Dear Mr. SullaIman:
ThIS letter constItutes a Development Order pursuant to Section 4-206.D.6 of the Commumty
Development Code. On January 18, 2005, the Commumty Development Board revie~ed your request
for FleXIble Development approval to permit retaIl sales WIthin an eXIstmg two-story commercIal
bUIldmg with a reductIon to lot area from 10,000 square feet to 7,720 square feet, a reduction to lot wIdth
(west) from 100 feet to 50.81 feet, reductIOns to the front (north) setback from 25 feet to 19 feet (to
eXIstmg and proposed bUIlding) and from 25 feet to five feet (to proposed pavement), a reduction to the
front (west) setback from 25 feet to 15 feet (to proposed pavement) and reductIOns to the sIde (south)
setback from 10 feet to one-foot (to eXIsting and proposed bUIldmg) and from 10 feet to' zero feet (to
proposed pavement), as a ComprehensIve Infill Redevelopment Project, under the provisIOns of SectIon
2-704.C, and a reductIOn to the landscape buffer along the south property lme from five feet to zero feet
and a reductIOn in the WIdth of the reqUIred foundatIon landscapmg adjacent to the buildmg (west SIde)
from five feet to 3.75 feet, as part of a ComprehensIve Landscape Program, under the provlSlons of
SectIon 3-1202.G. The Commumty Development Board (CDB) APPROVED the application with the
followmg bases and condItions:
Bases for Approval:
1. The proposal complies WIth the FleXIble Development critena as a Comprehensive Infill
Redevelopment Project per Section 2-704.C.
2. The proposal IS m complIance with other standards in the Code includmg the General ApplicabIlity
Criteria per SectIOn 3-913.
3. The proposal is m complIance WIth the ComprehensIve Landscape Program critena per SectIon 3-
1202,G,
4. The development is compatIble WIth the surroundmg area and will enhance other redevelopment
efforts.

CondItIons of Approval:
1. That the applIcant apply for City buIlding permIts for after-the-fact mterior renovatIons, buIlding
addItIons and sIte Improvements by March 19,2005, FaIlure to submit for these permIts wIthin thIS
tIme frame shall cause thIS FlexIble Development approval by the CDB to be null and void and cause
enforcement actIon to be mitIated agam;
2. That use of the bUIldmg be for retaIl sales and servIces;
3, That the site and landscape plans be amended pnor to the Issuance of any building permits to show
the followmg:
a. as part of the SIte data, that a recorded shared parkmg agreement exists on the adjacent property
to the south for 11 parkmg spaces;
b. revised landscape plans addressing overall landscape reqUIrements, mcluding showmg the
canopy of the l4-mch oak tree to be preserved, irngatIon, viSIbilIty triangles and foundatIon
landscapmg, to the satisfactIon of the Planmng Department;
c. provide eXlstmg topography of the eleven parkmg spaces m order to provIde assurance that
project WIll not block off sIte flow nor will unaccounted surface waters contnbute to system;
d. delineate eXIsting and proposed dramage basins on constructIOn plans;
e. provide eVIdence of proper notIficatIOn to the original engineer m accordance with F.A,C.
6lG15-27.00l;
f. provIde erosion and sedIment discharge controls on plans;
4. That the final deSIgn of the buildmg be consistent WIth the conceptual elevatIOns submItted, or as
modified by the CDB;
5, That the SIte be lImited to one monument SIgn, at a maximum height of SIX feet, located outside of
visibilIty trIangles, containing the SIte address and be coordmated/conslstent with the color and
materials of the bUIldmg;
6, That the owner/applicant immedIately notIfy the CIty'S Planning Department in writing in the event
parking on the adjacent property to the south becomes unavaIlable for use by the subject property.
The owner/applicant of the subject property shall obtain required parlang on other property(ies)
acceptable to the Planmng Department through the recording of a shared parkmg agreement(s).
FaIlure to provide the required number of parkmg spaces for the subject property shall be a VIolation
of thIS approval and shall be subject to remedies available to the CIty, including the revocatIon of
occupational lIcensees);
7. That all appropnate permIts be obtained to upgrade parkmg on the parcel to the south and all work be
completed and inspected prior to the issuance of a CertIficate of Occupancy for thIS SIte;
8. That this site share the dumpster on the property to the east, through appropriate agreements with the
City and the abutting property owner. ThIS off-SIte dumpster shall be upgraded with appropriate
buildmg permIts and be properly located and screened to meet CIty reqUIrements pnor to the Issuance
of a Certificate of Occupancy for this SIte; and ,
9. That, pnor to the Issuance of a Certificate of Occupancy, Traffic Impact Fees be determined and
paId.
Pursuant to SectIon 4-407, an applicatIon for a building permIt shall be made wlthm the tIme frames set
forth above. All reqUIred certIficates of occupancy shall be obtained withm one year of the date of
Issuance of the bUIldmg permIt. TIme frames do not change WIth successive owners, The Commumty
Development Coordinator may grant an extenSIOn of tIme for a period not to exceed one year and only
wlthm the onginal period of valIdIty. The Commumty Development Board may approve one additional
extenSIon of tIme after the community development coordmator's extenSIOn to ImtIate a bUIlding permit
applIcatIon.

The issuance of thIS Development Order does not relieve you of the necessIty to obtam any bUIldmg
permIts or pay any impact fees that may be reqUIred. In order to faCIlItate the Issuance of any permIt or
lIcense affected by this approval, please brmg a copy of this letter WIth you when applying for any
permits or lIcenses that reqUIre thIS pnor development approval.
AddItionally, an appeal of a Level Two approval (FlexIble Development) may be Imtiated pursuant to
Section 4-502.B by the applIcant or by any person granted party status WIthin 14 days of the date of the
CDB meetmg. The filing of an applIcatIOn/notice of appeal shall stay the effect of the deCIsion pendmg
the final determmatIOn of the case. The appeal penod for your case expIres on February 1,2005 (14 days
from the date of the CDB meetmg).
