Dear Ms. Stough:
ThiS letter constitutes a Development Order pursuant to Section 4-206.D.6 of the Commumty
Development Code. On August 17, 2004, the Commumty Development Board reviewed your FleXible
Development applIcation to Termmate the Status of a Nonconformity for density wIthm the TOUrIst
DistrIct to permIt the relocatIOn of five overnight accommodatIOn umts from the southern bUIlding
(BUlldmg A) to the northern bUIldmg (BUIldmg B) and the conversIOn of five overnIght accommodation
umts 111 the southern bUIldmg (BUIldmg A) to accessory storage and hotel office usage With a reductIOn to
the front (west) setback from 15 feet to zero feet (to eXlstmg pavement), a reductIOn to the front (south)
setback from 15 feet to seven feet (to existmg pavement), a reductIOn to the SIde (north) setback from 10
feet to three feet (to eXlstmg pavement), a reductIOn to the Side (east) setback from 10 feet to three feet
(to eXIstmg pavement), an mcrease to height from 35 feet to 48 feet (exIstmg BUIlding A) and from 35
feet to 67 feet (exlstmg BUIldmg B) and to elImmate the five-foot WIde foundatIOn landscape area
adjacent to the southern bUIldmg (BUIldmg A), under the prOVIsIOns of SectIOn 6-109.C and SectIOn 2-
803 I, WIth a ComprehenSIve Landscape Program, under the proVIsIOns of SectIOn 3-1202 G. The
Commumty Development Board (CDB) APPROVED the applIcatIOn With the followmg bases and
conditIOns.
Bases for Approval.
1. The proposal complIes With the FleXible Development CrIterIa to Termmate the Status of a
Nonconformity (denSity and number ofparkmg spaces) per Section 6-109.C.
2 The proposal IS m complIance With other standards m the Code mcludmg the General ApplIcabilIty
CrIterIa per Section 3-913.
3. The development IS conSIstent and compatible With the surroundmg area.
Conditions of Approval.
1. That a maximum of 111 total umts/rooms be proVided at thiS hotel/motel (mcludmg the
owner/manager umt);
2 That the FlOrIda Department of Busmess and ProfeSSIOnal RegulatIOn, DIVISIOn of Hotels and
Restaurants lIcense and the City'S occupatIOnal lIcense be amended to reflect the change m number
of umts/rooms, pnor to the Issuance of the Certificate of Occupancy for the umts m the northern
buIldmg (BUIldmg B). Guest stays for both bUIldmgs shall not exceed 30 days (except the

occupational licenses;
3 That no more than one umt be leased for a non-hotel/motel busmess use on the west side of the
southern bUIldmg (BUIldmg A) and Its use be lImited to offIce-type uses;
4 That the fmal deSign and color of the modificatIOns to both the southern and northern bUIldmgs be
conSIstent With the conceptual elevatIOns submitted to, or as modIfied by, the CDB;
5. That hedges and other landscapmg (not mcludmg trees) on the northern portion of the site be
mamtamed to a maximum heIght of three feet to prOVide contmued views of the water by adjacent
property owners and tenants/guests Landscape materIals along the north and east sides of the
property shall be of a type that mmImlzes msect and mamtenance debris Impacts on the neighbor to
the north. Landscape plans shall show complIance With these reqUIrements prIor to the issuance of
bUlldmg pern1Its for the relocated umts/rooms m the northern bUIldmg (BUIldmg B);
6 That, pnor to the Issuance of permits for the northern bUIldmg umts, the Planmng Department
approve the ComprehenSive Sign Program (SGN2004-07010). InstallatIOn and fmal mspectlOn of
slgnage under the ComprehenSive Sign Program shall occur prIor to the issuance of a Certificate of
Occupancy for the relocated umts m the northern bUIldmg (BUIldmg B), and
7. That a Umty of Title be recorded m the publIc records pnor to the Issuance of any permits.
Pursuant to SectIOn 4-407, an applIcatIOn for a bUIldmg permit shall be made wIthm one year of Flexible
Development approval (August 17, 2005). All reqUIred certificates of occupancy shall be obtamed
wlthm one year of the date of Issuance of the bUIldmg permit. Time frames do not change With
successive owners. The Commumty Development Coordmator may grant an extensIOn of time for a
perIod not to exceed one year and only wlthm the orIgmal perIod of valIdIty. The Community
Development Board may approve one addItional extensIOn of time after the commumty development
coordmator's extensIOn to mltIate a bUIldmg permIt applIcatIOn.
