DIRECT PUBLIC SUPPORT AND REPAYMENT
INFILL HOUSING DEVELOPMENT PROGRAM
1. Direct public support shall mean costs of providing infill housing which are unique to the specific lot and home
being produced. Direct public support costs may include land purchase, landscape and streetscape improvements,
infrastructure and site improvements, appraisals, surveys, interest paid during construction.
2. Direct public support will be provided to individual applicants based on their need, and may not exceed 25 % of
the total cost of land, building construction, permits, site development, landscaping, and other costs incidental to
construction of a house.
3. Direct public support may be provided to first-time homebuyers in the form of a grant of up to $2000 for
purposes of required downpayments, site landscaping, or reducing the principal amount of the first mortgage.
4. Direct public support may also be provilJed to purchasers under the program in tbe form of a second mortgage
to make the payments on the first mortgage affordable to low and moderate income families (up to 120% of the
area's median income). This second mortgage is intended to approximately cover the cost of the lot on which the
house is built. The following examples illustrate the relationship between second mortgage amount, ability to repay
the first mortgage, and the applicant's income:

Family of 4 with an income of $25,100 (80% of median) with $250 per month in other long-term debt (car, student
loans, etc.) can afford a housing expense (principal,interest,taxes and insurance) payment of $550 per month. It is -
proposed that an interest rate of 9 % be offered by participating lenders, with a term of 20 years.

BACKGROUND:
The request is for a Land Use Plan Amendment from High Density Residential to Residential/Office and a Zoning Amendment
from RM-28 (Multi-Family Residential "Twenty-Eight") District to an OL (Limited Office) District.
The owner of the subject property also owns property to the south which is developed with 10 dwelling units in three
buildings. This request if approved will divide Lot 2 but will not require replatting as it is addressed as an exemption under
Land Development Code Section 133.029(3), which states "The transference of part of one lot or tract to an adjacent lot or
tract (is permitted) provided such transference neither reduces any lot or tract to an area or width less than that specified in
Chapter 135.000". Both lots will meet the lot size requirements and the RM-28 Parcel is still within density limitations. This
lot adjustment is necessary to insure the parcel currently developed in apartments meets the side setback requirements.
The subject parcel is presently vacant. If this request is approved the owner proposes to seek a Conditional Use Approval
to permit the development of a child day care center on the property. This request will require Pinellas County Planning
Authority approval.
The request would result in the existing OL Zone to the north and to the west being extended to encompass the approximately
two lot parcel. This block between Turner St. and Pine St. is already a mixture of residential and office uses and the proposed
amendments would not be incompatible with the surrounding uses.
The Planning and Zoning Board at its meeting of October 2, 1990 continued this request until its meeting of October 16, 1990
because the applicant was not present. On October 16, 1990, the Planning and Zoning Board unanimously recommended
approval of this request.

FOURTH AMENDMEWl' TO AGREEMENT WITH
CHI CHI RODRIGUEZ YOUTH FOUNDATION, INC.
THIS AMENDMENT TO AGREEMENT is made and entered into on this
1st day of November, 1990, by and between the city of Clearwater,
Florida, a municipal corporation, hereafter referred to as
"City," and the Chi Chi Rodriguez Youth Foundation, Inc., a
Florida nonprofit corporation, whose address is Post Office Box
1521, Largo, Florida, hereafter referred to as ."Foundation,"
amending the Agreement between the parties dated November 12,
1985.
In consideration of the premises and of the faithful
performance by each of the parties of the covenants and
agreements between each other made, it is mutually agreed that
the Agreement between the parties dated November 12, 1985, is
amended as follows:
1. Paragraph 34 is amended to read as follows:

BACKGROUND: Several years ago, the City and Arthur J. Gallagher & Co.
and casualty insurance program. Under the program, Arthur J. Gallagher
program to various insurance markets and assists the City in purchasing
commensurate with its risk. Due to new legislation passed in 1989, the City has become
obligated to purchase first dollar flood insurance coverage. Renewal of these policies
have been tentatively placed as follows, but if better rates can be obtained with other

SECURITY FENCING (90-08) to SMITH FENCE COMPANY of CLEARWATER, FLORIDA for the sum
of $65,503.33 which is the lowest and most responsive and responsible bid received
in accordance with the plans and specifications.

