ThIS letter constttutes a Development Order pursuant to Section 4-206.D.6 of the Commumty
Development Code. On June 21, 2005, the Commumty Development Board revIewed your requests for
(1) Termmation of Status of NonconformIty for densIty (16 existing attached dwellmg umts; 16 attached
dwellmg units proposed), under the provIsIOns of Section 6-109; and (2) Flexible Development approval
to permit 16 attached dwellings with reductIOns to the front (south) setback from 15 feet to mne feet (to
pavement) and from 15 feet to three feet (to trash staging area), reducttons to the side (east) setback from
10 feet to 7.8 feet (to buildmg) and from 10 feet to five feet (to pavement), reductIOns to the SIde (west)
setback from 10 feet to 8.5 feet (to bUIldmg) and from 10 feet to 5.3 feet (to pavement), reductions to the
rear (north) setback from 20 feet to 10 feet (to bUIldmg) and from 20 feet to 11.4 feet (to pavement) and
an increase to bui1dmg height from 35 feet to 87.3 feet (to roof deck) wIth penmeter parapets of 5.67 feet
(from roof deck), under the provisions of Sectton 2-803.B, at 706 Bayway Boulevard. The Commumty
Development Board (CDB) DENIED the apphcation wIth the followmg bases:
Bases for Denial:
1, The proposal does not comply with the flexIble Development cntena for attached dwellings per
Section 2-803.B.
2. The proposal IS not m comphance WIth other standards m the Code mcludmg the General
ApplicabIhty Cnteria per Section 3-913,
3, The development IS not compattble with the surrounding area and WIll not enhance other
redevelopment efforts.
An appeal of a Level Two approval (FleXIble Development) may be mitiated pursuant to SectIOn 4-502.B
by the applicant or by any person granted party status wIthm 14 days of the date of thIS Development
Order. The filIng of an applicatton/nottce of appeal shall stay the effect of the deCIsion pendmg the final
determmatIOn of the case. The appeal period for your case expIres on November 30, 2004 (14 days from
the date of the CDB meetmg),

1. DURING CONsTRucnOt-l SEDIMENT IS TO REMAIN ON SITE, THE CONTRACTOR IS
RESPONSIBLE FOR ml:: INSTALLATION OF EROSION AND SEDIMENT CONTROL DEVICES
