TEMPORARY CONSTRUCTION EASEMENT
FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) cash in hand paid, the receipt of
which is hereby acknowledged, together with other good and valuable consideration as provided in that
Stipulated Order of Taking and Final Judgment entered in Case No. 08-19532-CI-21 in the Circuit Court of the
Sixth Judicial Circuit in and for Pinellas County, Florida, and by this reference made a part hereof, and the
benefits to be derived therefrom, Frank C. Kunnen, Jr. ("Grantor"), 22067 U. S. Highway 19 North,
Clearwater, FI. 33765-2363, as owner and holder of legal and equitable title in and to the real property described
herein, hereby grants and conveys to the CITY OF CLEARWATER, FLORIDA, a municipal corporation
("Grantee"), ingress, egress and easement over and across the following described lands, lying and being situate
in the County of Pinellas, State of Florida, to wit:

The easement rights hereby granted are for ingress, egress and construction purposes of the City of
Clearwater, Florida. The rights are temporary and will expire automatically one hundred eighty (180) days
following commencement of construction of Alligator Creek Channel "G" Drainage Improvements, City of
Clearwater Public Works Project No. 03-0023-EN, or upon the completion of such construction project,
whichever shall occur sooner, unless extended by written agreement of the parties hereto.
The term of this easement shall be One Hundred Eighty (180) Days and shall begin on September 1,
2008, and terminate on March 1, 2009, or at the completion of the project, whichever occurs first.
In consideration of the rights granted herein, Grantee, its employees, contractors, agents or designees
agree that all persons entering upon Grantor's property by virtue of the rights herein granted shall do so at their
own risk. Grantor accepts no liability whatsoever for any claims for injury or damages in connection with this
grant of temporary easement.
Restoration of the easement premises to equal or better condition as existed prior to commencement of
the aforementioned project will be completed by Grantee, at Grantee expense, not later than project completion.
