FLD2004-09072/TDR2005-01015 483 Mandalay Avenue Dear Mr. Zayac: This letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Community Development Code. On Apnl 19,2005, the Commumty Development Board revIewed yourrequests for (1) Flexible Development approval to permIt a mIxed use (proposed parking garage and attached dwellmgs m conjunction wIth eXIsting retaIl sales) with a reduction to the front (east) setback from 25 feet to 4.77 feet (to bUIlding), a reductIOn to the SIde (north) setback from 10 feet to 2.91 feet (to bUIldmg), reductIons to the side (south) setback from 10 feet to zero feet (to dumpster enclosure), from 10 feet to 1.74 feet (to pavement) and from 10 feet to 2.6 feet (to building), a reduction to the rear (west) setback from 20 feet to 0.5 feet (to building), to increase the building heIght from 35 feet to 70 feet (to roof deck) with an additIOnal four feet for perimeter parapets (from roof deck) and an additional 16 feet for rooftop pavilion (from roof deck) and to permit a building within the visibihty triangles, as a Comprehensive Infill Redevelopment Project, under the provisions of Section 2-803.C., and a reduction to the width of foundation landscaping along Poinsettia Avenue from five feet to 4.77 feet, as a ComprehensIve Landscape Program under the proviSIOns of Section 3-1202.G; and (2) Transfer of Development Rights of four units from 656 Bayway Boulevard, under the provisIOns of SectIon 4-1402 (TDR2005-01015). The Community Development Board (CDB) APPROVED the applicatIOns with the following bases and conditions: Bases for Approval: 1. That the final deSIgn and color of the bUlldmg be consistent with the conceptual elevattons submItted to, or as modified by, the CDB; 2. That tenant storage umts on Level Seven be for storage only; 3. That the paVIlion on the roof be open-air and not be enclosed in any manner; 4. That the southern reSIdent/emergency exit dnveway be used for both mgress and egress at appropnate times during peak events; 5. That replacement tree calculations be revised, acceptable to the Planning Department, prior to the issuance of any permits; 6. That a special warranty deed, specIfymg the number of dwelling units being conveyed or sold from 656 Bayway Boulevard and being transferred to this site, be recorded pnor to the issuance of any permits for this project. The special warranty deed shall also contain a covenant restricting in perpetuity the use of all platted lots at 656 Bayway Boulevard due to the transfer of development rights. Any mortgage holder of the sending site (656 Bayway Boulevard) shall consent to the transfer of development rights prior to the issuance of any permIts; 7. That all proposed utilities (from the right-of-way to the proposed building) be placed underground. Conduits for the future undergrounding of eXIsting utthties within the abutting right-of-way shall be mstalled along the entire SIte's street frontages prior to the issuance of a Certificate of Occupancy. The applicant's representattve shall coordinate the size and number of conduits with all affected utility provIders (electric, phone, cable, etc.), WIth the exact location, size and number of condUlts to be approved by the applicant's engineer and the City's Engineering Department pnor to the commencement of work; 8. That all eXIsting nonconforming freestanding and attached signage be brought into conformance with Code provisions prior to the Issuance of the first Certificate of Occupancy for the attached dwellings. The Comprehensive Sign Program may be utthzed to provide freestandmg and attached signage m accordance with Code proviSIOns; 9. That changes to the number and locatIOn of trash contamers, trash rooms and enclosures, acceptable to the Solid Waste Department and other DRC members, be reflected on revised site and bUlldmg plans prior to the issuance of any permits; 10. That dumpster enclosures meet Solid Waste Department size requirements and be conSIstent in extenor material and color as the hotel budding; 11. That a condominium plat be recorded prior to the issuance of the first Certificate of Occupancy; 12. That, pnor to the issuance of the first Certtficate of Occupancy, traffic impact fees be assessed and paId; 13. That all Parks and Recreation fees be paid pnor to the issuance of any permIts; and 14. That all FIre Department reqUlrements be met prior to the issuance of any permits. You are also requested, since the property is more than one platted lot, to record a Declaration of Unity of Title in the public records of Pinellas County within 30 days of the date of this letter. The attached Declaration of Unity of Title document has been prepared for you for signature and recording. The new Declaration of Unity of Title document requires the owners' signature to be witnessed by two persons (whom also must sign the form) and be notarized prior to recording. Once the new Declaration of Unity of Title document is recorded, please submit a copy of the recorded document to Wayne Wells for our records. , \ .. April 25, 2005 Zayac - Page Three Pursuant to SectIOn 4-407, an applIcatIon for a bUIldmg permit shall be made wlthm one year of FlexIble Development approval (Apnl 19, 2006). All reqUIred certificates of occupancy shall be obtained withm one year of the date of Issuance of the buildmg permIt. TIme frames do not change WIth successive owners. The Community Development Coordinator may grant an extension of time for a period not to exceed one year and only within the ongmal period of validity. The Community Development Board may approve one additional extensIOn