Re: Amendment to Reimbursement Agreement dated December 16,
1998 Regarding New Delivery Point - Anclote Lateral
Dear Brian:
Reference is made to that Reimbursement Agreement dated December 16, 1998
("Reimbursement Agreement") between City of Clearwater, Florida ("Customer") and
Florida Gas Transmission Company ("FGT").
The parties desire to amend the Reimbursement Agreement to reflect a change in
the location of the gate station resulting in an additional 543 feet of 4-inch pipe to be
added to the project covered by the Reimbursement Agreement.
Accordingly, for and in consideration of the mutual covenants herein contained,
the Parties agree as follows:
1. The Reimbursement Agreement is hereby amended to reflect a change in the
location of the gate station resulting in an additional 543 feet of 4-inch pipe.
2. The Attachment to the Reimbursement Agreement shall be amended to
reflect a change in the Estimated Cost of the project. The estimated cost of
such additional pipe to be constructed is $42,700 ("Additional Cost"), which
includes a tax gross-up of$1O,539. The Additional Cost shall be added to the
original estimate in the Reimbursement Agreement for an amended total
Estimated Cost of$I1O,700.
3. Except as expressly provided for herein, the terms of the Reimbursement
Agreement are not otherwise modified.
