Dear Mr. Landers: This letter constitutes a Development Order pursuant to Section 4-202.E of the Community Development Code. On May 6, 2004, the Development Review Committee (DRC) reviewed your application for Flexible Standard Development approval for the redevelopment of a single-family residence with a Preliminary Plat approval for the proposed three-unit townhouse in the Medium Density Residential (MDR) zoning district. The request includes: A reduction in the required north and east landscape buffers; and for waiver to the sidewalk requirement along Union Street, per section 2-303.A. The DRC recommended approval of the application with the following bases and conditions: Bases for Approval: 1. The proposal complies with Attached Dwellings criteria under the provisions of Section 2-303.A; 2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and 3. The proposed development is compatible with the surrounding area. Condition for Approval: I. That the space located above the garages not be rented or utilized as independent dwelling units: 2, That a final plat be recorded with Pinellas County prior to building permit approval: 3. That landscape plan be revised to show palm trees meeting Code prior to building permit approval: 4. That plans reflect root prune lines for staff review and approval prior to building permit approval: 5. That Recreation Facilities Impact Fees of $400 for 2 net new residential units are due prior to issuance of building permits or final plat, whichever occurs first: and 6. That a traffic impact fee of $2,277 to be paid prior to e.O. I concur with the findings of the Development Review Committee and, through this letter, approve your application for Flexible Standard Development with the above one condition. The approval is based on and must adhere to the application dated received March 24, 2004 and the revised site plans dated received April 13, and June 28, 2004.
