AGREEMENT FOR CONDUCTING
NOVEMBER 4.2008 MUNICIPAL ELECTION
WHEREAS, the City/Town of Clearwater ("City/Town") has requested the
assistance of the Office of the Pinellas County Supervisor of Elections ("Supervisor") in
conducting its November 4, 2008 election and

WHEREAS, the Supervisor is agreeable to providing such assistance to the
City/Town at no charge to the City/Town, subject to the following conditions:
NOW, THEREFORE, IT IS HEREBY AGREED BY THE CITY/TOWN AND
THE SUPERVISOR AS FOllOWS:
GENERAL PROVISIONS
The Supervisor shall conduct the November 4,2008 Municipal Election of the City/Town
(the "Election"). It shall be conducted under all applicable ordinances of the City/Town
and all sections of Chapters 97-106, Florida Statutes (the State Election Code). The
County Canvassing Board shall be in charge of the election procedure and canvassing
of the Election. Any decisions regarding election recounts of the vote shall be made by
the County Canvassing Board in accordance with the provisions of the State Election
Code, where applicable, and Administrative Rule.
It is understood that the provisions of this contract are based on current state law and if
any changes in election law should occur during the period of this agreement, those
changes will supersede the terms of this contract where applicable.
The City/Town will provide the Supervisor with a detailed map of the current boundaries
and a complete address list.

BALLOT INFORMATION (Kim Walker: 464-6641):
Final Ballot Language is due August 15, 2008 at 5 p.m.
BALLOT LAYOUT/PRINTING (Wayne Fusco: 464-4958):
The Supervisor is responsible for creating the ballot. If placement of the
City/Town's municipal races/questions on the ballot causes an additional ballot
card to be created, the City/Town will be responsible for the cost of that
additional ballot card. The Supervisor will bill the City/Town.
ABSENTEE BALLOTS (Rick Becker: 464-6108):
Absentee ballots will be mailed as soon as possible. Legal deadline to mail
absentee ballots to overseas voters is September 20, 2008, which is 45 days
prior to the election.
LEGAL NOTICES
The Supervisor is responsible for the following legal notices: canvassing board
meeting schedule, sample ballot, polling place list, and polling place change
notices. If the City/Town is conducting a special election or special referendum
election, the City/Town is responsible for notices required by F.S. 100.342. The
City/Town is responsible for any notices required in its charter or by ordinance.
SAMPLE BALLOT (Wayne Fusco: 464-4958)
The Supervisor will create the Sample Ballot and publish it in a newspaper of
general circulation. The City/Town is responsible for the printing costs associated
with printing their portion of the sample ballot. The Supervisor will bill the
City/Town for the City/Town's portion of the sample ballot.

POLLING PLACES (Julie Marcus: 464-6110)
Polling Places will be selected and contracted by the Supervisor.
POLLING PLACE CHANGE NOTICES (Julie Marcus: 464-6110):
The Supervisor will mail any necessary polling place change notices, one per
household and publish the list in a newspaper of general circulation.
TESTING BALLOT COUNTING EQUIPMENT (Wavne Fusco: 464-4958):
The canvassing board will certify test results of the ballot counting equipment and
the Supervisor will file the election parameters with the Division of Elections. The
Supervisor will publish canvassing board meeting schedule. The canvassing

*Effective January 1, 2008, anyone who casts a provisional ballot has two days after the
election to provide proof of eligibility to the Canvassing Board. The deadline for this
election is November 6, 2008 at 5 p.m. (Florida Statute 101.048)

machines to and from polling locations.

The Supervisor is responsible for any loss or damage to election supplies while

POLL WATCHERS (Kim Walker: 464-6641):
Poll Watcher designations must be submitted to the Supervisor. The deadline to
submit poll watcher designations for early voting sites is October 7.2008. The
deadline to submit poll watcher designations for polling places on Election Day is
PRIOR TO NOON October 21, 2008.
CANVASSING ABSENTEE BALLOTS:
The County Canvassing Board will canvass the absentee ballots.
PROVISIONAL BALLOTS:
The Supervisor will research each provisional ballot to determine the voter's
eligibility and will present the provisional ballots to the County Canvassing Board
for decision.
ELECTION NIGHT RESULTS:
Results will be released throughout the night and posted to the Supervisor of
Elections' website (www.votepinellas.com). The Supervisor will provide unofficial
results election night.
AFTER ELECTION:
Provisional ballots will be canvassed and, if accepted by the County Canvassing
Board, will be processed and added to the election night results to produce
Official Final Results. Precinct and absentee results will then be provided as
soon as possible.
