ASSUMPTION OF OBLIGATIONS UNDER LEASE
The undersigned, E. A. BARGER and ROSALIE M. MULDER, in
consideration of the Assignment of Lease to them dated December 14, 1976,
by and between the CITY OF CLEARWATER, FLORIDA, a municipal
corporation, as Lessor, and E. A. BARGER, as Lessee, by E. A. Barger,
and in further consideration of the Consent thereto by the City of Clearwater,
Florida, hereby aSSUIl1es and agrees to perform each and every covenant
and obligation of said E. A. Barger accruing subsequent to said assignment
to them, under the terms and conditions of said lease, it being understood
that said E. A. BARGER and ROSALIE M. MULDER have assUIl1ed the
interest of the said E. A. BARGER.

CONSENT TO ASSIGNMENT
The CITY OF CLEARWATER, FLORIDA, a municipal corporation,
the Lessor in the above described lease agreement dated December 14,
1976, hereby consents to the foregoing assignment therefor from E. A.
BARGER to E. A. BARGER and ROSALIE M. MULDER.

The City has entered into a Lease with Hr. E. A. Barger, Jr., authorizing
him to sell bait and ice at the Marina. I recommend that he be allot'led to proceed.
This is not a departure from established policy. Bait and ice were sold
from a shop in the Small Harina Building from the time it opened in 1952 until
it closed in 1970. A copy of the Lease is attached. See paragraph 3 on page 2.
The dock Leased to l-rr. Barger is at the same location as the former bait pier,
which served the public for 17 years.
The Small Harina Building ..las vacant from 1970 Wltil it ..1as finally
demolished to make room for additional parking. During that period, l;1r. Hat-lkins
himself expressed interest in leasing space in the building to operate a bait and
tackle shop. A competitor of Hr. Hal'1kins expressed similiar interest. Hr. Hat'lkins
evidentl;,.. feels that the sale of bait and ice at the Har:ina "louldbe unfair
competetion ,.lith private enterprise only if he t'lere not the concessionaire.
The Marina Gift Shop, Restaurant, Barber Shop, Harine Sales Store and
Realty Office occupy Leased public property and serve the public as ...,ell as
customers a..'1d tenants of the Harina. l4r. Barger has appeared before the City's
H.;rine Adyisory Board and explained his request for a Lease. The Board agreed
that facilities for sale of bait and ice at the Harina are highly desirable.
The sale o! bait and ice has been an integral part of the Narina since
