Clearwater jurisdiction, in accordance with Section 335.0415, Florida Statutes. The Department has
agreed to the transfer and all provisions listed in the executed Agreement and supporting Resolution

Avenue from Chestnut Street to Fort Harrison Avenue off the City of Clearwater Road System and onto
the State Highway System., as requested by the City. A map depicting this proposal and draft Transfer
Agreement are enclosed for your consideration. A copy of all known Department documents and
agreements relevant to this transfer are enclosed. '
The Department will coordinate with the City on reaching mutual agreement in accordance with Section
335.0415, Florida Statutes. The specific transfer requirements will include, as determined applicable by
the Department and your representative, the considerations outlined in the enclosed draft Terms of
Agreement. The Department requires a Resolution from the City authorizing the execution of the Transfer
Agreement including a statement that the local governmental entity agrees with the terms and conditions
found in the Transfer Agreement (see enclosed sample). The Resolution may be signed concurrently with
the Final Transfer Agreement and will be attached to the Final Transfer Agreement.

This AGREEMENT made and entered into this on the~ day of fE8IlLtI1I<'1 ,2003, by and
between the FLORIDA DEPARTMENT OF TRANSPORTATION, an agency of the State of Florida,
hereinafter called the DEPARTMENT, and the CITY OF CLEARWATER, hereinafter called the CITY.
WITNESSETH
WHEREAS, the CITY has requested the roadway transfer of Alt US 19/5R 595/Fort Harrison
Avenue from Belleair Road to Myrtle Avenue and SR 590/Drew Street from Fort Harrison Avenue to
Myrtle Avenue from the State Highway System to the City of Clearwater Road System; and the roadway
transfer of Myrtle Avenue from Chestnut Street to Fort Harrison Avenue from the City of Clearwater
Road System to the State Highway System; and this transfer is mutually agreed upon, between the CITY
and the DEPARTMENT, supported by CITY Resolution,
NOW, THEREFORE, THIS INDENTURE WITNESSETH: in consideration of the mutual covenants
and promises herein contained, and for other good and valuable consideration, the receipt and adequacy of
which are hereby acknowledged, the CITY and the DEPARTMENT agree as set forth below:
This Agreement sets forth the terms and conditions under which the CITY and the DEPARTMENT will
abide. The commencement of jurisdictional and maintenance responsibilities shall be upon approval of
the roadway transfer by the Secretary of the Florida Department of Transportation, approval to re-
designate Alt US 19 by the Association of American State Highway Transportation Officials (AASHTO)
and upon written notification of final construction acceptance ofthe state resurfacing project, Financial
Project Number 2571031.
TERMS OF THE AGREEMENT
I. Roadway Transfer of Alt US 19/5R 595/Fort Harrison Avenue from Belleair Road to Myrtle
Avenue and SR 590illrew Street from Fort Harrison Avenue to Myrtle Avenue from the
State Highway System to the City of Clearwater Road System:
( a) The CITY accepts all responsibility for operation and maintenance of the roadway. In addition
to the roadbed, this agreement includes all curbs, culverts, and drainage structures within the
right-of-way at the time of transfer. The CITY shall be responsible for maintenance of public
sidewalks and other ways in the right-of-way.
(b) The DEPARTMENT gives up all its rights to the road, except as specified in this agreement.

