ADDENDUM TO BEACH LIBRARY LEASE TO REINSTALL DROP BOX ~. 0~/01/1999 17:31 8132218091 EKONOMIDES AND ASSOC PAGE 02 , I ADDENDtm TO BEACH LIBRARY LEASE WHEREAS, B.J.E., Inc., a Florida corporation, with a tnailing address at 483 Mandalay Ave., Clearwater, Florida, as LESSOR, and the city of Clearwater, with mailing address at 112 S. Osceola Ave., Clearwater, FL 33756, as LESSEE, entered into a lease (the "lease") on January S, 1999. for units 106, 107 and 108 (the "premises ") of the shopping center known as Pelican Walk (the "centertt) with street addresS of 483 Mandalay Avenue, Clearwater, Florida; and WHEREAS, LESSEE wishes to install in front of the premises in the common area of the center a drop box for after hours return of library materials. NOW THEREFORE, in consideration of the sum of ten dollars ($10.00) and other good and valuable considerat.ion the receipt and sufficiency of which is hereby acknowledged, the parties agree to the following: 1. Consent _ LESSOR consents to the installation of a drop box in front of the premises in the common area of the center, at LESSEE"S sole expense, for the purposes ot att.er hours return of LESSEE"S library materials. LESSEE shall be entitled only to the non- exclusive use of the portion of common area occupied by alld to be used in conjunction with the drop box. Should LESSOR require the relocation of the drop box, LESSEE agrees to relocate the drop box promptly at its own expense. :2. Maintenance. LESSEE shall have full responsibility to maintain the drop box and shall keep same clean at all times. LESSEE shall also repair and return all portions of the common area effected by the installation and maintenance of the drop box to their condition prior to the installation of the drop box. 3. Indemnification. Lessee shall defend, indemnity and hold Lessor harmless from all liability, losses, costs, damages, or expenses. including the cost of investigation and reasonable attorneys fees, that Lessor may incur with respect to any claim or demand arising out of the use of the drop box by Lessee or any third party or with respect to any claim for damages due to personal injury or property loss related in any way to the presence of the drop box.
