LEASE RENEWAL - COLONY MARINA RESTAURANT, INC.
RECOMMENDATION: That the attached lease agreement renewal of the Colony Marina
Restaurant, Inc. for an additional five years be approved as recommended by the
City Manager, and that appropriate officials of the City be authorized to execute it.
BACKGROUND: In May, 1969, the City executed a five-year lease with Colonty Marina
Restaurant: Inc., for operation of a lunchroom on tne ground floor of the Clearwa.ter Beach
Marina building. This lease contained an option to renew for an additional five years. The
following changes have been made in the agreement, and are agreeable to the lessee:
'1. Rental rate increased to $300. per month, plus 5% of the gross revenue over and above
$60,000 per annum (old rate $250. per month plus 5% of gross over $60,000 per annum).
2.' Monthly City gas charge $27.00 to be added to monthly rental rate (restaurant's gas'
meter has been removed and the restaurant is served by the Marina I s gas meter. $27. 00
is the average amount ,used last year).
The leBsee requested that the lease renewal agreement again contain an option for renewal
fot an additional five years. The Staff does not recommend such an option. The option is
in the current lease because the lelllee agreed to make improvement~ to the property and the
,option gave the lessee the opportunity to recoup his investment. Based upon an anticipated
gross revenue of $l20, 000 per annum, net annual revenue to the City would be approximately
,$~,600.' This is considered to be a fair rate of return to the City. Attached is a sworn
statement of gross revenue.
,The tenant has been. highly satisfactory to the City.

regarding problems of interest to both parties. For the most part, the items listed in the

It. is the belief of the City Engineer and the Assistant City Manager for Administration that
it, is in the beat interest of the City that these problems of long standing be resolved at this
time. It is believed that the proposal contained in Mr. Marquardt's letter represent a
wash' out of dollars. It is not the intent to recommend that the City pay any portiun of

SUBJECT:
. Revision of Section llAw4, Code of Ordinances - Hearings -
Southern Standard Housing Code.
RECOMMENDATION: That Section llA-4 of the City Code of Ordinances, p~rtaining to
setting of a public hearing date on non-compliance byproperty owners or tenants with
written notice by Building Dept. official~ to repair, alter or improve, or to vacate or
close a building, or to remove or demolish a structure, be revised so that the City
Manag,er instead of the City Commission shall give notice of public hearings on non-com-

BACKGROUND: Section ll-A-4 of Code of Ordinances prp.Rcrioes that the City Commis-
sion shall give notice of Fublic Hearings after non-compliance of property owners or
tenants within prescribed time periods to written notices by Building official to correct
property deficiencies. This requirement on the part of the City Commission adds to the
lengthy.time period involved in correcting serious px:operty deficiencies and unsafe pro-
perty conditions. It is recommended that the City Manager be authorized to set such
public hearing dates and send the requi;red notices to the property owners or tenants.
This revised procedure would not in any way dim"inishor take away the City Commission's
rights in this matter, since the City Commission considers each case only after the
hearing has been scheduled and properly advertised and property owners or tenants
have been notified.

.SUBJECT: PROPOSED KINGS HIGHWAY RECREATIONAL CENTER
RECOMMENDATION: That a motion be passed approviug the design of the proposed
Kings Highway Recreational Center as designed by Mr, George C. Haddox, 'AlA, and
that the City Engineer be authorized to obtain bids for the construction of this facility.
BACKGROU NO: In October, 1973, the City Commission approved the Capital
Improvement Program which included a Recreational Center on Kings H~ghway (C. 1. P.
#3402). On November 5, 1973, the City Commission approved an agreement with Mr.
George C. Haddox, A.!. A. I to des ign this facility.
Following discussions with residents of the area and Scout officials" a consensus was
reached tbat the structure known as the Boy Scout Hut on Highland Avenue could not
be economically repaired or replaced, and that it would be better to expand the planned
Kings Highway Recioeational Genter to provide room for such gr oups in that facility.
'. The proposed design provides one more room in that Facility where Scouts and other
groups could meet.

SUBJECT:
IMPOUNDMENT OF MOTOR VEHICLES
RECOMMENDATION: That a motion be approved authorizing the City Manager to seek
'bids 90 a franchise to conduct towing and impoundment of motor vehicles at the direction
of the Police Department in accordance with Police Department and State regulations.
BACKGROUN 0- The City currently has an informal arrangement with a Clearwater
· towing firm. This arrangement is unsatisfactory in that the towing
firm's legal, administrative, procedural and financial responsibilities are not defined.
Congequently, the City and the towing firlD have been subjected to criticism for alleged im':'
p:r.oper procedures in impoundment of vehicles, and alleged non-cornpliance with State la.ws
pertaining'to impoundment of vehicles. The proposed franchise would apply only to those
vehicles which are involved in accidents, abandoned, stolen, etc., and which are required b
Police Department and State regulations to be towed for impoundment, No vehicles would
be towed for irnpoundment unless City Police have so directed. Vehicle owners/operato:L's
will retain their right to obtain or reque at a towing firm of their choice in routine canes of
'a'ccidents, disabled vehicles, etc., when the policy have not directed that the vehicle be
. impounded. , Attached' is, a preliminary list of bid specifications on the proposed franchise. '
The' request for bids will not be advertised until the City Attorney has completed his review"
,and refinements. Additionally, the City Commission will have an opportunity to review and
approve: the proposed franchise agreement, as well as award of the franchise.
