I I FLORIDA DEVELOPMENT COMMISSION INDUSTRIAL SERVICES DIVISION PLANNING AND COMMUNITY SERVICES DEPARTMENT CALDWELL BUILDING TALLAHASSEE, FLORIDA THIS AGREEMENT, entered into this 16th day of June , 19 58 , by and between the Florida Development Commission (hereinafter called the "Commission"), an agency of the State of Florida, with headquarters in the City of Tallahassee, and ... ..,.. Cl'J1u", (hereinafter called the "Municipality"), a municipal corporation chartered under the l~ws of the State of Florida. WITNESSETH THAT: WHEREAS, the Commission, in furtherance of its duties under Chapter 288, Florida Statutes, desires to advise, assist and cooperate with the Municipality in preparing plans and programs for physical and economic development within and in proximity to the area of the Municipality, and WHEREAS, in furtherance of the aforesaid purposes, the Commission proposes to execute concurrently herewith a contract with a prOfessional Consultant for services in connection with a specific undertaking (referred to herein as the "Project"), and _w I I -2- WHEREAS, the Commission intends to make application to the United States for a grant of funds in aid of the said project, and WHEREAS, the Municipality has requested that the Commission assist it in preparing plans and programs, NOW, THEREFORE, the parties hereto do mutually agree as follows: 1. The Planning Project. The Commission agrees to undertake a planning project that shall include the services, and shall otherwise be in accordance with the terms of a contract by and between the Commission and M1P,a.4 ........1. ,....J.lJJl~U_. el. A copy of said contract is attached hereto; and to the extent that the terms of said contract may be applicable hereto, they are hereby incorporated by reference. .~ I -3- I 2. Commission to Make Application for Federal Grant. The Commission agrees to make application, at as early a date hereafter as may be practicable, to the Housing and Home Finance Agency (Urban Renewal Administration) of the United states for a grant of funds in aid of the project, as provided under Section 701 of the Housing Act of 1954 and any amendments thereto, the said application to be for an amount of money equal to the total financial obligation assumed by the Municipality under Section 4 of this Contract. The Commission agrees to notify the Municipality of approval of the said application as soon as possible after such approval. It is expressly under- stood and agreed) however, that none of the provisions of this contract shall be binding upon either party hereto if the said application for Federal grant shall be denied, or if approved for a lesser sum than the amount requested in the application as aforesaid. 3. Commission to be Responsible for Administration, Supervision, and Payments to Consultant, The Commission agrees to provide general administration for the purposes of the project, including keeping of all accounts, the filing of forms and reports of progress that may be required by the Housing and Home Finance Agency; to provide general super- vision over the work of the Consultant; and to assume full finanoial responsibility for all payments due in accordance with the Consultant's contract, hereinbefore described, and any amendments thereto, and in the manner and to the extent expressly provided therein. The Municipality shall authorize I Jack/Wolle, as City Planner, or his successor' to act as its agent(s) to work in cooperation with the Commission and with the Consultant in carrying out the project. If the Municipality should elect hereafter to designate other, or additional, agents, written notice to that effect shall be given to the Commission at least five (5) days in advance. 6. Municipality to Provide Data, Services, and Facilities. Either party may terminate this contract by giving written notice to the other party specifying the date of termination, such notice to be given not less than thirty (30) days prior to the termination date therein specified. Upon termination, as aforesaid, the obligation of the Commission for continuance of the technical and professional services included in the project shall cease forthwith, and the Municipality shall not be obligated for contributions in excess of fifty percent (50%) of the costs of such services under the Commission's contract with the Consultant incurred up to the date of termination. ~ ~ '-,.;; J I -7- 8. By the signature of its properly designated officer, affixed hereto, the Municipality declares its intent to promote and to support a continuation of municipal planning, following comr;letion of the planning project that is contemplated in this contract, as a means generally of coping with the Municipality's problems of community development, and more particularly of attaining the objectives that may be recommended as a result of the said project.
