A G R E E MEN T

THIS AGREEMENT, by and between and among the CITY OF
CLEARWATER, FLORIDA, a municipal corporation, party of the
first part, hereinafter called the "City" and FRANK MUSCARELLA
and JENNIE MUSCARELLA, his wife, parties of the second part,
hereinafter called the "Muscarellas'" and GUY O. PARKER and
LUCILLE PARKER, parties of the third part, hereinafter called
the ttParkers'",
WITNESSETH: THAT WHEREAS, there is some uncertainty as
to the exact location of the right-of-way of Laura Street in
the City of Clearwater, Florida, and the north and south right-
of-way lines for said street immediately west of the junction
of said street with North Fort Harrison Avenue, and
WHEREAS, the uncertainty of the location of the north and
south lines of Laura Street as aforesaid materially effects the
owners of property adjoining said street on the north and south
of the above location, and
WHEREAS, the parties hereto are desirous of settling and
setting at rest the location of said lines, and
WHEREAS, Leo M. Butler, Registered Surveyor #78, has made
a survey of the said lines and the building lines in the area,
a copy of which survey is hereto attached and is by reference
made a part hereof.
NOW, THEREFORE, in consideration of the mutual covenants
and agreements herein contained and in further consideration
of other good and valuable considerations, the parties hereto
hereby mutually covenant and agree as follows:
1. That the right-of-way at Laura Street is forty-four
(44) feet in width and runs from the present building line on
the south of Laura Street to the present building line on the
north of Laura Street, as shown on the attached survey of that
portion of Laura Street immediately west of North Fort Harrison
Avenue.

2. That the following described land is not a portion of
Laura Street and the Muscarellas' and the Parkers' have no ob-
~ction to its being vacated by the City:
Begin at the Northeast corner of Lot 13 of EARLL &
TATES SUBDIVISION, as recorded in plat book 1, page
20 of the public records of Hillsborough County,
now Pinellas; thence North along the west line of
Fort Harrison Avenue 2.38 feet; thence westerly
along the north line of existing building 92.0 feet;
thence south 2.8 feet to the south line of Laura Street
as recorded in said plat book 1, page 20; thence east
along said south line, 92.0 feet to Point of Beginning.
3. That the following described property is a part of
right-of-way of Laura Street and the Muscarellas' and the
Parkers' hereby disclaim all interest therein, and agree that
it shall be used and dedicated as a part of Laura Street:
Begin at the southeast corner of Lot 14 of EARLL &
TATES SUBDIVISION, as recorded in plat book 1, page
20 of the public records of Hillsborough County, now
Pinellas; thence north along the west line of Fort
Harrison Avenue 2.17 feet; thence west along the
south line of the existing building 84.0 feet; thence
south 2.7 feet to the south line of Lot 14; thence
east along the said south line 84.0 feet to Point of
Beginning.
IN WITNESS WHEREOF, the parties hereto have set their
