AGREEMENT TO MOOR COAST GUARD HOUSEBOAT CG-60048 IN CLEARWATER MARINA ~^ 'P~~ I I AGREEMENT WHEREAS, on 12 August 1983, the City of Clearwater, under Lease No. DTCG28-84-L-000 25, leased certain premises at the Clearwater Marina, to the United States of America, to moor Coast Guard Houseboat (CG-60048), for use as a temporary Coast Guard Station. WHEREAS, clause 4, alterations, of said lease contains the Standard Government Restoration Clause. NOW, THEREFORE, the United States Coast Guard and the City of Clearwater, Florida, agree as follows: 1. The Coast Guard and the City of Clearwater agree to terminate lease DT CG28-84-L 00025, effective on the execution of this Agreement. 2. The Coast Guard agrees to permit Coast Guard Houseboat (CG-60048), currently located on leased site, for use by the City of Clearwater, for an indefinite period of time but not less than five (5) years from the date of execution of this Agreement, in lieu of restoring the leased premises to its original condition. 3. The Houseboat may be used for such purposes as may be deemed appropriate by the City of Clearwater and shall remain under City control at all times. The City shall have authority to make internal and external modifications of the Houseboat appropriate to such purposes at City cost. The City shall neither request nor demand any assistance from the Coast Guard, financial or otherwise, for any costs attendant to the City's use, operation, maintenance or repair. 4. The parties agree that title to the aforesaid Coast Guard Houseboat shall be retained by the Coast Guard and the City agrees to indemnify, protect and save harmless the United states of America, the Department of Transportation, the United states Coast Guard, all their officers, agents or employees, acting officially or otherwise, from any and all liability, costs, settlements, judgments, demands or claims of every kind or character, due to, or by reason C (I' 0 f(J.k./l,.a'~C:.,(;, "I ',At.,,,,., ...."1" ,=.,rJ...(,....(..("..." The City of Clearwater agrees that at such time as the Houseboat is no longer serviceable, or of no further use to the City, the City will advise the Coast Guard of its desire to relinquish its use of the Houseboat, and shall return the Houseboat to the control of the Coast Guard for disposal in accordance with Federal RegUlations. 6. This Agreement will be effective upon the Houseboat being transferred to the City of Clearwater. This Agreement, entered into by and between the undersigned parties, on this day of 198.(.
