Dear Mr. Roush:
This letter constItutes a Development Order pursuant to SectIon 4-202.E. of the Commumty Development Code.
On May 5,2005, the Development Review Committee (DRC) reviewed your application for FleXIble Standard
Development approval to amend a previously approved Flexible Standard development application (FLS2002-
08062) to permit five (5) attached dwellings in the Medium DenSity ResIdential (MDR) zoning distrIct, per
Section 2-303.A. and Prelimmary Plat approval for five (5) residential lots, under the provisions of SectIOn 4-
702. The DRC recommended approval of the application as amended by Staff with the following bases and
conditions:
Bases for Approval:
1. Staff finds the proposal compliant with the Flexible Standard Development criteria as per Section 2-
303.A.1-3;
2. Staff finds the proposal complIant with the standards of the General ApplIcability Criteria as per Section 3-
913. 1 through 6; and
3. Staff finds the proposal compliant with the requirements for a preliminary plat under the provIsions of
Section 4-702.
Conditions of Approval:
1. That the final design and color of the building be conSIstent with the conceptual elevations submitted to (or
as modified by) Staff;
2. That a Transportation Impact Fee be paid, prior to the Issuance of a Certificate of Occupancy;
3. That all signage meet the reqUIrements of Code and be limited to attached signs on the canopies or attached
dIrectly to the budding and be architecturally-integrated with the design of the building with regard to
proportion, color, material and fimsh as part of a final sign package submitted to and approved by Staff pnor
to the issuance of any permits whIch includes:
a) All SIgnS fully dimensioned and coordinated in terms of including the same color and font style and
size; and
b) All signs be constructed of the highest quality materials which are coordinated with the colors,
matenals and architectural style of the bUIldmg;
4. That all proposed utilitIes (from the right-of-way to the proposed buildings) be placed underground and
mstallation of conduit(s) along the entIre length of the site's street frontage be completed prior to the
issuance of the first certificate of occupancy;

5. That Open Space, Recreation Land and Recreation Facility impact fees be satIsfied prior to the Issuance of
building peimits or final plat, whIchever occurs first;
6. That the fence details be subll11tted prior to issuance of a building penrut;
7. That black barrels and recyclmg containers be brought to the road by the residents,
8. That access to any gated area be provided to the Solid Waste Department and gated entries require Knox
entry system per Pinellas County Ordinance 98-4; and
9. That evidence of recording of the final plat is provided prior to issuance of a building permit.
I concur with. the findings of the Development Review Committee and, through this letter, approve your
application for Flexible Standard Development with above nine (9) conditions. The approval is based upon and
must adhere to the applicati'On dated received May 31, 2005 and the revised site plan dated received May 31 and
June 28, 2005.
Pursuant to Section 4-303, an application for a building permit shall be made within one (1) year of Flexible
Standard Development approval (by July 20, 2006), as applicable. All required certificates of occupancy shall
be obtained within one (1 j year of the date of issuance of the building permit. Please be advised that time
frames do not, change with successive owners. An extension of time may be granted by the Community
Development Coordinator for a period not to exceed one (1) year and only within the original period of validity.
The issuance of this Development Order does not relieve you of the necessity to obtain any building permits or
pay any impact fees that mi;ly be required. In order to facilitate the issuance of any permit or license affected by
this approval, please bring a copy of this letter with you when applying for any permits or licenses that require
this prior development approval.