BACKGROUND: On February I, 1990, the City Conunission authorized the execution of
a Joint Participation Agreement (JPA), Job No. 15099-3808 with the Florida
Department of Transportation (FDOT) for the purpose of installing security fencing
at Clearwater Airpark. The JPA is one of two authorized with the FOOT by
Commission Resolution No. 90-2 (ATCH) for installing improvements at the Airpark
on a 50/50 cost sharing basis. Funding for the City's share was authorized by the
Penny-for-Pinellas infrastructure tax with $250,000 allocated in the FY 90 CIP to
fund the airpark improvements scheduled for FY 89/90. The State will reimburse
the City for the State's share upon completion of the project.
The project was designed by the City's airport consulting engineer, Greiner, Inc.
That firm is in charge of the construction process including bidding and
construction management. Plans and specifications for the security fencing
project were prepared in accordance with FAA, State, and City requirements and
have been reviewed and accepted by the FAA, FDOT, and the City's airport
authority.
Consisting of construction of a 6-foot high chain link fence in those areas around
the Airpark where none exists or where the present security fence is inadequate,
the project will greatly enhance the safety and security of operations at the
Airpark. Two sixteen foot wide electric, key-pad entry gates will control access
by motorized traffic onto the Airpark flight line and maintenance areas.
Installation between the Airpark and the golf course will control the intrusion
of golfers and other pedestrians into the Airpark, too, and further improve
operational safety by preventing them from wandering onto the runway in search of
errant golf balls.
All construction is to be completed by mid January 1991.
The available balance in this project is sufficient to provide funds for this
contract.

Greiner therefore recommends that the construction contract for subject project be
awarded to Smith Fence Company in the amount of the base bid on base bid plus additive
alternate subject to the legal and financial review and approval of the City of Clearwater
and the Florida Department of Transportation.

asked to redraw the plans showing all dimensions of panel widths, walk-way widths, etc. and

product. This was done and the bid was re-advertised. The redrawn floor plan was reviewed
by the Building and Fire Departments, .and they indicated code requires that walkways be a
minimum of 4411 wide and some minor adjustments were made to assure this code was met. The
drawing of the floor plan and the specifications will be available at the work session for
Commission review.
A bid protest was sublnitted by Alan's Office Supply, protesting the bid specifications prior
to the bid opening. The Purchasing Manager responded to the protest on August 30, 1990
upholding the specifications, and notified Alan's Office Supply if they wished to appeal
Purchasing's findings they had five days to file such an appeal with Kathy Rice, Assistant
City Manager. No appeal has been filed with Ms. Rice. Alanis Office Supply did submit a
bid and was the highest cost bid submitted.

authorize fll)al action by the Development Review Committee (ORC) subject to the conditions on page 2. .

BACKGROUND:
The developer Is requesting approval of a site plan for an auto emission inspection station building to be constructed on a
currently vacant 1.65 (gross) acre site, presently zoned M.l (County). The applicant has also put forward requests for
Annexation, Land Use Plan Amendment to Industrial and IL (Limited Industrial) Zoning. Vehicle service would require a
conditional use approval under the IL(Umited Industrial) District Zoning. Conditional Use approval must be obtained prior to
Development Review Committee courtesy review, as per Section 137.010 (f) (4).
The actual facility is proposed to be built on the rear portion of the lot next to the railway track. The building is proposed to
accommodate five (5) inspection lanes with an additional lane to be added at a later date. It appears that due to the site
configuration the parcel does not meet the 100 ft. frontage required on Range Road, although some consideration should be
given to the fact that the parcel has a flag shape. One access to the site is proposed, which is located at some point off
Range Road.
Analysis of this development determined a high trip generation factor and consequently required a traffic impact study; such
study has been submitted and has been reviewed by the Traffic Engineer. Revisions to the traffic impact study are necessary
regarding: (1) directional split (the report has too many vehicles going on Range; not enough on Belcher) and (2) trip
distribution (the report says that 70% are diverted trips rather that primary; this is not a correct assumption, it should assume
that a greater percentage of trips are primary and working from there it will be acceptable as it will use up some but not all
the available capacity on Belcher). Belcher is now considered at "C" Level of Service (L.O.S.) (2,900 vehicles during the peak
hour) and Is required to be maintained at "0" L.O.S. (3,130 peak hour trips). The Traffic Engineer finds the actual L.O.S. on
Belcher currently to be somewhere between "C" and "0". The study based the trip generation on actual projected trips taken
from data on the number of registered vehicles and number of stations in the proposed facility, rather than estimates by ITE
4th Edition. The faCility will probably use up about 50% of the remaining capacity for Belcher Road, the specific figure of
which will be documented in the city's concurrency records. While Traffic Engineering is recommending that this project be
approved, based on their findings that it will not negatively affect the L.O.S. on Belcher, the traffic impact study must be
corrected. It should be noted that this project will use up a generous portion of available peak hour capacity for Belcher
which may restrict the Intensity of other developments in this area in the future. That is, a substantial amount of Belcher
Road's peak hour capacity will be consumed by this project. The Traffic Engineering office estimates that this project will
utilize 41.5% of Belcher Road's remaining peak hour capacity; there are 236 peak hour trips left to be allocated and this
project will generate approximately 98 peak hour trips. This is allowable under City concurrency regulations, but has the
effect of potentially limiting other development projects on this section of Belcher Road.

