiring to submit a protest based on the proposition that the proposed
workwoulgunreasonably interfere with public navigation, or would unfavorably

reasons therefor. The Federal c Qurts have ruled that the decision of the De-
partmont of the Army on the application must be based entirely on the effect
tJ1e proposed worle wnu1d have upon n2vii.:'~ation, and not on its effect Oll. property
ve1ues or other considerat;ic:ns h'ving nothing to do with navigation. A De-
partment of the Army permit is merely a waiver of objections insofar as public ;
rights of na.vigbtion are concerned. It confers no fra.nchise or property rights;
nor does it in a.ny way abridge any right wlJich any aggrieved person w"uld have .
had under any law, had the pF'r!l'it not been issued. Protests based on effects
on public navigation should be addressed to the District Engine'er:Corps or-

Clearwater Bea.ch Islend, Clearwater, Florida. The proposed wooden addition
wQuld ext<md into the waterwa.y 50 feet in continuation of the "L" head of
the existing pier a.t the old fiSIl plant. The extension would bo roughly
parallel with the shore line and would be 6 ~eet wide, supported on 2-pile
bonts on about 10-foot oenters, with tho du~k about 5 feet above mean low
water.
