Dear Mr. Kensler:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On April 16, 2004, the Development Review Committee (DRC) reviewed your
application for Flexible Standard Development approval to repaint the existing hotel and augment an
existmg deck with awning and landscaping within the Tourist District under the provisions of Section
2-802. The proposed colors of the building are September Leaf - golden brown (Duron #7744M) and
Folksy Gold - pumpkin (Sherwin Williams #6360) with existing Sunbrella Firesist awnings (#8167
Royal Blue). The DRC recommended approval of the apphcation subject to the following bases and
conditions:
Bases for approval:
1. The proposal complies with Tourist District flexibility criteria for overnight accommodations under
the provisions of Section 2-802;
2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
3. The proposed development is compatible with the surrounding area.
Conditions of approval:
1. That all Fire Code provisions are met prior to issuance of building permit for the deck;
2. That any future exterior modifications be submitted to the Planning Department; and
3. That any changes to existing signage be reviewed through the Planning Department and/or the
Comprehensive Sign Program.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development. The approval is based on and must adhere to the
site plans dated received March 23, 2004 and elevations/colors dated received April 15, 2004.
Pursuant to Section 4-303, an application for a building permIt shall be made within one year of
Flexible Development approval (April 16, 2005). All required certifi.f~e~of occupancy shall be