FOR STORM WATER DISCHARGE FACILITY
1. ALL SODDED AREAS SHALL BE MOWED AND MAINTAINED PROPERLY.
2. UNDER NO CIRCUMSTANCES SHALL THE RETENTION AREA BE FILLED WITH ANY OTHER
SUBSTANCE THAN STORMWATER.
3. SWALE AREAS SHALL BE KEPT CLEAN AND FREE OF ANY OBSTRUCTIONS.
4. IF DAMAGE TO THE SYSTEM DOES OCCUR, THE SYSTEM SHALL BE RECONSTRUCTED
IN ACCORDANCE WITH THE APPROVED PLAN.
5. THE OWNER SHALL PERIODICALLY MONITOR THE STORMWATER SYSTEM (PIPE
CONVEYANCE SYSTEM AND RETENTION POND) FOR SILT AND SEDIMENTATION BUILD UP.
THE PIPE CONVEYANCE SYSTEM SHALL BE FLUSHED, AS DEEMED NECESSARY NO LESS
THAN TWICE A YEAR. ALL MATERIAL SHALL BE COLLECTED DOWNSTREAM AND
REMOVED. THE RETENTION POND SHALL BE KEPT MOWED AND FREE OF DEBRIS.
THE OWNER SHALL BE RESPONSIBLE TO MAKE SURE THAT TO THE BEST OF HIS
ABILllY NOTHING ENTERS THE SYSTEM BESIDES STORMWATER THAT COULD DETERIORATE
THE FUNCTIONING CAPABILITIES OF THE SYSTEM, E.G. GASOLINE, OIL, GREASE,
CHEMICALS, ETC.
EROSION AND SILTATION CONTROL NOTES
1. SEDIMENT TRAPPING MEASURES: SEDIMENT BASINS AND TRAPS, PERIMETER BERMS,
FILTER FENCES, BERMS, SEDIMENT BARRIERS, VEGETATIVE BUFFERS AND OTHER
MEASURES INTENDED TO TRAP SEDIMENT AND/OR PREVENT THE TRANSPORT OF
SEDIMENT ONTO ADJACENT PROPERTIES, OR INTO EXISTING WATER BODIES, MUST BE
INSTALLED, CONSTRUCTED OR, IN THE CASE OF VEGETATIVE BUFFERS, PROTECTED
FROM DISTURBANCE, AS A FIRST STEP IN THE lAND ALTERATION PROCESS. SUCH
SYSTEMS SHALL BE FULLY OPERATIVE AND INSPECTED BY THE ENGINEER BEFORE
ANY OTHER DISTURBANCE OF THE SITE BEGINS.
2. PROTECTION OF EXISTING STORM SEWER SYSTEMS: DURING CONSTRUCTION, ALL
STORM SEWER INLETS IN THE VICINllY OF THE PROJECT SHALL BE PROTECTED BY
SEDIMENT TRAPS SUCH AS SECURED HAY BALES, SOD, STONE, ETC., WHICH SHALL BE
MAINTAINED AND MODIFIED AS REQUIRED BY CONSTRUCTION PROGRESS, AND WHICH
MUST BE APPROVED BY THE ENGINEER BEFORE INSTALLATION.
3. SEDIMENTATION BASIN: THE CONTRACTOR WILL BE REQUIRED TO PROHIBIT DISCHARGE
OF SILT THROUGH THE OUTFALL STRUCTURE DURING CONSTRUCTION OF ANY RETENTION
AREA AND WILL BE REQUIRED TO CLEAN OUT THE RETENTION AREA BEFORE INSTALLING
AN~ PERMANENT SUBDRAIN PIPE. IN ADDITION, PERMANENT RETENTION AREAS MUST
BE TOTALLY CLEANED OUT AND OPERATE PROPERLY AT FINAL INSPECTION AND AT
THE END OF THE WARRANlY PERIOD.
4. SWAlES, DITCHES AND CHANNELS: ALL SWALES, DITCHES AND CHANNELS LEADING
FROM THE SITE SHALL BE SODDED WITHIN (3) DAYS OF EXCAVATION. ALL OTHER
INTERIOR SWALES, ETC., INCLUDING DETENTION AREAS WILL BE SODDED PRIOR TO
ISSUANCE OF A CERTIFICATE OF OCCUPANCY.
5. PROTECTION AND STABILIZATION OF SOIL STOCKPILES: FlLL MATERIAL STOCKPILES
SHAlL BE PROTECTED AT ALL TIMES BY ON-SITE DRAINAGE CONTROLS WHICH
PREVENT EROSION OF THE STOCKPILED MATERiAl. CONTROL OF DUST FROM SUCH
STOCKPILED MATERIAL, MAY BE REQUIRED, DEPENDING UPON THEIR LOCATION AND THE
EXPECTED LENGTH OF TIME THE STOCKPILES WILL BE PRESENT. IN NO CASE SHALL
UNSTABILlZED STOCKPILE REMAIN AFTER TEN (10) CALENDAR DAYS.
6. MAINTENANCE: AlL EROSION AND SILTATION CONTROL DEVICES SHALL BE CHECKED
REGULARLY, ESPECIALLY AFTER EACH RAINFALL AND SHALL BE CLEANED OUT

