RE: Development Order regarding case FLS2004-11 070 at 965 Bay Esplanade.
Dear Mr. Koelbel:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On December 30, 2004, the Development Review Committee (DRC) reviewed
your application for Flexible Standard Development for construction of a single-family residence, in
the Low Medium Density Residential district. The request is to reduce the front (west) setback from 25
feet to 10'-8", to reduce the rear, waterfront (east) setback to building from 25 feet to 16'-8", and to
reduce the rear, waterfront (east) setback to paved walk from 25 feet to zero feet" as a residential infill
project, per section 2-203.C. The DRC recommended approval of the appHcation with the following
bases and conditions:
Bases for Approval:
1. The proposal complies with Detached Dwellings criteria under the provisions of Section 2-203.C;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions of Approval:
1. That payment in lieu of a four foot concrete sidewalk required along Bay Esplanade (Community
Development Code Section 3-1701.) be paid prior to issuance of a building permit;
2. That the columns (only) of the fence proposed in the front setback should not exceed 48 inches in
height. Revise prior to issuance of a building permit; and
3. That the allowable ISR listed in the site data table be revised from 42.0% to 65.0% prior to
issuance of a building permit.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with the three above conditions. The approval is
based on and must adhere to the site plan and application dated received November 18,2004 and the
revised application dated received December 1, 2004 and site plans dated received January 28,2005.

Flexible Standard Developinent approval (January 3, 2006). All required certificates of occupancy
shall be obtained within on~ year of the date of issuance of the building permit. Time frames do not
