Dear Mr, Fowler:
ThIS letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community
Development Code. On December 14,2004, the Commumty Development Board reviewed your request
for FlexIble Development approval to construct an awnmg over an existmg sidewalk cafe at an eXIstmg
restaurant WIth a reduction to the front (north) setback from 15 feet to zero feet and a reductIOn to the
SIde (west) setback from 10 feet to four feet, under the provIsIOns of SectIOn 2-803.J. The Community
Development Board (CDB) APPROVED the applIcation WIth the following bases and condItions:
Bases for Approval:
1. The proposal complIes with the Flexible Development cntena for restaurants per SectIOn 2-803.J.
2. The proposal IS m complIance with other standards m the Code, includmg the General ApplicabIlity
Cnteria per Section 3-913.
3. The proposal IS m complIance WIth Beach by Design.
CondItIOns of Approval:
1, That the color of the awnmg be consIstent WIth that approved, or modIfied by, the CDB; and
2, That all requirements of the FIre Department be met prior to the issuance of any permits.
Pursuant to Section 4-407, an applIcatIOn for a bUIldmg permIt shall be made wIthm one year of FlexIble
Development approval (December 14, 2005). All reqUIred certificates of occupancy shall be obtamed
wIthm one year of the date of issuance of the building permit. TIme frames do not change WIth
succeSSIve owners. The Community Development Coordmator may grant an extensIOn of time for a
penod not to exceed one year and only wIthm the ongmal penod of valIdity. The Commumty
Development Board may approve one addItIOnal extensIOn of time after the commumty development
coordmator's extensIOn to mItiate a bUIlding permIt applIcatIOn.
The Issuance of thIS Development Order does not relIeve you of the necessity to obtain any bUIldmg
permIts or pay any Impact fees that may be reqUIred, In order to facilitate the issuance of any permIt or
lIcense affected by this approval, please bnng a copy of thIS letter WIth you when applying for any
permIts or lIcenses that reqUIre thIS pnor development approval.
