~ This letter constitutes a Development Order pursuant to Section 4-202.E of the CommunitYJ
Development Code. On November 12, 2004, the Development Review Committee (DRC) reviewed
your application for Preliminary Plat approval to create eight new residential lots and one common area
lot (PLT2004-00014) and Flexible Standard Development (FLS2004-09064) to construct eight new
detached dwelling units, in the LMDR zoning district, per Sections 2-203.C (Residential Infill Project)
and 4-703.A. The request includes:
Lot 1: Front (west) Setback from 25.0 feet to 12.7 feet to building
Increase in building height from 25 feet to 35 feet measured from the mean average of existing
grade to the flat rooftop.

The DRC recommended approval ofthe application with the following bases and conditions:
Bases for Approval:
1. The proposal complies with Residential Infill Criteria under the provisions of Section 2-203.C;
2. The plan complies with General Applicability Critena under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions for Approval:
1. That Final plat application and plat be submitted to the Engineering Department. Plat must be
approved by City Council prior to recording with Pinellas County.
2. That Final plat is recorded with Pinellas County prior to the issuance of a building permit.
3. That any future additions to lots 1 through 8 comply with a 0.65 Impervious Surface Ratio (ISR).
4. That prior to issuance of a building permit, plans will indicate how entrance gates will be operated
i.e. gate console;
5. That prior to issuance of a building permit, provide a double ring infiltrometer test at the retention
pond demonstrating a 24 hour recovery time;
6. That prior to issuance of a building permit, plans will indicate the garage floor elevations for all the
homes and show that in a 100yr. storm that they will not flood;
7. That prior to issuance of a building permit, provide a Tree Preservation Plan prepared by a certified
arborist, consulting arborist, landscape architect or other specialist in the field of arboriculture; and
8. That all Fire Department Code requirements be met prior to the issuance of any permits.

I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with the above eight conditions. The approval is
based on and must adhere to the site plan and application received October 8, 2004, revised building
elevations dated received January 27,2005 and the revised site plan dated received May 6,2005.
Pursuant to Section 4-303, an application for a building permit shall be made withm one year of
Flexible Standard Development approval (May 16, 2006). All required certificates of occupancy shall
with successive owners.
The issuance of this Development Order does not relieve you of the necessity to obtain any building
permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or
license affected by this approval, please bring a copy of this letter with you when applying for any
permits or licenses that require this prior development approval.
Pursuant to Section 4-502.A, an appeal may be initiated within seven days of the date the Development
Order is issued by an applicant or property owners within the required notice area and who presented
competent substantial evidence in the Level One review. A copy of the Development Order is being
sent to those surrounding property owners who presented competent substantial evidence in the Level
One review. The filing of an application/notice of appeal shall stay the effect of the decision pending
the final determination of the case. The appeal period for your case will expire on May 23, 2005,
(seven days from date of Development Order).

