",70 feet of Gunn Avenue be approved and retained full width as a right-of-way easement with City control over the plantings in this area ~ -, , , GI And that the appropriate officials be authorized to execute same. ,,' BACKGROUND: :, GUnn Avenue is a relatively short street which ends in a " cul-de-sac just short of Lake Starcrest. a privately owned lake. ,.' There is no likelihood that Gunn Avenue will ever be extended to the North. . ,', This portion of unpaved right-of-way is now maintained by the '. adjoining property owners and the only need the City has is for access to maintain storm drainage into the lake. This request has been reviewed by the various City Departments involved and Traffic Engineering is the only department to object to this vacation. Traffic Engineering states that placement of the palm trees in >,the extension of Gunn Avenue will provide a hazard for motorists. traveling north on Gunn, who fail to realize that the street ends. Although there have been some cost overruns most projects are under budget~ Thus, funds originally budgeted for contingencies have not been needed and an unencumbered balance of nearly $30,000 exists and is available for redistribution among previously approved projects. Fiscal status of all first year projects is shown on the second attachment. The first Community Development "Program Year" ends on June 30, 1976. Encumbering the bulk of the first year funds prior to the expiration of the program year would be an affirmative showing by Clearwater of its continu- ing capacity to carry out the CDBG program in a timely manner. BACKGROU N D: As directed by the City Commission, the staff has renegotiated the option to purchase the property known as the Hunt-Shingler properties, for the proposed Civic Center/Auditorium. The conditions which have now been renegotiated in th'e previous propos ed option agreement considered by the Commission at its meeting of March 18, 1976, are as follows: 1. Increase in purchase price from $1,450, 000 to $1,496,000. 2. Term of option increased from 6 months to 9 months. .3. Payment for option by City reduced from $72,500 to $25,000. The option price to be applied toward the purchase price, but not refundable if the option is not exercised. 4. The sellers would guarantee that the property would be suitable under normal construc- tion conditions for constructing a Civic Center / Auditorium. It is the staff's belief that the attached option is the best that can be negotiated at this time. The $25,000 would be transferred from the C. I. P. Storm Drainage Improvement Projects. DYNA-FLo.l Temporary Sewer Service Agreement RECOM MENDATION: Approve the attached Temporary Sewer Service Agreement with Dyna -Flow for sewage treatment capacity of up to 200, 000 gpd., until the permanent Clear- water Northeast Wastewater Treatment Plant is operational~ conditional upon the Clearwater and Safety Harbor City Commis sions' approval of a contract between Safety Harbor and Clear- water for treatment of Safety Harbor's sewage at the permanent Northeast Treatment Plant~ II!I And that the appropriate officials be authorized to execute some. BACKGROUND: The City staff has prepared the attached agreement to obtain a net increase in capacity of 100,000 gpd wastewater treatment in the Northeast Clearwater area on an interim basis. Pertinent provisions of the contl."act include: 1. A guarantee of 200 gpd wastewater treatment capacity for Clearwater in the Dyna-Flow plant on a temporary basis. 2. Th.e capacity will be available (if needed) to Clearwater for a period of five years. Clear- water may terminate the agreement in less than five years when the permanent plant is J),per ational. 3. Clearwater will receive all tap fees for the units within the City to be temporarily served by Dyna-Flow. 4. Dyna-Flow will receive the monthly sewer rate established by the Clearwater City CommiB sion for those units temporarily hooked up to the Dyna-Flow plant. 5. Tem.porary hook-ups will be at the expense of U. S. Home. 6. The City of Safety Harbor will receive 100 gpd capacity in the Clearwater interim one (1) million gpd treatment plant. The Acting City Engineer and the City Manager believe that this net increase in capacity will be needed by Clearwater prior to the time the permanent Northeast Wastewater Treatment lant is operational. The contract with Safety Harbor for its sewage treatment at the permanent Northeast Treat- ent plant is nearing finalization and will be presented to the Clearwater City Commission at 'ts next regular meeting. The intent of this recommendation is to have the Safety Harbor ontract approved by both City Commissions, prior to execution of the Dyna-Flow contract. Harold Braaksma et a1 SUBJECT: RECOMMENDATION: The agreement for sanitary sewer for North 65 feet of Lot 8, Suban's Sub- division be approved SUbject to approval by the BUilding Permit Review Committee. ~And that the appropriate officials be authorized to execute same. BACKGROUN D: Property is in the County, is contiguous to existing City limits, but cannot be annexed as it would create an enclave. Sanitary sewer is available to the property. Property owner cannot build on lot without sanitary sewer. Sanitary sewer will go to the Marshall Street Plant. Area presently served with City water and gas. Fire Hydrant approximately 300 feet from the property. West Drive is paved but without curbs and is in poor condition. The right of way is platted 60 feet. A ten foot utility easement is required at the rear of the lot. Proper zoning, when annexed should be RS 60, which is acceptable per both City and County Comprehensive Plans and per surrounding land use and zoning. This is a standard two-year agreement.
