RECOMMENDATION: Pass a Resolution authorizing the City Manager to submit a
proposal to UMTA-DOT for a "Downtown People Mover" system between the
Clearwater Central Business District and the Clearwater Beach area.
[] And that the appropriate officials be authorized to execute same.
BACKGROUN D:
In April, 1976, the Federal Urban Mas s Transportation Administration (UMT A)
announced a project to demonstrate the benefits of fully automated people mover systems
in urban downtown areas. U:MTA will choose up to three cities and will provide up to
80 percent of the capital costs involved. Sixty-seven cities are vying for these funds.
The State Department of Transportation (DOT) fully supports this project and has
indicated a willingness to fund half of the non-federal share. There is also a possibility
that credit for a portion of the local share would be given for existing public right-of-
way used in establishing the system.
After review of proposals submitted, UMTA will invite full applications from those
cities whose proposals have the most merit.
The Clearwater proposal enVlSlons an Automated Guideway Transit (AGT) system,
originating from an intermodel terminal in the Central Business District. with an
elevated guideway across the intracoastal waterway (no draw span), an elevated
guideway along the southern edge of the Memorial Causeway to the Public Beach area
and a provision for future expansion to the Sand Key area.
The Tampa Bay Area. Rapid Transit Authority and the Florida Department of Transporta-
tion are joint participants with the City in proposal preparation. It is contemplated
that operation and maintenance of the Clearwater Downtown People Mover system would
be as signed to TBAR T.

BACKGROUND:
The Planning Director explained to the Planning and Zoning Board the intent
of rezoning this spot commercial zone, along U. S. Highway 19 N., in accordance
with its use. He explained that civic clubs and fraternal organizations
throughout the City have been zoned ISP.
Elliot Stern, Past President of Clearwater Jaycees, spoke against the
application. He emphasized their intent to continue, and even expand,
the commercial leasing of space within the facility.
After the description of the Jaycees use and intent it was determined the
ISP zoning could not apply to this property.
The Planning and Zoning Board and the Planning Director support the
denial of this change in zoning.

BACKGROUND:
The Planning Director explained the intent of rezoning this spot commercial
zone, along U. S. Highway 19 N. The property is presently undeveloped except
for paved access areas leading to the Clearwater Jaycees Building area.
The original planned use of this property was to provide a convenience store
,to serve the planned mUlti-family residential project adjacent and south and I'
another to the north known as Stratford village.
The Planning Director stated that there was sufficient business usage within
a mile or two in either direction along U. S. 19, and that the original intent
of a service commercial area to meet the needs of a low income housing pro-
ject on the site immediately to the south had been negated when that residen-
tial project did not develop. Further that people will not walk to this site
except from immediately adjacent tracts and that vehicular movement would be
to the larger centers. Also commercial development here would affect traffic
flow and there would be some conflict with ingress and egress.
Attorney William MacKenzie representing U. S. Home, requested that this re-
~oning be denied, and that the present business zoning be retained in order
io provide the needed service when the adjacent multi-family area is developed.
"The Planning and Zoning Board, noting the earlier action re the Jaycees
:~~cation, concurred with William MacKenzie on retaining this remainder parcel
\~?r commercial usage and voted to recommend denial of the rezoning request.

When Montclair Estates was platted and annexed this property was zoned
multi-family in order that a non profit swim club could be established
(This was the only residential zone permitting a community club.)
Surrounding development has continued as single family in character except
that (overall) to the south an RPD (Residential Planned Development) of
approximately 10 units per acre was approved with public dedication to the
north for a park.
Tract in question is a spot zone of high density not compatible to
surrounding development.
Montclair Road is 66 feet Right of Way.
N. Keene Road is 100 feet Right of Way.
The Planning and Zoning Board and the Planning Director concur
with this recommendation.

Business zoning was requested in 1971 and was denied. Owner appealed the
decision and the court directed the City Commission to rehear the case, and
act on some type of district other than what it was zoned (R-4 Multiple
Dwelling). The property was subsequently zoned CG although staff and Planning
and Zoningc\Board had recommended PS (Professional Services). The City also'
requested the owner to give additional right-of-way for Greenwood and to make
the zoning subject to restrictions prohibiting service station, garage, or
junkyard usage. The owner at the time indicated pending agreement for a
; European Health Spa. The City Attorney stated that a Health Spa could not be
placed in a PS district.
At the Planning and Zoning Board meeting of 6-8-76 the owner would not accept
RM-16 or PS zoning for the tract.