The Issuance of this Development Order does not relIeve you of the neceSSIty to obtam any bUIldmg
penmts or pay any Impact fees that may be reqUIred In order to faCilitate the issuance of any permit or
lIcense affected by this approval, please brIng a copy of this letter with you when applying for any
permits or lIcenses that reqUIre this prIor development approval.
Additionally, an appeal of a Level Two approval (FleXible Development) may be mitIated pursuant to
SectIOn 4-502.B by the applIcant or by any person granted party status wIthm 14 days of the date of the
CDB meetmg. The fIlmg of an applIcatIon/notice of appeal shall stay the effect of the deCISIOn pendmg
the fmal determmatlOn of the case. The appeal perIod for your case expIres on August 31, 2004 (14 days
from the date of the CDB meetmg).

GENERAL IRRIGATION NOTES
GENERAL LANDSCAPE NOTES
Tree drlpline
J . Repair or Install a new automatic Irrigation system to provide I 00% coverage of all landscape areas.
2 Shrub risers shall only be used In hedges or mass plantlngs. Risers shall not extend more than 2" above the
Installed height of the plant. All risers shall be schedule 40 pipe, painted black. In no case shall shrub risers be
Installed adjacent to walkways, driveways or other areas where they may be damaged.
3. All heads Installed In plantmg areas along walks, drives and parkmg lots shall be I 2" pop-up hxed spray
heads. All heads shall be Installed With the top of the spray body flush With finish grade. All groundcover areas
shall be Irrigated With 1211 pop-up fixed spray heads and extensions as required.
4. All sodded areas shall be Irrigated With 4" pop-up spray heads or pop-up gear driven heads unless
otherWise speCified. _
5. Pipe, valves and other Irrigation equipment may be shown In drives, walks or bUIldings for clarity only. Install
all valves and other equipment In landscape beds for best acceSSibility and concealment.
G. Valves shall be Installed In a manifold Wlthm a valve box of suffiCient size to service all valves Within the box.
Valve box shall be free from any debriS which may cover valves. PrOVide a 3" depth gravel sump at the bottom of
the valve pit.
7. All Irrtgatlon equipment and installation techniques shall meet federal, state and local codes, regulations and
ordinances.
8. All gear driven heads and all heads along walks, curbs, drives and parkmg areas shall be Installed on fleXible
polyethylene sWing JOints.
9. Gear driven heads and fixed spray heads shall be Installed on separate zoneswhere pOSSible. PreCipitation
rates and head type should be compatible Within each zone.
J O. Gear driven heads shall not be Installed m shrub areas or be mstalled on risers where pOSSible.
I I. Controller shall be mounted as shown on plan
J 2. All sleeves shall be schedule 40 pipe Installed a minimum of 14" below grade. Sleeves shall be used only
to Installlaterallrrigabon lines through. Sleeves shall not be used as a method to convey water through the
system. ,.
13. Adjust all heads to provide maximum coverage and effiCiency and minimiZe overthrow. Irrigation heads shall
not spray over walks, drives or any other non-Irrigated areas. ,
14. EqUipment shall bemanufactured by, "Tord, 'Ralnblrd" or IIHunter" or as otherWise stated on the plans.
15. Contractor shall field verify water source to deliver the proper pressure, pounds per square Il1ch (PSI) and
water flow, gallons per minute (GPM) as reqUIred by the Irrigation system. Notify the Landscape Architect If there
15 any discrepancy.
J G. All permlts reqUired for installation shall be prOVided by the contractor.
I 7. Refer to the Landscape Plans when locating all Irrigation equipment. Allow ample room near Irrigation
equipment for the proper Installation of trees, shrubs and other work shown on draWings to be Installed.
J 8. All wires shall be Installed In wire sleeves.
19. Contractor shall be responSible for all Items on the plan and Irrigation speCification.
20. Contractor shall Instruct the owner on the full operation and maintenance of the Irrigation system.
2 I. Contractor shall be responSible for all final repairs or adjustments to prOVide proper coverage to all
landscape areas.
22. All questions regarding Irngatlon speCifications shall be directed to the Landscape Architect at (727)
787-2840.
I . All plant matenals shall be FlOrida # I or better and Installed to highest nursery standards. Plants shall be
healthy, free of pest and disease.
