Dear Mr. Lafferty:
This letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community
Development Code. On July 8, 2004 the Development Review Committee reviewed your
application for Flexible Standard Development approval to remodel existing hotel in the Tourist
Zoning District. The request is for exterior building facade enhancements and a reduction of
overnight accommodation units from 18 to 16 units per section 2-802.J. The DRC recommended
approval of the application with the following bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Standard Development criteria per Section 2-802.J.
2. The proposal is in compliance with other standards in the Code including the General
Applicability Criteria per Section 3-913.
3. The proposal is in compliance with Beach By Design guidelines.
4. The development is compatible with the surrounding area and will enhance other
redevelopment efforts.
Conditions of Approval:
1. That the use of this property be for overnight accommodations, meeting the definition of the
Community Development Code, with owner and guest stays not to exceed 30 consecutive
days. At the request of the City Manager or designee, the records of the business shall be
made available for examination to determine whether the length of stay complies with these
provisions. Failure to pr<;>vide such records upon request shall be grounds for imposition of
appropriate fines, revocation of the occupational license and/or any other enforcement
afforded by law or by City regulations. A license must be obtained and maintained from the
Florida Department of Business and Professional Regulation, Division of Hotels and
Restaurants. A registration lobby shall be maintained. This development shall not be

2. That a condominium plat be recorded prior to the issuance of the first Certificate of
Occupancy;
3. That the final design and color of the building be consistent with the conceptual elevations
submitted to the DRC; and
4. That all signage be consistent to the design/colors submitted and comply with the
requirements of the signage portion of the Community Development Code and Beach By
Design.
I concur with the findings of the Development Review Committee and, through this letter,
approve your application for Flexible Standard Development with above four conditions. The
approval is based on and must adhere to the application dated received May 26, 2004 and the
color samples, elevations, and site plans dated received July 12, 2004.
Pursuant to Section 4-407, an application for a building permit shall be made within one year of
Flexible Development approval (August 3, 2005). All required certificates of occupancy shall be
obtained within one year of the date of issuance of the building permit. Time frames do not
change with successive owners. The Community Development Board may grant an extension of
time for a period not to exceed one year and only within the original period of validity.
The issuance of this Development Order does not relieve you of the necessity to obtain any
building permits or pay any impact fees that may be required. In order to facilitate the issuance
of any permit or license affected by this approval, please bring a copy of this letter with you when
applying for any permits or licenses that require this prior development approval.
