1. To prepQre plans and specifications for the work involved, and advertiso
for bids for lh~ equipment and materi<Jls. The decision as to the type and make of
equipi-;1(';nt purchased will be the DEPf,rrn.1UlT1S discretion.
2. To perform the complete installation.
3. To furnish technical supervision during thE:; installation phase of the
work and finally inspect the complete project.
THE C!TV AGREES:
1. Thnt the equ i pr.18,"it shall rem8 i n the pror:rty of the DEPfl.R.H1ENT, and it
is hereby understood a:ld agreed that the CITY shall not, under any condition remove
the equipment which is the subject matter of this Agreement for any reason without
permission and written consent of the DEPARTMENT.
2. Upon completion of the installation, to assume sole responsibility for
the mainten~nce of said li9~lting syste~ a~d ~jaffic control signal system in accor-
dance with the DEPARH'lENT1S pol ide:: G,ld IISt:::n(!3rc Spccificoticrls f()r High\'/E::y Light-
in911, and traffic control signal systems and the payment for all cost of electricity
and electrical charges incurred in connection with the operation thereof out of the
CITylS regular fund.

decide all questions, difficulties and disputes of \-:!,Gtevccr rl2.ture which may 2rise
under or by renson of this Agreement, the prosecution 2nd fulfillm8nl of the scr-
vices hereunder, and the character, qual ity,arnount c;nd value: thereof, 2.nd his
decision upon all claims, questions and disputes shall be final alld conclusive
upon the parties hereto.

RESOLUTION
No. 70 - 53
A RESOLUTION OF THE CITY OF CLEARWATER,
FLORIDA, A UTHORIZING EXECUTION OF AN
AGREEMENT FOR THE INSTALLATION OF A ROAD-
WAY LIGHTING AND TRAFFIC CONTROL SIGNAL SYSTEM
WITHIN. THE RIGHT OF WAY UMITS HEREAFTER
DESCRIBED AND PROVIDING WHEN THIS RESOLUTION
SHALL TAKE EFFECT.
WHEREAS, the State of Florida Department of Transportation has
located and proposes to construct or reconstruct a part of State Road 55; and
WHEREAS, it is the intent of the Department of Transportation to
include as a part of the prime contract for State Road 55, Section 15150-6512,
described as Interchange at SR 60, a Roadway Lighting and Traffic Control
Signal System; and
WHEREAS, the City of Clearwater, Florida, having requested the
Department of Transportation to purchase and install the Roadway Lighting
and Traffic Control Signal System as a part of the prime contract for Section
15150-6512, Interchange at SR 60;
NOW. THEREFORE, B~ IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
.
1. That the Mayor-Commissioner, City Manager, City Clerk and
City Attorney be and they are hereby authorized and directed to make, execute
and deliver to the Department of Transportation an Agreement, wherein the
City of Clearwater will, upon installation of said Roadway Lighting and Traffic
Control Signal System, furnish power for and maintenance of same from
regular City funds.
2. That a certified copy of this Resolution be forwarded to the
Department of Transportation at Tailahassee, Florida.
