Love for waiver of City Code requirements for installation of a sidewalk in conjunction with construction of a parking lot on lots 15 & 16, Block C, Carolina Terrace (Michigan and Howard). CJ And that the I appropriate officials be authorized to execute same. BACKGROUND: Some time ago, when Missouri Avenue was widened, a portion of Mr. Love's property was taken for road right-of-way. This 'taking' reduced the amount of parking space available to Mr. Love's business. He has now decided to construct a parking lot on the corner of Michigan & Howard Streets to provide additional parking for his business. On March 1, 1976 the Commission did not grant Mr. Love's appeal from the City Manager's d~nial of his request for a sidewalk installation waiver. The! City Manager's basis for denial was that the request did not conform to the provisions of Section 7 -6 of City Code' of o.rdinances in that a sidewalk can readily be constructed on this property and an undue hardship was not made apparent. Mr. Love has requested that the City Commission reconsider his appeal because he was not present at the Commission meeting of March 1, 1976 to ,present his case. Mr. Love's son I'lvieiited.. the,' office prior to the Commis 8ion meeting of March 1, 1976 but he did not clearly understand that hia appeal would be heard at the meeting that day. The County would have total control over the emergency medical program within the City of Clearwater. The deed conveying the property to the Johnsons was dated January 16, 1974, and contained a stipulation that if a building permit was not obtained within forty (40) months from the date of sale and construction commenced immediately thereafter, the property would revert to the City. On December 18, 1975, the City Commission approved that the City refund to the Johnsons the $5, 100 paid for the property, in exchange for a Quit Claim Deed for the property. This approval was subj ec t to there being a bonafide buyer for the property irom the City at the price of $6,000, and that the Deed conveying the property to the new owners contain the same reverter clause as the previous deed. The above action was taken by the City as the Johnsons believed they had the property sold for $6,000. This sale did not materialize and the Johnsons are again trying to dispose of the property.