(c) It is agreed that all obligations ofthe DEPARTMENT under any maintenance, utility, or any
other such agreement, relating to the specific roads to be transferred, shall be transferred to the
CITY at'the same time and in the same manner as jurisdictional responsibility.
(d) The roadway transfer of Alt US 19/5R 595/Fort Harrison Avenue from Belleair Road to
Myrtle Avenue and SR 590/Drew Street from Fort Harrison Avenue to Myrtle Avenue shall
be effective upon approval by the Secretary of the Florida Department of Transportation,
approval to re-designate Alt US 19 by the Association of American State Highway
Transportation Officials (AASHTO) and written notice offinal construction acceptance ofthe
state resurfacing project, Financial Project Number 2571031.
( e) Existing deeds or right-of-way maps will be recorded by the CITY in the public land
records of Pin ell as County in which the rights-of-way are located.
(f) Ifthere is evidence of historical or archaeological resources that could be adversely
impacted after a transfer, the CITY agrees to maintain the resources in accordance with
District Environmental Management Office's (DEMO) recommendations.
(g) The DEPARTMENT will offer the opportunity for a public hearing prior to removal ofthe
state road designation of the transferred roadways, described herein.
II. Roadway Transfer of Myrtle Avenue from Chestnut Street to Fort Harrison Avenue from
the City of Clearwater Road System to the State Highway System:
(a) The CITY agrees to the perform the following roadway and signalization improvements on
or along the portion of Myrtle Avenue to be transferred, as a condition ofthe transfer:
i. Provide a dedicated southbound left turn movement for Myrtle at Chestnut Street
and improve turning radii, within existing right-of-way, at Court and Marshall
Streets
ii. Widen lane width on Myrtle Avenue from 10 to 11 feet, where right-of-way allows
iii. Replace span wire with mast arm installations at: Marshall, Palmetto and
Seminole Streets and perform feasibility analysis of upgrading the Cleveland
Street signal from existing span wire to mast arms; if feasible, implement the
upgrade
iv. Locate existing utilities
v. Upgrade the approaches to the railroad crossing
vi. Maintain existing street lighting payment arrangement with Florida Power
Corporation with the CITY reimbursed by the DEPARTMENT
(b) The CITY gives up all its rights to the roadway, except as specified in this agreement.
(c) The DEPARTMENT accepts all responsibility for operation and maintenance of the
roadway. In addition to the roadbed, this agreement includes all curbs, culverts, and drainage
structures within the right-of-way at the time of transfer. The DEPARTMENT shall be
responsible for maintenance of public sidewalks and other ways in the right-of-way.

(d) The D EP AR TMENT will offer an opportunity for a public hearing prior to the assignment of
a state road number and designation of the transferred alignment of Myrtle Avenue as
Alternate US 19.
(e) The roadway transfer of Myrtle Avenue from Chestnut Street to Fort Harrison Avenue from
the City of Clearwater on to the State Highway System shall be effective upon: approval by
the Secretary ofthe Florida Department of Transportation; approval to re-designate Alt US
19 by the Association of American State Highway Transportation Officials (AASHTO);
written notification of final construction acceptance of the state resurfacing proj ect, Financial
Project Number 2571031 and completion ofthe aforementioned roadway and traffic signal
improvements by the CITY, see paragraph (a) above.
(f) It is agreed that all obligations of the CITY under any maintenance, utility, or any other such
agreement, relating to this specific road to be transferred, shall be transferred to the
DEPARTMENT at the same time and in the same manner as jurisdictional responsibility.
(g) Existing deeds or right-of-way maps will be recorded by the DEPARTMENT in the public
land records of Pin ell as County in which the rights-of-way are located.
All words used herein in the singular form shall extend to and include the plural. All words used in the
plural form shall extend to and include the singular. All words used in any gender shall extend to and
include all genders.
This Agreement embodies the whole agreement ofthe parties. There are no promises, terms, conditions,
or obligations other than those contained herein, and this Agreement shall supersede all previous
communications, representations, or agreements, either verbal or written, between the parties hereto.
This Agreement shall be governed by and construed in accordance with the laws ofthe State of Florida.

Each party is an independent contractor and is not an agent of the other party. Nothing contained in this
Agreement shall be construed to create any fiduciary relationship between the parties, during or after the
performance of this Agreement. Neither party shall have the authority to bind the other party to any
obligation whatsoever to any third party without the express specific written consent of the other.
No modification, amendment, or alteration in the terms or conditions contained herein shall be effective
unless contained in a written document executed with the same formality and of equal dignity herewith.
If any part of this Agreement shall be determined to be invalid or unenforceable by a court of competent
jurisdiction or by any other legally constituted body having the jurisdiction to make such determination,
the remainder of this Agreement shall remain in full force and effect provided that the part of this
Agreement thus invalidated or declared unenforceable is not material to the intended operation of this
Agreement.

