We have evaluated your application for a Binding Letter
dated October 26, 1984, and received October 26, 1984. Based on
the information contained in the application and other informa-
tion obtained during the review of the development proposal, we
enter the following Findings of Fact, Conclusions of Law, and
Order.
In 1980, five additional buildings were constructed. These
buildings encompass 156,000 square feet of gross floor area of
office development which are not vested because they were ap-
proved and built after July 1, 1973. The applicant proposes to
construct two additional office structures consisting of l2Q,000
square feet of gross floor area. Estimated date of buildout
is 1986. -

2. The Arbor Shoreline Office Center is located on approxi-
mately 26 acres along the east side of U.S. 19 in the City of
Clearwater, pinellas County. Old Tampa Bay borders the property
to the east. The property lies within Section 20, Township 29
South, Range 16 East, Pinellas County, Florida. Hillsborough
County, the nearest adjacent county, is approximately 12 miles to
the east of the site.
3. The applicant is Robert S. Schumaker, authorized repre-
sentative for Justice Office Center, Inc., which proposes to
develop Arbor Shoreline Office Center. -
, . 4. "The applicable presumptive Development of Regional
~-,Impact ,(DRI) guideline for the project is Rule 27F-2.07, Office
Parks, Florida Administrative Code (F.A.C). Rule 27F-2.07,
Office Parks, F.A.C., provides that any proposed office park
operated under one common property ownership or management that
occupies more than 300,000 square feet of gross floor area or 30
acres is presumed to be a DRI. The development to be evaluated
in this binding letter in terms of its impacts, consisting of
276,000 square feet of gross floor area on 26 acres, does not
exceed the presumptive threshold for office development. There-
fore, the project is not presumed to be a DRI.
5. The Department has reviewed the representations made by
the applicant and has considered relevant comments by the review-
ing agencies. The Department finds that the only regional issues
identified during the review of the binding letter application
are surface drainage and water quality and transportation.
A. Surface Drainage gnd Water Ouality
The project site is located on the shore of Old
Tampa Bay. Since this Bay has been designated as Class
II waters, the Department finds that it is a regionally
significant water body.
The applicant states that all runoff from the
Phase II portion of the project will be collected in an
existing retention pond located in the south central ,area
of Phase I. Outflow from the retention pond is via an
eight-inch underdrain line, which connects to an exis-
ting ditch along the south property line. The drainage
system is designed for a 25-year 24-hour storm event.
This system design allows for runoff from phase II to
percolate through a grassy area prior to discharging
into Old Tampa Bay. The proposed drainage system allows
for an effective degree of treatment prior to discharge
from the project site.

All of the drainage for phase II of the project
will be incorporated into the existing drainage system
established for phase I, which has been a~proved by the
Florida Department of Environmental Regulation (FDER)
and Pinel1as-County. The original drainage system had
been designed to handle the additional runoff to be
generated by the proposed development. The FDER and the
Southwest Florida Water Management District both responded
to a request for comments by the Department on the
proposed development. Neither expressed concern that
the proposed development would significantly impact any
regional resources.
The Department finds that no evidence has been sub-
mitted to show that stormwater runoff from the proposed
project will have a substantial impact upon Old Tampa
Bay, a regionally significant ~ater body.
B. 1ransoortation
Direct access to the site is provided by UcS. 19,
a regionally significant roadway. The other regionally
significant roadway to be impacted by project traffic is
SeRo 60 (Gulf~to=Bay Boulevard), which becomes the
Courtney Campbell Causeway over Tampa Bay. The Depart-
ment considers these roads to be regionally significant
because they are federal or state roads and cross county
lines. S.R. 60 is also a major hurricane evacuation route,
.
The applicant's traffic analysis estimated the
number of trips to be generated by the development using
trip generation rates presented in the Institute of
Transportation Engineers' (ITE) publication, Trip Genera-
~ion, -~hir~,~dition. _ The, rate used in this analysis was
for gene~~~~office projects of 200,000 or more square
feet. The applicant did an analysis for both average
daily traffic and P.M. peak hour traffic.
',_ 'J.'~ip _,distribution was "based on a zip code survey
.,conducted upon the pres~nt ~mployees at the Arbor Shore-
line Office Center. After locating employees by general
sector-of residence, t~ips were distributed on the adja-
cent road 'network. Future trips for the 120,000 square
feet__of 9~_fice yet to be completed were distributed on a
percentage basis using the findings of the zip code sur-
vf}Y., - ----
,All trips generated by the development will exit
directly onto u.s. 19. Presently, there is only one
access point at which traffic can enter and exit the