CLEARING AND SITE PREPARATION NOTES
WATER SYSTEM NOTES
1. ALL ELEVATIONS REFER TO THE NAVD (1988),
2. LOCATIONS, ELEVATIONS, AND DIMENSIONS OF EXISTING UTILITIES, STRUCTURES, AND
OTHER FEATURES ARE SHOWN ACCORDING TO THE BEST INFORMATION AVAILABLE AT THE
TIME OF PREPARATION OF THESE PLANS. THE CONTRACTOR SHALL VERIFY THE LOCATIONS,
ELEVATIONS, AND DIMENSIONS OF ALL EXISTING UTILITIES, STRUCTURES AND OTHER
FEATURES AFFECTING THIS WORK PRIOR TO CONSTRUCTION.
1. PRIOR TO ANY SITE CLEARING, ALL TREES SHOWN TO REMAIN ON THE CONSTRUCTION
PLANS SHALL BE PROTECTED IN ACCORDANCE WITH THE LOCAL REGULATORY AGENCY'S
TREE ORDINANCE. IT IS THE CONTRACTOR'S RESPONSIBILITY TO MAINTAIN THESE TREES
IN GOOD CONDITION. NO TREES SHOWN TO REMAIN SHALL BE REMOVED WITHOUT WRITTEN
APPROVAL FROM THE OWNER, ONLY "GRADING BY HAND" IS PERMITTED WITHIN THE CANOPY
LINE OF TREES THAT ARE TO REMAIN.
1. A VERTICAL CLEARANCE OF 18 INCHES SHALL BE MAINTAINED BETWEEN SANITARY SEWERS
AND WATER MAINS. IF CLEARANCE CANNOT BE ACHIEVED BY ADJUSTING WATER MAINS
THE SANITARY SEWER SHALL BE CONSTRUCTED OF DUCTILE IRON CLASS 54 A MINIMUM
OF 10 FEET ON BOTH SIDES OF THE CONFLICT POINT. AS AN ALTERNATIVE THE
SANITARY SEWER MAY BE PLACED IN A SLEEVE OR ENCASED IN CONCRETE FOR THE
REQUIRED 10 FEET ON EACH SIDE OF THE CONFLICT POINT,
3. THE CONTRACTOR SHALL CHECK PLANS FOR CONFLICTS AND DISCREPANCIES PRIOR TO
CONSTRUCTION. THE CONTRACTOR SHALL NOTIFY THE OWNER'S ENGINEER OF ANY
CONFLICT BEFORE PERFORMING ANY WORK IN THE AFFECTED AREA.
2. THE CONTRACTOR IS TO PREPARE THE SITE PRIOR TO BEGINNING ACTUAL CONSTRUCTION
IN ACCORDANCE WITH THE SOILS TESTING REPORT. COPIES OF THE SOILS REPORT ARE
AVAILABLE THROUGH THE OWNER OR THE SOILS TESTING COMPANY, QUESTIONS
REGARDING SITE PREPARATION REQUIREMENTS DESCRIBED IN THE SOILS REPORT ARE TO

2. A HORIZONTAL SEPARATION OF 10 FEET SHALL BE MAINTAINED BETWEEN WATER MAINS
AND SANITARY SEWER.
3. ALL WATER MAINS SHALL HAVE A MINIMUM OF 30 INCHES AND A MAXIMUM OF
42" BELOW FINISHED GRADE,
4. ALL WATER SYSTEM WORK SHALL CONFORM WITH LOCAL REGULATORY STANDARDS AND
SPECIFICATIONS.
4. THE CONTRACTOR SHALL EXERCISE EXTREME CAUTION IN AREAS OF BURIED UTILITIES AND
SHALL PROVIDE AT LEAST 48 HOURS NOTICE TO THE VARIOUS UTILITY COMPANIES IN
ORDER TO PERMIT MARKING THE LOCATIONS OF EXISTING UNDERGROUND UTILITIES IN
ADVANCE OF CONSTRUCTION, BY CALLING FLORIDA SUNSHINE STATE ONE CALL CENTER
OF FLORIDA, INC. AT 1-800-432-4770,
5. THE CONTRACTOR IS RESPONSIBLE FOR REPAIRING ANY DAMAGE TO EXISTING FACILITIES,
ABOVE OR BELOW GROUND, THAT MAY OCCUR AS A RESULT OF THE WORK PERFORMED
BY THE CONTRACTOR.
3. CONTRACTOR SHALL CLEAR AND GRUB ONLY THOSE PORTIONS OF THE SITE NECESSARY
FOR CONSTRUCTION. DISTURBED AREAS WILL BE SEEDED, MULCHED, OR PLANTED WITH
OTHER APPROVED LANDSCAPE MATERIAL IMMEDIATELY FOLLOWING CONSTRUCTION.
4. THE TOP 4" TO 6" OF GROUND REMOVED DURING CLEARING AND GRUBBING SHALL BE
STOCKPILED AT A SITE DESIGNATED BY THE OWNER TO BE USED FOR LANDSCAPING
PURPOSES, UNLESS OTHERWISE DIRECTED BY THE OWNER.
5. CONFLICTS BETWEEN WATER AND STORM OR SANITARY SEWER TO BE RESOLVED BY
ADJUSTING THE WATER LINES AS NECESSARY.
6. CONTRACTOR TO INSTALL TEMPORARY BLOW-OFFS AT THE END OF WATER SERVICE
LATERALS TO ASSURE ADEQUATE FLUSHING AND DISINFECTION.
7. RESTRAINING JOINTS SHALL BE PROVIDED AT ALL FITTINGS AND HYDRANTS AS SHOWN ON

