Dear Ms. Williams: This letter constitutes a Development Order pursuant to Section 4-202.E of the Community Development Code. On January 27,2005, the Development Review Committee (DRC) reviewed your application for Flexible Standard Development approval for the construction of a two unit, attached dwelling (duplex), in the Medium Density Residential district, per Section 2-303.A. The DRC recommended approval ofthe application with the following bases and conditions: Bases for Avproval: 1. The proposal complies with Detached Dwellings criteria under the provisions of Section 2-303.A; 2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and 3. The proposed development is compatible with the surrounding area. Conditions of Approval: 1. That the final design of the building be consistent with the conceptual elevations submitted or as modified by the DRC; and 2. That a $200 Recreation Facilities impact fee is due prior to building permit issuance for each new residential unit on vacant property. I concur with the findings of the Development Review Committee and, through this letter, approve your application for Flexible Standard Development with the two above conditions. The approval is based on and must adhere to the site plan and application dated received I?ecember 17, 2004 and the revised site plans dated received March 17, 2005 and the revised building elevations dated received March 28,2005. r BRIANJ AUNG~l, MAYOR FRANK HlIJflARD, VICC MAYOR BILL JON~ON, COLJNeIL~\!:'lflCR (i) HOYl HAMill ON, COUNCfL\!L\lBCR CARLCN A PEIERSCN, COUNUL\!E\fflCR "EQUAL EMPLOYMEN 1 AND AFFIRMAl IVE Ac I ION EMPLOYER" c: 4'- · \' March 31, 2005 Ms. Williams- Page Two Pursuant to Section 4-303, an application for a building permit shall be made within one year of Flexible Standard Development approval (March 31, 2006). All required certificates of occupancy shall be obtained within one year of the date of issuance of the building permit. Time frames do not change with successive owners. The issuance of this Development Order does not relieve you of the necessity to obtain any building permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or license affected by this approval, please bring a copy of this letter with you when applying for any permits or licenses that require this prior development approval. THE ROOT MASS FORM OF EACH TREE PROPOSED FOR INSTALLATION SHALL BE BALLED OR BUR LAPPED, BARE ROOT TREES ARE NOT AC- CEPTABLE. ALL NONBIODEGRADABLE WRAPPINGS WILL BE REMOVED AND BURLAP WILL BE FOLDED DOWN TO ENHANCE WATER ABSORPTI(iN. IF WIRE BASKETS ARE USED IN CONJUNCTION WITH BALLED AND BURLAPPED TREES. THE FIRST FEW ROWS OF EACH BASKET WILL BE REMOVED AT THE TIME OF INSTALLATION. 2. SUPPORTING APPARAl1JS SHALL BE REMOVED AFTER 1 COMPLETE GROWING SEASON. ALSO THE FLEXIBLE ATTACHMENTS SHALL BE USED WHERE SUPPORT WIRES ARE WRAPPED AROUND TREE TRUNKS/STEMS TO PREVENT CAMBIAL DAMAGE. 3. PLANTING HOLES ASSOCIATED \WITH PROPOSED TREES MUST SLOPE (NOT COMPACTED) AND A MINIMUtM OF 18-24 INCHES WIDER THAN THE DIAMETER OF THE ROOT BAUL TREES SHALL BE INSTALLED SUCH THAT THE TOP OF THE ROOT MASS IS LEVEL WITH THE SURFACE OF THE PIJI.NTING HOLE. TREES SHOULD BE INSTALLED 3 - 5 INCHES ABOVE GRADE ON SITES CONTAIN liNG CIJI.Y. A 2 - 3 INCH LAYER OF ORGANIC MULCH MUST ALSO BE IPIJI.CED OVER THE ENTIRE SURFACE OF EACH PLANTING HOLE. TO PREVENT FUNGAL INFECTION MULCH SHOULD BE PULLED BACK A FEW INCHES FROM THE BASE OF EACH TREE. 4. IF ON SITE SOIL CONDITIONS ARE SUCH THAT SOIL AMENDMENTS WILL BE NECESSARY, THE PLANTING MUST INCLUDE SOIL MIXTURE THROUGHOUT THE ENTIRE SECTION OF EACH PLANTER AREA TO A DEPTH CONSISTENT WITH THE ROOT DEVELOPMENT OF PROPOSED PLANT MATERIAL 5. PIJI.NTERS ADJACENT TO OR WITHIN VEHICUIJI.R USE AREAS MUST BE CONSTRUCTED SUCH THAT L1MEROCK, ASPHALT, CONCRETE OR ANY OTHER OBSTRUCTIONS DO NOT EXTEND UNDER THE SURFACE INTO THE PLANTING AREAS. 6. THE PRACTICE OF TREE TRUNK WRAPPING AND THE APPLICATION OF PAINTS/TAR ONTO PRUNED TREE BRANCHES IS NOT RECOMMENDED BY THE INTERNATIONAL SOCIETY OF ARBORICULTURAL 7. PLEASE NOTE THAT THE USE OF FERTILIZERS DURING PLANT INSTALLATION IS NOT APPROVED. SCIENTIFIC EVIDENCE INDICATES THAT~lfILlZATION (SPECIFICALLY, THE APPLICATION OF NITROGEN) OF T .' /SHRUBS WITHIN THE FIRST GROWING SEASON INHIBITS ROOT GRO .. '.
