RE: Development Order regarding case FLS2004-02011 at 1209 N. Ft. Harrison Avenue
Dear Mr. Moritz:
This letter constitutes a Development Order pursuant to Section 4-202.E of the Community
Development Code. On April 1, 2004, the Development Review Committee (DRC) reviewed your
application for Flexible Standard Development for a reduction in front (west) setback from 25 feet to
15 feet to pavement for the expansion of an existing automobile service station from 413 square feet to
a 1,200 square foot, under the provisions of Section 2-703.D. The DRC recommended approval of the
application with the following bases and conditions:
Bases for approval:
1. The proposal complies with criteria under the provisions of Section 2-902.G.;
2. The proposal complies with criteria under the Downtown District Design Guidelines;
3. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and
4. The proposed development is compatible with the surrounding area.
Conditions of Approval:
1. That the palms shown on the plan be listed in the schedule prior to building permit;
2. That a revised plant schedule must be done to include the quantity, size, spacing and materials for
all proposed plantings prior to bUIldmg permIt;
3. That the large metal storage unit be removed prior to issuance of any building permits; and
4. That the signage be approved by the Comprehensive Sign Program (SGN2004-02011) prior to
issuance of any sign permits.
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with the above four conditions. The approval is
based on and must adhere to the site plan and application dated received February 27, 2004 and
additional supporting materials dated received June 7,2004.

Pursuant to Section 4-303, an application for a building permit shall be made witlftn' one year of
Flexible Standard Development approval (June 23, 2004). All required certificates of occupancy shall
be obtained within one year of the date of issuance of the building permit. Time frames do not change
with successive owners.

The issuance of this Development Order does not relieve you of the necessity to obtain any building
permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or
license affected by this approval, please bring a copy of this letter with you when applying for any
permits or licenses that require this prior development approval.
Pursuant to Section 4-502.A, an appeal may be initiated within seven days of the date the Development
Order is issued by an applicant or property owners within the required notice area and who presented
competent substantial evidence in the Level One review. A copy of the Development Order is being
sent to those surrounding property owners who presented competent substantial evidence in the Level
One review. The filing of an application/notice of appeal shall stay the effect of the decision pending
the final determination of the case.

TERMITE PROTECTION REQUIREMENTS: (per FBC 2001)
Sec. 1816 - TERMITE PROTECTION:
1816. 1 Term ite protect ion shall be provided by registered
termiticides or other approved methods of termite
protection labeled for use os 0 preventative
treatment to new construction.
1816.1.1 If soil treatment is used for subterranean
termite prevention, the initial chemical soil treaatment
inside foundation perimeter shall be done after all
excavation, backfilling, and compaction is complete.
1816.1.2 If soil treatment is used for subterranean
termite prevention, soil area disturbed after initial
chemical soil treatment shall be retreated with a
chemical soil treatment, including spaces boxed or formed.
1816.1.3 If soil treatment is used for subterranean
termite prevention, space in concrete floors boxed out
or formed for the subsequent installation of plumbing
traps, drains, or for any other purpose shall be created
by using plastic or metal permanently placed forms of
sufficient depth to eliminate any plonned soil
disturbance after initial chemical soil treatment.
1816.1.4 If soil treatment is used for subterranean
termite protection, chemically treated soil shall be
protected with a minimum 6 mil vapor retarder to
protect against rainfall dilution. If rainfall occurs
before vapor retarder placement. re-treatment is
required. Any work, including placement of reinforcing
steel, done after chemical treatment until the concrete
floor is poured, shall be done in such manner as to
avoid penetrating or disturbing treated soil.
1816.1.5 If soil treatment is used for subterranean
termite prevention, concrete overpour or mortar
accumulated along the exterior foundation perimeter
shall be removed prior to exterior chemical soil
treatment, to enhance vertical penetration of the
chemicals.

1816.1.6 If soil treatment is used for subterranean
termite prevention, chemical soil treatments shall also
be applied under all exterior concrete on grade within
one foot (12") of the primary structure sidewalls. Also,
a vertical chemical borrier sholl be applied promptly
after construction is completed, including initial
landscaping and irrigation/sprinkler installation. Any
soil disturbed after the chemical vertical barrier is
applied shall be promptly retreated.
ADDITIONAL REQUIREMENTS FROM OTHER PARTS OF CODE:
104.2.7 CERTIFICATE OF PROTECTIVE TREATMENT FOR
PREVENTION OF TERMITES:
A weather resistant job site posting board shall
be provided to receive duplicate Treatment Certificates as
each required protective treatment is completed,
providing a copy for the person to whom the permit is
issued and another copy for the Building Permit files.
The -Treatment Certificate shall provide the product used,
identity of the applicator, time and date of the treatment,
site location, area treated, chemical used, percent
concentration and number of gallons used, to establish
a verifiable record of protective treatment. If the soil
chemical barrier method for termite prevention is used,
final exterior treatment shall be completed prior to
final building approval.
104.2.8 NOTICE OF TERMITE PROTECTION:
A permanent sign which identifies the termite
treatment provider and need for re-inspection and
treatment contract renewal shall be provided. The
sign shall be posted near the water heater or electric
panel.
1403.1.6 In order to provide for inspection for termite
infestation. clearance between exterior wall coverings and
final earth grade on the exterior of a building shall not
be less than 6 inches (152 mm).
Except ions:
1) Paint or decorative cementitious finish less than five-
eighths (5/8") inch thick adhered directly to the masonry
foundation sidewall.
2) Access or vehicle ramps which rise to the interior finish
floor elevation for the width of such ramps only.
3) A four inch (4") inspection space above patio and garage
slabs and entry areas.
4) If the patio has been soil treated for termites, the
finish elevation may match the building interior finish floor
elevations on masonry construction only.
5) Masonry veneers.

1503.4.4 PROTECTION AGAINST DECAY AND TERMITES:
Condensate lines and roof downspouts shall discharge at least
1 foot (305 mm.) away from the structure sidewall. whether by
underground piping, tail extensions, or splash blocks.
Gutters with downspouts are required on all buildings with
eaves of less than 6" horizontal projection except for gable end
rakes or on a roof above another roof.
Irrigation/sprinkler systems and risers for spray heads shall not
be installed within 1 foot of the building sidewall.
2303 ~TE CLEANUP
2303.1.3 requires that all wood and debris be removed from under
or within 1 foot of the building, except for materials that are
naturally durable wood or are pressure treated for ground contact.
2303.1.4 In order to reduce chances of termite infestation, no
wood, vegetation, stumps. dead roots, cardboard, trash, or other
cellulose-containing material shall be buried on the building lot
within fifteen feet (15') of any building or the position of any building
proposed to be built.
2304.1.2 FOAM PLASTIC INSULATION:
In areas where hazard of termite damage is very heavy,
clearance between earth and foam plastics opplied to the
exterior wall sholl be not less than six inches (6").