2. All plants shall be contall1er grown except as noted on plan.
3. All palms and trees shall have straight trunks With no tWists, knotting or other defective characteristics.
4. Mulch shall be 100% Pine Bark, Installed to a minimum thickness of 2".
5. Sod shall be 95% weed free St. Augustine "Floratam", Installed With tight J01I1ts.
G. All dimenSions shall be field checked by the Landscape Contractor prior to construction With any
discrepancies reported to the Landscape Architect.
7. All materials shall be as speCified on the plans. If materials, labor or II1stallatlon techniques do not adhere
to the speCifications, they will be rejected by the Landscape Architect With speCified materials and installation
carned out by the Landscape Contractor at no additional cost.
8. No substitutIons of materials or changes to the draWings or speCificatIons shall be made.
9. All reqUired permits are to be prOVided by the Instal11l1g contractor unless speCIfically stated otherWise In
the speCifications.
10. Contractor Identification signs shall not be allowed on the proJect.
I I. Contractor shall be responSible for all Items as shown or deSCribed on thiS plan and speCifications.
12. All proposed landscape and sod areas contalnll1g turf or weeds shall be treated With "Round-up" per
manufacturer's speCifications.
13. Landscape Contractor shall prOVide all necessary site preparatton reqUired to ready the site for plantll1g as
specified.
I 4. The landscape Contractor shall warranty and guarantee all materials and labor for a period of 90 days for
shrubs and groundcover, palms and trees. Warranty and guarantee period shall begin upon date of completion.
'5. All repairs and/or replacements shall be made by the Landscape Contractor wlthm 10 working days upon
notification of any defiCienCies by the owner or their representative.

GENERAL IRRIGATION NOTES
) . Repair or Install a new automatic Irrigation system to provide I 00% coverage of all landscape areas.
2 Shrub risers shall only be used In hedges or mass plantlngs. Risers shall not extend more than 2" above the
Installed height of the plant. All risers shall be schedule 40 pipe, painted black. In no case shall shrub risers be
Installed adjacent to walkways, driveways or other areas where they may be damaged.
3. All heads Installed In planting areas along walks, drives and parking lots shall be I 2" pop-up fixed spray
heads. All heads shall be Installed With the top of the spray body flush With finish grade. All groundcover areas
shall be Irrigated With 12" pop-up fixed spray heads and extensions as required.
4. All sodded areas shall be Irrigated With 4" pop-up spray heads or pop-up gear driven heads unless
otherWise speCified.
5. Pipe, valves and other Irrigation equipment may be shown In drives, walks or bUIldings for clarity only. Install
all valves and other equipment In landscape beds for best accessibility and concealment.
G. Valves shall be Installed In a mamfold Within a valve box of suffiCient size to service all valves Within the box.
Valve box shall be free from any debriS which may cover valves. PrOVide a 3" depth gravel sump at the bottom of
the valve pit.
7. All Irrigation equipment and installation techniques shall meet federal, state and local codes, regulations and
ordinances.
8. All gear driven heads and all heads along walks, curbs, drives and parking areas shall be Installed on fleXible
polyethylene sWing JOints.
9. Gear driven heads and fixed spray heads shall be Installed on separate zoneswhere pOSSible. PreCipitation
rates and head type should be compatible Within each zone.
J O. Gear driven heads shall not be Installed In shrub areas or be Installed on risers where pOSSible.
I I. Controller shall be mounted as shown on plan
12. All sleeves shall be schedule 40 pipe Installed a minimum of 14" below grade. Sleeves shall be used only
to Install lateral IrrJgatlon lines through. Sleeves shall not be used as a method to convey water through the
system.
13. Adjust all heads to prOVide maximum coverage and effiCiency and minimiZe overthrow. Irrigation heads shall
not spray over walks, drives or any other non-Irrigated areas.
14. EqUipment shall be manufactured by, "Toro", "Ralnblrd" or "Hunter" or as otherWise stated on the plans.
15. Contractor shall field verify water source to deliver the proper pressure, pounds per square Inch (PSI) and
water flow, gallons per minute (GPM) as requlred- by the irrigation system. Notify the Landscape Architect If there
IS any discrepancy.
I G. All permits reqUired for Installation shall be prOVided by the contractor.
17. Refer to the Landscape Plans when locating alllrrlgatlol1 equipment. Allow ample room near Irrigation
equipment for the proper installation of trees, shrubs and other work shown on draWings to be Installed.
18. All wires shall be Installed In wire sleeves.
19. Contractor shall be responSible for all Items on the plan and Irrigation speCIfication.
20. Contractor shall Instruct the owner on the full operation and maintenance of the Irrigation system.
