RECOM MENDATION:
Authorize modification of the legal description contained
in exhibit "A" of the lease agreement dated April 30, 1984, by and between
the City of Clearwater and Clearwater Beach Seafood, Inc., to include
an additional 300 square feet of property to the demised premises as
described in the revised exhibit "A" included herewith.
o And that the appropriate officials be authorized to execute same.
BACKGROUN 0: The current lease provides for construction of a seafood
restaurant alongside and above the existing seafood market.
The design of the seafood restaurant addition, as approved by the city, will
result in the second floor eaves extending three (3) feet outside the
'leased area identified in the lease description, plus an additional
fenced area on the east side of the building to screen a dumpster storage
area.
These extensions will, in the op~n~on of staff, enhance the appearance
of the building and will not reduce usable public space at the marina.
Staff recommends approval of the revised legal description contained in
the revised exhibit "A".

Dear Mr. Shoemaker:
I have been advised by city staff that my seafood restaurant addition,
as designed and approved by the city, extends beyond the limits of the
legal description contained in my lease.
While the building proper will be situated within the leased area, the
"encroachment" is created by eaves on the building, which extend outward
three feet at the second floor roof level. A further extension exists
on the east side of the building to provide for a low fence to screen
the seafood market's dumpster.
I have been advised by the harbormaster that, although he approves of
the building as designed, it will be necessary to revise the legal
description contained in my lease before construction can commence.
I request that whatever corrective action is required be taken at the
earliest possible time i~ order that construction not be delayed.

Legal Description
That part of Lot 12 and 13 of City Park Subdivision according to the Plat
thereof as recorded in Plat Book 23, Page 37 of the Public Records of
Pinellas County, Florida. Commence at the North West corner of Lot 13
and run Easterly along the North line of s~id Lot 13, 107 feet to the point
of beginning. Thence, run Easterly along the North line of Lot 12 and 13
a distance of 103 feet; thence run Southeasterly 63.78 feet to a point on
a line 63.00 feet South of and parallel to the North line of Lots 12 and 13;
thence run Westerly along said line 113.00 feet; thence run Northerly along
a line parallel to the East line of Lot 13, 63.00 feet to the point of
