Attached is information related to the request by Deborah L. Martohue, Esquire, for an
extension of time relative to the above referenced project located at 3280 and 3290
McMullen Booth Road. A one-year extension is being requested which would expire on
September 7, 2009.
Pursuant to Section 4-407 of the Community Development Code, extensions of time
“shall be for good cause shown and documented in writing.” The Code further delineates
that good cause “may include but are not limited to an unexpected national crisis (acts of
war, significant downturn in the national economy, etc.), excessive weather-related
delays, and the like.” In this particular case, the project was delayed due to litigation,
preparing a development agreement, and processing the related land use applications
concerning the site. The Code further states that the Community Development Board
may consider whether significant progress on the project is being made and whether or
not there are pending or approved code amendments that would significantly affect the
project. It should be noted that, pursuant to Section 4-407, the Planning Director has
previously granted a one-year time extension.

shall constitute my written request on behalf of the applicant to seek a second one-
year extension from the Community Development Board to initiate the building
permit application for Development Order FLD2005-O 10 14. Accordingly, I am
requesting that you place this extension request on the July 15, 2008 COB agenda.

On May 17, 2005, me Community Development Board (COB) approved the above referenced flexible
Development applicauon to permit a two scory, 45,000 square fOOL medical clinic with non-residential off-street
parking tn the Low Medium DenSity Residential (LMDR) District under the provisions of Section 2-204.C; a
reduction to the front (west) sctback from 25 feet to 15 feet 10 pavement: a reduction to the side (south) setback
from 10 feet to four feet to parking; and an increase 10 building height from 30 feet to 35 feet for top of parapet
and 10 43 feet for elevator/stair tOwer; as a Comprehensive (nlill Project, under the provisions of SeCClon 2-
1204.A and a Comprehensive Landscape Program under the proviSIons of Section 3.1202.G.
Pursuant 10 Section 4-407 of the Community Developmenc Coue, an application for a building permit must be
initiated within one year from the date of COB approval (by May 17. 2006). However. It has been determined
by the City Attorney's Office that due to the litigation assOCIated with this applicatlon, an application for
building permit was to be Initiated wlChin one year of the date of conclUSIOn of saId litigatIon (by September 6.
2007),
In addition to the above, Section 4-407 of the Community Development Code allows the Planning Director to

for this extension within the time frame granted by the Planning Director (period of validity after the

be submitted with sufficient lead time to be placed on the CDB agenda that precedes the above expiration