6. ALL UNDERGROUND UTILITIES MUST BE IN PLACE AND TESTED OR INSPECTED PRIOR TO

SERVICE MAIN EXTENSIONS AND CONNECTIONS MUST BE COORDINATED THROUGH THE
LOCAL REGULATORY AGENCY DEPARTMENT OF PUBLIC UTILITIES.
9. ALL UNDERGROUND PVC SHALL BE DR14 (C-900).
8. ALL SPECIFICATIONS AND DOCUMENTS REFERRED TO SHALL BE OF LATEST REVISIONS

BE IN ACCORDANCE WITH WATER DEPARTMENT SPECIFICATIONS. CONTRACTOR TO
NOTIFY OWNER'S ENGINEER AND COUNTY INSPECTORS 48 HOURS IN ADVANCE OF
PERFORMING TESTS,
10. CONTRACTOR SHALL SUBMIT FOR APPROVAL TO THE OWNER'S ENGINEER SHOP
DRAWINGS ON ALL PRECAST AND MANUFACTURED ITEMS. FAILURE TO OBTAIN
APPROVAL BEFORE INSTALLATION MAY RESULT IN REMOVAL AND REPLACEMENT AT

12. WORK PERFORMED UNDER THIS CONTRACT SHALL INTERFACE SMOOTHLY WITH OTHER
WORK BEING PERFORMED ON SITE BY OTHER CONTRACTORS AND UTILITY COMPANIES. IT
WILL BE NECESSARY FOR THE CONTRACTOR TO COORDINATE AND SCHEDULE HIS
ACTIVITIES, WHERE NECESSARY WITH OTHER CONTRACTOR AND UTILITY COMPANIES.
PAVING AND GRADING NOTES
13. ALL DISTURBED AREAS WITHIN PUBLIC RIGHT-OF-WAY ARE TO BE RESTORED TO ORIGINAL
CONDITION OR BETTER.
1. THE CONTRACTOR SHALL BE RESPONSIBLE FOR PROTECTING EXCAVATIONS AGAINST
COLLAPSE AND WILL PROVIDE BRACING SHEETING OR SHORING AS NECESSARY,
TRENCHES SHALL BE KEPT DRY WHILE PIPE AND APPURTENANCES ARE BEING PLACED.
DEWATERING SHALL BE USED AS REQUIRED.
SANITARY SEWER NOTES
14. REPAIR AND REPLACEMENT OF ALL PRIVATE AND PUBLIC PROPERTY AFFECTED BY THIS
WORK SHALL BE RESTORED TO A CONDITION EQUAL TO OR BETTER THAN EXISTING
CONDITIONS BEFORE COMMENCING CONSTRUCTION WORK UNLESS SPECIFICALLY
EXEMPTED BY THE PLANS. ADDITIONAL COSTS ARE INCIDENTAL TO OTHER CONSTRUCTION
AND NO EXTRA COMPENSATION IS TO BE ALLOWED.
2. CONTRACTOR IS RESPONSIBLE FOR OBTAINING THE NECESSARY DEWATERING PERMITS FROM
THE LOCAL WATER MANAGEMENT DISTRICT OR OTHER REGULATORY AGENCY.
1. A HORIZONTAL SEPARATION OF 10 FEET SHALL BE MAINTAINED BETWEEN WATER MAINS AND
SANITARY SEWER.
2. ALL SANITARY SEWER WORK SHALL CONFORM WITH LOCAL REGULATORY STANDARDS AND

15. ALL DISTURBED AREAS WHICH ARE NOT TO BE SODDED ARE TO BE SEEDED AND MULCHED
TO FOOT STANDARDS AND MAINTAINED UNTIL A SATISFACTORY STAND OF GRASS
ACCEPTABLE TO THE REGULATORY AGENCY AND ENGINEER OF RECORD HAVE BEEN
OBTAINED. ANY WASHOUTS, REGRADING, RESEEDING, AND GRASSING WORK, AND OTHER
EROSION WORK REQUIRED, WILL BE PERFORMED BY THE CONTRACTOR/SUBCONTRACTOR

