Attached is a copy of the letter to Tom & Pat Wolkowsky, owners
of the Marina Restaurant, regarding their Lease Agreement. The
Marina restaurant will be placed on a month to month from October
through December.
Please advise me on what form or letter can be used to place the
Marina restaurant on a month to month starting October 1, 1996.
Your help is appreciated.

Dear Tom & Pat:
This letter is a follow up to our meeting last week and to
discussions with city management on a new lease for the Marina
Restaurant.
At the meeting you received a draft copy of the standard city
Lease Agreement for Marina building leases. On Page 6, Paragraph
11 states: "Major renovations to the customer seating area, major
renovations to the kitchen area and major renovations to the
storage." If you are unable to meet the financial demands of the
renovations of the Marina Restaurant, we would like to know that
up front. At one time, the city was advised that it would cost
approximately $80,000 to completely renovate the Marina
Restaurant space.
The city wants to see these major renovations to the Marina
Restaurant space. We are willing to negotiate a new lease with
you, as long as you are able to meet the financial requirements
of Paragraph 11. If you are able to meet the requirements, then
the fixed rent and percentage of the gross amount will be
negotiated prior to the lease being submitted to the city
commission for approval. The city will allow you forty five (45)
days from the date of this letter, or until Tuesday, October 1,
1996, to submit a complete list of major renovations. The list
must include a detailed description of all renovations, along
with estimated costs. I suggest that you contract with a
construction company to get all the required information. The
below information is supplied to assist you in getting the
information for major renovations:
1. Major renovations to the customer seating area will include
new lighting, new seating (which could include a redesign of the
entire seating area), new equipment such as plates and hardware,
painting or re-paneling the walls, new flooring material (either
tile or carpeting), new or up-dated air conditioning system and
new or updated service counter.
2. Major renovations to the kitchen area will include new
lighting, new or up-dated kitchen equipment, new or up-dated air

conditioning and painting of all interior walls.
3. Major renovations to the storage area will include new
lighting, up-dating the restaurant restroom with all new fixtures
and paint, new storage racks for supplies, new air conditioning
for the storage area and the painting of all interior walls. It
will be up to you for the removal or relocation of some non-load
bearing walls in the storage area.
All major renovations must meet and comply with current city
code. During the major renovations when the restaurant is closed
to business, the city will consider relief for payment of rent
during the construction period(s). We will also consider a five
(5) year option on the new lease, so that you will be able to
recoup your expenditure costs.
As we discussed, the Marina restaurant will be a "No Smoking"
restaurant with any new lease, unless you can provide a
ventilation system capable of removing ALL smoke from the
restaurant space. Any ventilation system you consider must be
approved by city management.
Because you will not be able to get the major renovation
information to the city until October 1, 1996, you will be placed
on a month-to-month basis on that day until December 1, 1996. If
you fail to get the required information by the above dates, your
lease will be canceled and the city will bid out the space.