WATER SYSTEM TESTING AND INSPECTION
REQUIREMENTS
1. ALL COMPONENTS OF THE WATER SYSTEM. INCLUDING FITTINGS, HYDRANTS,
CONNECTION, AND VALVES SHALL REMAIN UNCOVERED UNTIL PROPERLY PRESSURE
TESTED AND ACCEPTED BY THE OWNER'S ENGINEER. PRESSURE TESTS TO BE IN
ACCORDANCE WITH WATER DEPARTMENT SPECIFICATIONS. CONTRACTOR TO NOTIFY
OWNER'S ENGINEER AND WATER DEPARTMENT INSPECTORS 48 HOURS IN ADVANCE OF
PERFORMING TESTS.
WATER/SEWER CLEARANCE
REQUIREMENTS
VERTICAL CLEARANCE AT CROSSINGS:
GRAVllY SEWERS OR FORCE MAINS CROSSING UNDER WATER MAINS SHALL BE lJo.lD TO
A MINIMUM VERTICAL DISTANCE OF 18 INCHES BETWEEN THE INVERT OF THE UPPER PIPE
AND THE CROWN OF THE LOWER PIPE. THE CROSSING SHALL BE ARRANGED SO THAT
THE SEWER JOINTS AND WATER JOINTS WILL BE EQUIDISTANT mOM THE POINT OF CROSSING
WITH NO LESS THAN 10 FEET BETWEEN ANY TWO JOINTS. WHERE THE MINIMUM 18 INCH
SEPARATION CANNOT BE MAINTAINED, A SECTION OF DUCTILE IRON PIPE SHALL BE PLACED
CENTERED ON THE POINT OF CROSSING FOR A MINIMUM OF 10 FEET ON EITHER SIDE OF

SPECIFICATIONS. LAND DEVELOPMENT, ZONING AND/OR RELATED ORDINANCES.

3. LOCATIONS, ELEVATIONS, AND DIMENSIONS OF EXISTING UTILITIES, STRUCTURES,
AND OTHER FEATURES ARE SHOWN ACCORDING TO THE BEST INFORMATION AVAllJo.BLE
AT THE TIME OF PREPARATION OF THESE PlANS. THE CONTRACTOR SHALL VERIFY

START OF CONSTRUCTION THE CONTRACTOR IS RESPONSIBLE FOR CONTACTING ALL
UTILITIES NOT INCLUDED IN THE "SUNSHINE- PROGRAM.
6. CONTRACTOR IS SOLELY RESPONSIBLE FOR CONSTRUCTION SAFETY.
SPECIAL PRECAUTIONS MAY BE REQUIRED IN THE VICINllY OF

7. ALL UNDERGROUND UTILITIES MUST BE IN PLACE AND TESTED AND INSPECTED PRIOR

FAILURE TO OBTAIN APPROVAL BEFORE INSTALLATION MAY RESULT IN REMOVAL AND
REPLACEMENT AT THE CONTRACTOR'S EXPENSE. ALL SHOP DRAWINGS ARE TO BE
REVIEWED AND APPROVED BY THE CONTRACTOR PRIOR TO SUBMITTAL TO THE
OWNER'S ENGINEER.
10. AT LEAST THREE (3) WORKING DAYS PRIOR TO CONSTRUCTION, THE CONTRACTOR
SHALL NOTIFY THE ENGINEER AND APPROPRIATE AGENCIES, AND SUPPLY THEM WITH

11. SITE WORK CONCRETE SHALL HAVE A COMP.RESSIVE STRENGTH OF AT LEAST 3,400

12. AL.L PRIVATE AND PUBLIC PROPERTY AFFECTED BY THE WORK SHALL BE RESTORED
TO A CONDITION EQUAL TO OR BETTER THAN EXISTING CONDITIONS UNLESS
