WHEREAS, the Department and the City heretofore on April 27,
1973, entered into an agreement whereby the City by resolution
determined it was in the public interest to participate in the
cost of a Joint Project Agreement, Job No. 15000-1707(3707), in
the City of Clearwater, Pinellas County, Florida, and submitted
monies in the amount of $5,000.00 to pay for the cost of pre-
liminary work; and
WHEREAS, the Department agreed to prepare plans and speci-
fications, secure equipment and materials, prov:..de fer construc'-
tion of the project, supervise and inspect said project; and
WHEREAS, by formal action on Septeraber 24, 1973, at a
meeting of the City Commission of Clearwater, Florida, certified
copy of excerpt of official minutes attached hereto and by this
reference made a part hereof, it was decided that the City would
proceed with the project solely under city funding, thereby the
agreement with the Department was to be cancelled and any unen-
cumbered funds on deposit with the Department were to be returned;
and
WHEREAS, the Department as of the date of this agreement
has not performed any work or incurred any expense as a result
of the agreement of April 27, 1973, with the City;
NOW, THEREFORE, THIS INDENTUIlli WITNESSETH: That the
City for and in consideration of the sum of $5,000.00 heretofore
previously paid to the Department under the terms of said agreement,
the receipt whereof is hereby acknowledged, to be paid to the
City upon execution hereof, does hereby agree to and with the
Department to the termination of the Joint Project Agreement

dated April 27, 1973. As a result thereof, the City fully, finally,
and completely discharges the Department of any and all responsi-
bility and liability for or in connection with said agreement.
IN WITNESS WHEREOF, the parties hereto have c~used these
presents to be executed, the day and year first above written.

The Assistant City :1ana.ger sU~Jmarized staff memorandum
of September 20th recoillmending the use of City funds for
the construction of the Pierce Street Extension. He noted
that federal funding could not be counted on for support of
the TOPICS nro6ra~ and that risin~ construc~ion ccsts
indicated the 3.dvisability of ?roceeding i"i~h the pr:)ject
imrnediatsly. The Traffic E..gineer commented on the n'Jmbcr
of projects involved under the TOPICS ?ro8ram and repor1:ed
that State funds also might r.ot: be available to support
this city ?roject. Reviewing varioJs funding considerut:ions,
the Assistant City :1ana8er stated tha. t the City could furnish
the estimated $700,000 for the pierce Street Extension in
realiE~aent of other budgeted itcns and the City Engineer