3. PROPOSED SPOT ELEVATIONS REPRESENT FINISHED PAVEMENT OR GROUND SURFACE

.3. SANITARY SEWER MAINS AND LATERALS SHALL HAVE A MINIMUM COVER OF THREE (3) FEET

COLORED GREEN AND LAID ONE FOOT ABOVE THE PIPE.
5, CONTRACTOR TO PROVIDE A 1/2" BITUMINOUS EXPANSION JOINT MATERIAL WITH SEALER
AT ABUTMENT OF CONCRETE AND ANY STRUCTURE.
16. CHAPTER 77-15.3 OF THE FLORIDA STATUTES REQUIRES THAT AN EXCAVATOR NOTIFY ALL
GAS UTILITIES A MINIMUM OF TWO WORKING DAYS PRIOR TO EXCAVATING. MAPS SHOW
ONLY THE APPROXIMATE LOCATION OF GAS MAINS AND DO NOT SHOW SERVICE LINES, THE
ONLY SAFE AND PROPER WAY TO LOCATE EITHER MAINS OR SERVICE LINES IS BY AN ON-
SITE INSPECTION BY THE RESPECTIVE GAS PERSONNEL. THEREFORE, EXCAVATORS ARE
INSTRUCTED TO TELEPHONE THE RESPECTIVE GAS COMPANY TWO WORKING DAYS
BEFORE' ENTERING A CONSTRUCTION AREA.
6. ALL PAVEMENT MARKINGS SHALL CONFORM TO FOOT STANDARD INDEX NO. 17346,
SHEETS 1-7.
7. CONTRACTOR SHALL TRIM, TACK, AND MATCH EXISTING PAVEMENT AT LOCATIONS WHERE
NEW PAVEMENT MEETS EXISTING PAVEMENT.
8. CONTRACTOR IS TO PROVIDE EROSION CONTROL/SEDIMENTATION BARRIER (HAY BALES
OR SILTATION CURTAIN) TO PREVENT SILTATION OF ADJACENT PROPERTY, STREETS,
AND STORM SEWERS. IN ADDITION, CONTRACTOR SHALL PLACE STRAW, MULCH, OR OTHER
SUITABLE MATERIAL ON GROUND IN AREAS WHERE CONSTRUCTION RELATED TRAFFIC IS
TO ENTER AND EXIT THE SITE. IF, IN THE OPINION OF THE ENGINEER AND/OR LOCAL
AUTHORITIES, EXCESSIVE QUANTITIES OF EARTH ARE TRANSPORTED OFF-SITE EITHER

INFORMATION ON A SET OF THE APPROVED PLANS CONCURRENTLY WITH CONSTRUCTION
PROGRESS. WITHIN TWO (2) WEEKS FOLLOWING FINAL INSPECTION THE CONTRACTOR
SHALL SUBMIT ONE (1) SET OF RECORD DRAWINGS TO THE ENGINEER. THE
FINAL RECORD DRAWINGS SHALL COMPLY WITH THE FOLLOWING REQUIREMENTS:

Concrete Pavers to conform to ASTM C9.36-S2,
Course Granular Bose shall be in accordance with manufactures requirements (4" min. for 2 .3/8" pavers
and S" min. for .3 1/8" pavers), Granular base shall be crushed concrete or other material approved by City Engineer,
Coloring or dye sh all be uniform throughout each concrete paver unit. Dipped or externally colored paver units are unacceptable,
Pavers shall be installed with edge restraint and confined with cemented paver units, curbs, poured concrete or other suitable method.
Final finished surface shall be of uniform elevation or slope.
Subgrade shall be free of clay, organics, or other materials which will allow future settlement and compacted to 9S% AASHTO T -180-57.

