Dear Mr. Williams:
Senior City management has reviewed your letter of October 4, 2001 with respect to the
referenced lease.
While there is mutual agreement that the Noland Company and its predecessor have historically
been good, clean, tax paying businesses operating within the City of Clearwater, City officials are
committed to competent management of City-owned assets. It is this commitment that compelled
management to initiate the recent, long overdue review of the terms and conditions of its 29-year
lease of the South Greenwood parcel to the Noland Company and its predecessor.
My September 10, 2001 letter to you outlined the modified terms and conditions upon which City
management would recommend approval of a new lease. Those modifications represent a very
generous offer of one-half the market rent as determined by a certified appraisal performed in
June of this year, and a very liberal interpretation of the City's development code as it applies to
outdoor storage areas.
I have been directed to advise you that management will neither consider nor recommend lease
renewal on any lesser terms and conditions than those detailed in the September letter. If those
terms and conditions are unacceptable to Noland Properties, this letter will serve as Notice to
remove all plumbing supplies and storage equipment, and completely vacate the subject property
by not later than Monday, December 31,2001.