of time after the community development coordinator's extensIOn to initIate a building permIt application. The issuance of this Development Order does not relieve you of the necessIty to obtam any building permits or pay any impact fees that may be required. In order to facilitate the Issuance of any permit or license affected by thIS approval, please brmg a copy of thIS letter WIth you when applying for any permIts or licenses that require thIS prior development approval. AddItionally, an appeal of a Level Two approval (Flexible Development) may be initiated pursuant to Section 4-502.B by the applicant or by any person granted party status within 14 days of the date of the CDB meetmg. The filmg of an application/notice of appeal shall stay the effect of the decision pending the final determmatIon of the case. The Landscape Contractor shall grade planting beds, as required, to provide positive drainage and promote optimum plant growth. 2. All recommended trees and plant materials will be graded as Nursery Grade No. 1 or better as outlined by the Florida Department of Agriculture and Consumer Services, Division of Plant Industry "Grades and Standards for Nursery Plants", 7th Edition, 1998 as revised from time to time. 3. All planting shall be done in accordance with the Florida Nurserymen's and Grower's Associations approved practices. 4. All plants shall be fertilized with Agriform 20-10-5 tablets as per the manufacturers specifications in conjunction with note # 5. 5. The planting soil shall be the approximate proportions as follows: 50% sand and 50% organic material consisting of native peat, well-decomposed sawdust, leaf mold and top soil. It shall provide a good pliable and thoroughly mixed medium with adequate aeration, drainage and water-holding capacity. It shall also be free of all extraneous debris, such as roots, stones, weeds, etc. 6. All planting areas shall receive a 3" layer of cypress mulch, which is to be watered-in after installation. 7. The plant material schedule is presented for the convenience of the Landscape Contractor. In the event of a discrepancy between the plan and the plant key, the plan shall prevail. 8. Plants shall meet size, container, and spacing specifications. Any material not meeting specifications shall be removed and replaced at the contractor's expense. 9. The Landscape Contractor shall be responsible for examining fully both the site and the bid documents. Discrepancies in the documents or the actual site conditions shall be reported to the Landscape Architect in writing at the time of bidding or discovery. No account shall be made after contract completion for failure to report such condition, or for errors on the part of the Landscape Contractor at the time of bidding. 10. The Landscape Contractor shall be responsible for securing all necessary applicable permits and licenses to perform the work set forth in this plan set and the specifications. 11. Plant material shall be bid as specified unless unavailable, at which time the Landscape Architect will be notified by in writing of intended changes. 12. Any and all questions concerning the plan set and/or specifications shall be directed to the Landscape Architect at (727) 793-9888 13. There shall be no additions, deletions or substitutions without the written approval of the owner. 14. The Landscape Contractor shall guarantee, in writing, plant survivability for a period of twelve (12) months from final acceptance by the owner. 15. All dimensions to be field-.checked by the Landscape Contractor prior to landscape material installation. Discrepancies shall be reported immediately to the owner. 16. All materials must be as specified on the landscape plan. If materials or labor do not adhere to specifications, they will be rejected by the City Project Manager with proper installation carried out by Landscape Contractor at no additional cost. 17. All permits necessary are to be provided by the installing contractor unless otherwise specifically stated in the specifications. 18. No contractor identification signs shall be permitted on the project, except for the project information signs. 19. Existing sod shall be removed as necessary to accomodate new plantings. 20. Any existing areas that are disturbed during the landscape installation shall be resodded with St. Augustine "Floritam". 21. The Landscape Contractor will be responsible for the collection, removal, and proper disposal of any and all debris generated during the installation of this project. 22. All areas disturbed within right of way' shall be sodded. 23. All landscaping within right-of-way will require a separate R-O-W permit.ill be responsible for the collection, removal, and proper disposal of any and all debris. IRRIGATION NOTES 1. A low volume irrigation system, that provides 100% coverage to all proposed plantings, will be designed and installed by the Contractor. 2. The proposed Irrigation System must meet or exceed all applicable City code requirements. (i.e., Back Flow/ Prevention, Automatic Rain Shutoff Device, etc...) 3. Irrigation system must be insipected and accepted by Lcndscape Architect prior to installation of mulch. Irrigation must meet city code section 3-1203.C to provide 100% coverage, and include a rain sensor and timer. 4. Irrigation as-built drawings, which accurately and clearly identify all modifications &/or substitutions, must be :submitted prior to final inspection and acceptance. 5. The Landscape Contractor must coordinate the placement and power supply for the irrigation control timer with the General Contractor. 6.