project site. In the application, a second access point
is shown at Barn Boulevard, which would be used by all
traffic exiting south from the existing project
entrance. This access road does not currently exist, but
is proposed to tie in with a roadway located in Bay Cove
Apartments situated directly south of'Arbor Shoreline.
The Department has questioned the city of Clearwater as
to the applicability of this as-yet-unconstructed access
/ road. The City has indicated, in a letter to the Depart-
) ment, that issuance of any Certificate of Occupancy is
dependent upon there being the second access point for
traffic turning south or using Barn Boulevard. This
will eliminate any southbound turning movements from the
/ present Arbor Shoreline entrance. Therefore, the
I Department recognizes that the access drive must be
! . constructed prior to occupancy of the additional office
\ ~evelopment and will consider it in this traffic
~ analysis. .
The applicant distributed 52% of the trips to the
north on u.s. 19, with 42% distributed to the south on
u.S. 19 (the remaining 6% were distributed westward onto
Barn Boulevard). As mentioned above, the Department
finds that u.s. 19 and Gulf-to-Bay Boulevard (S.R. 60)
are the regionally significant roadways to be impacted
by this development.
Background traffic was projected for buildout year
1986. This was done by taking 1983 pinellas County
counts and applying an annual growth rate of 3.5%.
Capacities of regionally significant roadways were
derived from generalized capacity figures provided by
the Florida Department of Transportatio~ (FDOT).
The applicant contends that u.s. 19 north of Barn
Boulevard operates at a higher capacity than is
reflected by the service capacities listed in Urban
Transportation Plan Technical Procedure #1 for a divided
arterial. The presence of limited controlled access, as
well as a grade-separated intersection with GUlf-to-Bay
Boulevard, differentiates this segment of u.s. 19 from
the segment south of Barn Boulevard. The_applicant
utilized service volume calculations as identified in
Task C of the Urban Transportation Planning Model
Update--Phase II, a document prepared for ,the Florida
Department of Transportation (FOOT) by COMSIS Corporation.
In Task C of the Urban Transportation Planning
Model Update, a base figure of 870 vehicles per hour is
used as the Level of Service (LOS) "E" service volume

for a six-lane divided arterial. This figure was then
adjusted to reflect the operating conditions of the
particular segment under analysis. The applicant adjus-
ted the base figure through use of a population adjust-
ment factor. Task C states that a population adjustment
factor of 1.075 shoul~ be use~ in metropolitan areas of
greater than one million peorle, making the base figure
of 870 vehicles per h~ur senEitive to area population.
The recommended ~apacity value of 870 vehicles per
hour identified in Tas~ C was based on assumptions
about the operating conditions of the roadway. The
COMSIS calculation of capacity values was based on 60%
green time for divided arter ia 1,S. The appl icant studied
green times for the thr:e signalized intersections in
the project site area on u.s. 19, and found that green
time was between 75 and 80%. The applicant adjusted the
base figure of 870 vehicles p~r hour by a ratio of 70/60
to reflect the'greater amount of green time on 0.5. 19
than was used in the I JMSIS E :udy.

The applicant the~ multiplied this figure by 0.8
to adjust the COMSIS LOS "E" service volume to a LOS "C"
service volume. Therefor~, by utilizing Task C as pre-
pa~ed by COMSIS Corporation, the applicant calculated,
that the LOS nCft seI7lce volurr.e was 873 vehicles per
lane, or 2,619 vehiclE"3 for t'lree lanes in one direction.

