J' ~. .' .',," . :.:.. .. , I AMENDMENT TO LEASE AGREEMENT THIS AMENDMENT TO LEASE AGREEMENT, made and entered into this 9~ day of ~~_ , 1986, by and between the CITY OF CLEARWATER, FLORIDA, a municipal corporation, hereinafter referred to as "Lessor," and HOWARD G. HAMILTON, hereinafter referred to as "Lessee;" WIT N E SSE T H: WHEREAS, the parties hereto have previously entered into a Lease Agreement dated October 28, 1985, whereby the Lessor leased to the Lessee a food concession and restroom complex building for a term of fifteen years; and WHEREAS, the term of the Lease Agreement was incorrectly inserted in the Lease Agreement and the parties intended that the term of the lease and the lease year coincide with the calendar year so as to ease both the computation of the rental payments and the transition from the lease agreement between the Lessor and Lessee prior to the agreement dated October 28, 1985; and WHEREAS, the legal description for the property subject to the Lease Agreement has been determined by a survey to be in error, and the parties desire to substitute a correct legal description for the property; NOW, THEREFORE, the parties hereto convenant and agree as follows: 1. The legal description of the property subject to the Lease Agreement is deleted, and the following is substituted therefor: Food concession and restroom complex building located on the West 140 feet of the East 215 feet of the following described parcel: Lots 18 and 19 and the North 1/2 of Lot 20 of Lloyd, White and Skinner Subdivision, according to the plat thereof as recorded in Plat Book 13, page 12 and 13, of the Public Records of Pinellas County, Florida, located in Section 7, Township 29 South, Range 15 East, Pinellas County, Florida. 2. Paragraph 1 of the Lease Agreement is deleted, and the following is substituted therefor: 1. The term of this lease is fifteen (15) years, beginning on the 1st day of January, 1986, and ending on the 31st day of December, 2000. As referred to in this agreement, a "lease year" is that year that commences on the 1st day of January and terminates on the 31st day of December of each year during the term of this lease. Reference to the City Manager throughout this lease refers to Lessor's City Manager or his designated agent. The term "Lessor" refers to the City, and any act to be taken by the Lessor under this lease must be taken by the City Commission. -1- (!