Development to northwest and southwest is principally low density'residential.
Early multiple family development to southeast is approximately 17 units per
acre. North of tract across Druid Rd. is Barbee Towers; a specially designed
apartment structure for Senior Citizens. North of this is a convalescent home
also established through BAA procedure.
The only trend in the Greenwood corridor extending south to Lakeview and
within a block of this intersection has been medical office or medical clinic
development, all approved through BAA (Similar to action establishing medical
offices west of subject tract).
Summary of reasons supporting the City request of removal of B (Business)
zoning on th1S parcel.
1. Retention of CG is spot zoning giving one owner a: privilege others
in area do not have and also is not compatible to that of surrounding
properties.
2. CG zoning is not needed at this location because adequate commercial
services are provided within 2 blocks of site.
3. Multi-family residential, or professional usage is the trend for the
area evidenced by housing for the elderly and BAA requests and building
permits for doctors offices etc., during the past three years.
4. Previous zoning was speculative and no need for CG was established
then nor exists now.
5. This action is a part of an ongoing rezoning study scheduled for this
high density multi-family zoned area (which is principally single-family
used) between Greenwood and Myrtle, south of Druid Rd., per City Commission
direction to rezone commensurate with use and Comprehensive Plan implementa-
tion.
The Planning and Zoning Board action and recommendation of denial.
At the public hearing of the Planning and Zoning Board, the Board (4:1)
voted to deny the City request from CG to RM-16. Such is the Board's
recommendation.
The assumed reasons for the Board's recommendation follows:
1. A moral obligation to support the previous determination of granting
CG zoning by the City Commission in 1971. (Counter to a previous Pro-
fessional zoning recommendation of the Planning and Zoning Board at that
time).
2. The legal obligation to respond to the Court direction for a rehearing
(assumed to be for business zoning since this was what the City had denied;
however, the Court had only ordered for due process for something other than
the R-4 zoning held at that time.)
3. The owner will not accept Multi-family or a PS, professional zone
compromise.

BACKGROUND:
This is in continuance of the overall rezoning directed by the City
Commission in order that zoning will match the established or proposed

Although property was initially zoned RM-28 and CS, the City and
County have acquired properties for public use. The County area
being developed.

:The Comprehensive Land Use Plan shows this area to be Public/Semi-public as
:presently zoned.
Attorney William L. Gilkey represented Northwood Estates at the Planning &
,ZQning Board public hearing and explained the economic difficulties in sales
of church sites within the 40 acre Tract I. He pointed out the agreement with
the City, when Northwood Estates was platted, that should the developer be
unable to sell, with ISP zoning, all or any part of Tract I, within a reasonabl
'period of time, then Tract I or any remaining part may be rezoned to a density
not to exceed 3.3 dwelling units per acre. Two 5 acre church sites have been
sol~ and he has hope of selling a third; however, he requested to rezone the
'remaining 25 acres into a RS-60 district. Of this 2S acres,they are in

on the public hearing notice.

BACKGROUND:
This area has developed in accordance with the Comprehensive Land Use Plan.
The area includes all of that land occupied by Clearwater Point Condominiums
plus the recreation area.
This rezoning is in continuance of the overall directive by the City
Commission to rezone parcels to match the established or proposed Land use.
Mr. Edward S. Branigan Jr., President of lnterhouse Association of Clearwater
Point Condominiums, spoke in favor of the request at the Planning and Zoning
Board meeting.
Attorney Michael L. Hastings represented Field Hotel Corporation and Field
Construction Corporation and spoke against the change in zoning on the basis
of its effect on an active legal suit of Field Hotel Corporation vs. the City
of Clearwater (Case No. 758130-10).Field Hotel Corporation is seeking building
permits at a density of 34 unit~ per acre to use on two additional highrise
"structure~ on t~e project.
The Planning Director explained that this requested change in zone would have
no effect on the permitted density, since both CG & RM-28 limit the density
to~8 units per acre.