BACKGROUND:
Last year, an amendment was made to the Florida Statutes that enabled counties and municipalities to pass ordinances that authorize
. code inspectors to write tickets for certain code violations. The Planning and Development Department proposes to utilize this
enforcement option for the occupational license ordinance, nuisance ordinance, and Land Development Code. If this ordinance is
approved by the City Commission, the Department would have the option of pursuing violations either through the Municipal Code
Enforcement Board or through the issuan~e of tickets. Tickets may be issued by the code inspectors when violators fail to comply
with the code within a reasonable time period established by the inspectors. The violator will have the opportunity to contest the
citation in county court, if desired. The ordinance proposes three classes of violations, depending upon the seriousness of the offense.
The proposed fmes are $30 plus court costs for a Class III violation (such as failure to procure an occupational license), $60 plus
court costs for a Class II violation (such as the display of pennants for sales promotion), and $135 plus court costs for a Class I
violation (such as a sign dangerously placed at an intersection that blocks the view of motorists).

pursuant to sections 553.79 and 553.80. Florida Statutes. of buildina codes
adopted pursuant to section 553.73, Florida Statutes. as they apply to
construction. provided that a building permit is either not required or has been
issued by the city. For the purposes of this paraQraph. "buildinQ codes" means
only those codes adopted pursuant to section 553.73. Florida Statutes.

means of enforcinq city codes or ordinances.
Nothinq contained in this
subsection shall prohibit the city from enforcina its codes or ordinances by any
other means.

(a) Upon receipt of a complaint that property is in violation of this
chapter and upon completion of the field investigation by the code enforcement

property shall w+++ be posted with a notice advising of the existence and nature
of the violation and requesting compliance on or before a date certain, which
shall be the day before the date of a regularly scheduled meeting of the code
enforcement board but which shall be not less than twenty-one (21) days after
the date of posting. A copy of the notice shall w+++ be sent to the property
owner by mail on or before the date of posting, or by personal service within
fourteen (14) days after the date of posting.

RECOMMENDATION:
City Commission approve the Final Site Plan for Island Estates Dry Storage Marina subject to the conditions listed on page
3, as recommended by the Development Review Committee IO.R.C.).

BACKGROUND:
On August 2, 1990, the City Commission reviewed a preliminary site plan for this site for a proposed modification to the
existing high dry storage structure which consisted of raising the 'roof to add two additional levels of boats to the e~lsting
one level and thereby increase storage from 42 boats to a total storage of 126 boats. The City Commission authorized the
site plan to go forward through the review process with the final site plan returning to the City Commission for final action.
Prior to the City Commission meeting, the Planning and Zoning Board, at its meeting of July 17, 1990, had granted conditional
use approval subject to the fOllowing conditions: 1) The applicant shall obtain requisite site plan re....ew approval and submit
for site plan certification within 6 months; 21 The site plan shall be revised showing enough of the City parking lot to
determine that the new southerly parking on subject site will work, prior to submittal of the final site plan for review by the
DRC; 3) The limits of the parking/vehicular easement on City property shall be provided on the site plan for DRC review;
41 The existing and proposed height of the structure shall be given on the final site plan in accordance with the CG height
limitation for DRC review; 51 The 50% minimum open space requirement for the front yard shall be provided on the site plan
prior to DRC review; 61 The rollout dumpster is subject to Sanitation approval prior to certification of the final site plan; 7)
The developer must comply with City landscaping requirements and supplementary landscaping intended to reduce the impact
of the structure as determined by the City's Environmental Management Division and the Director of Planning and Development
Department, !>rior to submittal of the final site plan for DRC review; 81 Any lighting shall be directed away from residential
areas; 9) Total boat storage shall not exceed 126 boats; 101 No engine testing or repairs between the hours of 9:00 p.m.
and 6:00 a.m.; and 1111f variances are required, such variances must be approved by the Development Code Adjustment
Board.
According to the developer's architect, the height of the structure was to meet the 50 foot maximum height restriction of
the CG District for which the property is zoned. While the site Iwhich was developed several years ago prior to current codes)
has no conforming improved parking area, the applicant proposed to redevelop the east side of the site, which was previously
used for outdoor service (there was once a canopy In this area for boats to be placed under) and the south side of the site
into parking areas to provide parking for the additional boat storage (code requirement is .5 parking space per slip). The
parking area on the east side of the site was to be accessible from one driveway off Windward Passage and the southerly
parking area was to also be accessible from Windward Passage via an existing City owned parking area for the Clearwater
Marine Science Center. The Traffic Engineer recommended that the affected portion of the City owned parking area/easement
be shown on the site plan for determination that the new parking area will be consistent with the existing parking lot.
The roof addition required approval of setback variances as the existing structure did not conform to current minimum
requirements in the CO Zoning District. On August 9, 1990, these variances were denied by the Development- Code
Adjustment Board as the Board was concerned about the nonconforming setbacks and parking on the site.
