RE: Development Order regarding case FLS2004-07050 at 1822 Montclair Road.
Dear Mr. Beau:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Deve10pme!lt Code. On September 9, 2004, the Development Review Committee (DRC) reviewed
your application for Flexible Standard Development application for attached dwellings. The request
includes the construction of five new town homes, per Section 2-303.A. and preliminary plat approval.
The DRC recommended approval ofthe application with the following bases and conditions:
Bases for Approval:
1. The proposal complies with Detached Dwellings criteria under the provisions of Section 2-303.A;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions of Approval:
1. That a copy of the agreement with Florida Power regarding the pond located in rear easement may
remain, be provided prior to building permit;
2. That the curbing be remove and area filled in where the two drives are next to one another;
3. That a final plat be recorded with Pinellas County prior to issuance of building permit:
4. That the final design ofthe building be consistent with the conceptual elevations submitted or as
modified by the DRC; and
5. That a $200 Recreation Facilities impact fee is due prior to building permit issuance for each new
residential unit on vacant property.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with the four above conditions. The approval is
based on and must adhere to the site plan and application dated received July 29,2004 and the revised
site plans dated received March 28,2005.
