Dear Mr. Armstrong:
This letter constitutes a Development Order pursuant to Section 4-202,E of the Community
Development Code. On April 1, 2004, Development Review Committee (DRC) reviewed your
application for Flexible Standard Development approval to permit 10 attached dwellings within the
Downtown District under the provisions of Section 2-902.C and Preliminary Plat approval (PLT2004-
00001), The DRC recommended approval of the applications with the following bases and conditions:
Bases for Approval:
1. The proposal complies with the Flexible Standard Development criteria as Attached Dwellings per
Section 2-902.C.
2. The proposal complies with other standards in the Code including the General Applicability
Criteria per Section 3-913.
3. The proposal is in compliance with the Vision, Goals, Objects and Policies of the Clearwater
Downtown Redevelopment Plan and the Town Lake Residential character district.
4. The development is compatible with the surrounding area and will enhance other redevelopment
efforts.
Conditions of Approval for FLS2004-02009:
1. That evidence the recording of a final plat be submitted to Staff prior to the issuance of any
building permits;
2. That all Engineering Department requirements be met prior to the issuance of any permits;
3. That all Fire Department Code requirements be met prior to the issuance of any permits;
4. That a SWFWMD permit or letter of exemption be provided prior to the issuance of any permits;
5. That revised plans be submitted which accurately depict all required erosion and sediment control
techniques prior to the issuance of any permits;

6. That Open Space and Recreation Impact Fees be paid prior to the issuance of any building permits
or final plat, whichever occurs first;
7. That an internal collection system (inlets and pipes) and connection to City storm sewer at Ewing
and Court be provided prior to the issuance of a Certificate of Occupancy.
8. That all pipes and other structures located within the City right-of-way be constructed to City of
Clearwater Standards and Specifications and turned over to the City upon issuance of the first
Certificate of Occupancy;
9. That all Traffic Impact Fees be paid prior to the issuance of a Certificate of Occupancy;
10. That all utilities on site and within the right-of-way are placed underground before Certificate of
Occupancy;
11. That the final building elevations including final colors and buildinglroof/window/trimletc.
material samples be submitted to Planning Staff, prior to issuance of a building permit, and be
consistent with the elevations dated submitted May 25, 2004 as revised by Staff;
12. That any future changes to the buildings~color! m~~rial, design, fencing, etc.) be reviewed by the
Planning Staff; ~..~;~~~_~
13. That the west and east elevations of building_4..on....weet A-3 be revised to include a dark colored
base and white base trim to match all other elevations; and
14. That all signage meet Code requirements and be architecturally-integrated into the design of the site
and buildings.
Conditions of Approval for PLT2004-00001:
1. That a confirmation letter from the Post Office approving proposed street name be submitted to
Staff;
2. That all lot lines include bearing and distance; and
3. That all Engineering Department and platting requirements will be met including but not limited to
a provision for ingress/egress easement, sidewalk easement, drainage and utility easements
I concur with the findings of the Development Review Committee and, through this letter, approve
your application for Flexible Standard Development with above 17 conditions. The approval is based
on and must adhere to the application dated received February 26, 2004, revised site plan dated
received April 28, 2004 and revised elevations dated received May 25, 2004.
Pursuant to Section 4-303, an application for a building permit shall be made within one year of
Flexible Standard Development approval (June 9, 2005). All required certificates of occupancy shall be
obtained within one year of the date of issuance of the building permit.
Time frames do not change with successive owners. An extension of time may be granted by the
Community Development Coordinator for a period not to exceed one year and only within the original
period of validity. The Community Development Coordinator may approve an additional extension of
time not to exceed one year for good cause shown and documented in writing. The coordinator must
receive the request for this extension within the one-year period of validity after the original time
extension.

The issuance of this Development Order does not relieve you of the necessity to obtain any building
permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or
license affected by this approval, please bring a copy of this letter with you when applying for any
permits or licenses that require this prior development approval.

1. Provide tooled joints at distances matching the width. Also
place expansion joints at driveways.
2, If some physical obstruction exists which prevents the placing
of sidewalks as shown, contact the Engineering Division for
alternate location,
3. Wooden and other spacers will not be permitted in sidewalks or
driveways.
4. No coatings of any kind will be permitted on concrete
sidewalks or driveways without specific approval of the City
Engineer.