. All assumptions'mad~-by the applicant are documented in
the COMSIS manual, and the ones utilized by the appli-
cant do-represent the conditions which ~xist in the
development area. ---=

Attached Tabl-e,s I and II are presented by the'
applicant as an analysis of traffic impacts of Arbor
Shoreline Office Center for average daily traffic
(AnT) and peak-' hour tr~ffic. The ,applicant's analysis
indicates that all segments of the regionally signifi-

cant roadways will be operating at LOS "F" d~ring the
peak hour, and LOS "0" or worse for daily traffic. The
aFPlicant found that for the segment of U~S. 19 north-
bound north of the project site, project traffic will
utllize 9.9% of the peak hour service,volume. Project
traff~c will not utilize this great a percentage of
serv ~ce volume (AOT or peak hour) on any other road
segment.
The Department considers a utilization of 10% or
more of the AOT or peak hour LOS "Cn service volume on a
regionally significant roadway to be a substantial
, impact when the roadway is operating below LOS "C.~ The
applic3nt's analysis concludes that all regional roadway
sesments to be affected by project 'development will be
operating at an unacceptable level of service (LOS "0"
or worse) for both AnT and peak hour. However, the
applicant's traffic analysis indicates that project
traff~c will not utilize greater than 10% of the peak
hour )r ADT service volume for any segment. Therefore,
the t~partment finds that the project will not have a
subst~ntial impact on'the regional transportation
systc.n.
7. On Nc 1ember 9, 1984, notice of this request for a
Binding Lette~ of Interpretation was published in the Florida
Administrati'ie Weekly. In addition, the Tampa Bay Regional Plan-
ning Council and the City of Clearwater were notified.
CONCLUSIONS Qf LAN
1. The proposed Arbor Shoreline Office Center development,
with 358,OO~ square feet of office development, Exceeds the pre-
sumptive th~eshold set forth in Chapter 27F-2, Florida Adminis-
trative Code and is therefore presumed to be a Development of
Regional Impacc. However, the Department finds that 82,000
square feet a~e vested pursuant to Chapter 380, Florida Statutes.
Therefore, th.' portion of Arbor Shoreline Office Center evaluated
in~this bindir~~ letter, consisting of 276,000 square feet, is not
presumed to be a Development of Regional Impact.
2. Furthermore, based upon information contained in Finding
of Fact No.5, the Department concludes that no evidence has been
presented to show that the proposed development will substan-
tially impact regionalty significant resources or facilities.
The Departn:ent concludes that the Arbor Shoreline Office Center
development will not have a substantial impact upon the health,
safety, or welfare of citizens of more than one county. There-
fore, the Arbo~ Shoreline Office Center development is not a
Development of ~egional Impact.

This binding letter of interpretation has been issued
pursuant to the procedural requirements of Subsection 120.57(2),
Florida Statutes, and constitutes final agency action appealable
within 30 days to a District Court of Appeal pursuant to Section
120.68, Florida Statutes. If you wish to present oral or written
evidence, or a written statement in opposition to this agency
action, you must file with the Department a written request for
. an opportunity to do so within 30 days from this dateo Such a
request for a reconsideration shall be made in accordance with
Rule 9B-l6016, Florida Administrative Code, and will be responded
to by the Department pursuant to Subsection l20.57(2)(a), Florida
Statutes.
This determination does not obviate the need to comply with
other applicable state or local permitting p'rocedures~ Any

The State of Florida has determined that Arbor Shoreline Office
Complex is not a Development of Regional Impact. This means that
the development can proceed as approved by the City, with no
hold-ups on permits to allow regional review.

However, I draw your attention to page four of the attached
Binding Letter. In this, the State formally recognizes the need
for a second access point, to permit exiting southbound traffic
to turn left at Harn Boulevard. This access point utilizes the
loop road in the adjacent residential complex, and was the
subject of a site plan amendment in May, 1984.
We need to keep in mind that this access point is now considered
a Qaterial fact in the State's BLI determination. If this access
point is deleted, the traffic analysis used in the BLI determina-
tion will have to be amended. The subsequent increase in the
indicated northbound traffic movements would almost certainly
make this project a Development of Regional Impact.