1. The Landscape Contractor shall grade planting beds, as required, to provide positive drainage and promote optimum
plant growth,
2. All recommended trees and plant materials will be graded as Nursery Grade No, 1 or better as outlined by the Florida
Department of Agriculture and Consumer Services, Division of Plant Industry "Grades and Standards for Nursery Plants",
7th Edition, 1998 as revised from time to time.
3. All planting shall be done in accordance with the Florida Nurserymen's and Grower's Associations approved practices.
4. All plants shall be fertilized with Agriform 20-10-5 tablets as per the manufacturers specifications in conjunction with
note # 5.
5. The planting soul shall be the approximate proportions as follows: 50% sand and 50% organic material consisting of
native peat, well-decomposed sawdust, leaf mold and top soil. It shall provide a good pliable and thoroughly mixed
medium with adequate aeration, drainage and water-holding capacity. It shall also be free of all extraneous debris,
such as roots, stones, weeds, etc.
6. All planting areas shall receive a 3" layer of cypress mulch, which is to be watered-in after installation,
7. The plant material schedule is presented for the convenience of the Landscape Contractor. In the event of a discrepancy
between the plan and the plant key, the plan shall prevail.
8. Plants shall meet size, container, and spacing specifications_ Any material not meeting specifications shall be removed
and replaced at the contractor's expense.
9. The Landscape Contractor shall be responsible for examining fully both the site and the bid documents. Discrepancies
in the documents or the actual site conditions shall be reported to the Landscape Architect
in writing at the time of bidding or discovery. No account shall be made after contract completion for failure to report
such condition, or for errors on the part of the Landscape Contractor at the time of bidding.

13. There shall be no additions, deletions or substitutions without the written approval of the owner.
14, The Landscape Contractor shall guarantee, in writing, plant survivability for a period of twelve (12) months from final
acceptance by the owner.
15. All dimensions to be field-checked by the Landscape Contractor prior to landscape material installation. Discrepancies shall
be reported immediately to the owner.
16, All materials must be as specified on the landscape plan. If materials or labor do not adhere to specifications, they will
be rejected by the City Project Manager with proper installation carried out by Landscape Contractor at no additional cost.
17. All permits necessary are to be provided by the installing contractor unless otherwise specifically stated in the specifications
18. No contractor identification signs shall be permitted on the project, except for the project information signs.
19, Existing sod shall be removed as necessalY to accomodate new plantings.

Any existing areas that are disturbed during the landscape installation shall be resodded with St. Augustine
"Floritam".

The Landscape Contractor will be responsible for the collection, removal, and proper disposal of any and all debris
generated during the installation of this project.

All areas disturbed within right of way shall be sodded.

Required internal trees will be planted at time of indivual house construction.
IRRIGATION NOTES
1. A low volume irrigation system, that provides 100% coverage to all proposed
plantings, will be designed and installed by the Contractor.
2. The proposed Irrigation System must meet or exceed all applicable City code
requirements. (i.e., Back Flow Prevention, Automatic Rain Shutoff Device, etc...)
3. Irrigation system must be inspected and accepted by Landscape Architect
prior to installation of mulch. Irrigation must meet city code section 3-1203.C
to provide 100% coverage, and include a rain sensor and timer,
4. Irrigation as-built drawings, which accurately and clearly identify all modifications
&/or substitutions, must be submitted prior to final inspection and acceptance.
5. The Landscape Contractor must coordinate the placement and power supply for the
irrigation control timer with the General Contractor.

GENERAL LANDSCAPE NOTES
1. The Landscape Contractor shall grade planting beds, as required, to provide positive drainage and promote optimum
plant growth.
2, All recommended trees and plant materials will be graded as Nursery Grade No, 1 or better as outlined by the Florida
Department of Agriculture and Consumer Services, Division of Plant Industry "Grades and Standards for Nursery Plants".

3. All planting shall be done in accordance with the Florida Nurserymen's and Grower's Associations approved practices.
4. All plants shall be fertilized with Agriform 20-10-5 tablets as per the manufacturers specifications in conjunction with
note # 5.
5, The planting soil shall be the approximate proportions as follows: 50% sand and 50% organic material consisting of
native peat. well-decomposed sawdust, leaf mold and top soil. It shall provide a good pliable and thoroughly mixed
medium with adequate aeration, drainage and water-holding capacity, It shall also be free of all extraneous debris,
such as roots, stones, weeds, etc.
6. All planting areas shall receive a 3" layer of cypress mulch, which is to be watered-in after installation.
7. The plant material schedule is presented for the convenience of the Landscape Contractor, In the event of a discrepancy
between the plan and the plant key, the plan shall prevail.
8, Plants shall meet size, container, and spacing specifications. Any material not meeting specifications shall be removed
and replaced at the contractor's expense,