TRANSPORTATION; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Clearwater has requested the transfer of US Alt. 19/5R
595/Fort Harrison Avenue from Belleair Road to Myrtle Avenue (Section 1501000, M.P.
19,164 to 21.212 and Section 1502000, M.P, 0.000 to 1.126) and SR 590/Drew Street
from Fort Harrison Avenue to Myrtle Avenue (Section 15050000, M.P. 0.000 to 0.247)
from State Highway System to the City of Clearwater Road System, and the transfer of
Myrtle Avenue from Chestnut Street to Fort Harrison Avenue (Section 15025000, M.P.
0,000 to 1.553) from the City of Clearwater Road System to the State Highway System,
and
WHEREAS, the transfer is mutually agreed upon, between the City of Clearwater
and the Florida Department of Transportation, and
WHEREAS, the City Commission hereby authorizes the Mayor-Commissioner to
sign the transfer agreement described in the resolution, and
WHEREAS, said transfer is in the best interest of the City of Clearwater because
it aids in the redevelopment of the downtown area; now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA:
Section 1. A certified copy of this resolution shall be forwarded forthwith to the
State of Florida Department of Transportation in Tallahassee, Florida,
Section 2, This resolution shall take effect immediately upon adoption.

Technical Memorandum, A Cultural Resource Assessment Survey for Right of Way (ROW)
Transfer on Alternate US 19 fr.om Missouri Avenue to Myrtle Avenue, Pinellas County

Dear Mr. Adair:
Our office has received the referenced project in accordance with Chapter 267, Florida Statutes, and
implementing state regulations, regarding possible impact to historic properties listed, or eligible for
listing, in the National Register of Historic Places, or otherwise of historical, architectural or
archaeological value. The State Historic Preservation Officer is to advise and assist state and federal
agencies when identifying historic properties, assessing effects upon them, and considering alternatives
to avoid or minimize adverse effects,
Results of the cultural resource assessment indicate that nine previously recorded historic properties
(8PI165, 8PI316, 8PI860, 8PI1261, 8PI1894, 8PI2262, 8PI8023, 8PI8024, 8PI8347) are located
adjacent to the subject right-of-way. All of these properties are either listed, eligible for listing, or
considered potentially eligible for listing in the National Register of Historic Places, but are located
outside the subject right-of-way and will not be affected by the proposed roadway transfer. Two
gateposts at Alternate U.S. 19 and Druid Avenue, which are contributing objects to the Harbor Oaks
Residential Historic District (8PI1261), appear to be located just west of the FDOT -owned Alternate
U.S, 19 right-of-way. No significant historic properties were identified within the subject right-of-way.
Based on the information provided, it is the opinion of this office that the transfer of Alternate U.S. 19
to the Cities of Largo and Clearwater will have no effect on any historic properties listed or eligible for
listing in the National Register.

The purpose of the United States (U.S.) Numbered Highway System is to facilitate travel on the main interstate highways,
over the shortest routes and the best available roads, A route should form continuity of available facilities through two or
more states that accommodate the most important and heaviest motor traffic flow in the area.
The routes comprising the National System of Interstate and Defense Highways will be marked with its own distinctive
route marker shield and will have a numbering system that is separate and apart from the U.S. Numbered Highway System.
For the convenience of the motorist, there must be continuity and a uniform pattern of marking and numbering these
Interstate routes without regard to state lines. .
The U,S. Numbered System was established in 1926 and the Interstate Numbered System was established in 1956. Both
have reached the period of review, revision, and consolidation, They now need perfecting rather than expansion. Therefore,
any proposed alteration in the established systems should be extremely meritorious and thoroughly, though concisely,
explained in order that the Special Committee on U.S. Route Numbering and the Standing Committee on Highways of the
Association may give prompt and proper consideration to each and every request made by a member department.
Explanation and Reasons for the Request: (Keep concise and pertinent.)
This action is required in order to relocate a five-mile portion of the current. designation
of U.S. Alternate 19 to a routing that will function more safely and efficIently. The
proposed new routing is more advantageous for heavy truck traffic than the existing route
through the central business districts of the cities of Largo and Clearwater.
The proposed new,routing is in keeping with established AASHTO policy for states to
consider relocating existing U. S. routes so as to follow newer, better or shorter roads.
This proposed new routing would follow a newer and slightly shorter route with more
through lanes than are presently available on the existing route: The curr~nt log of the
route as shown in the Association publication U.S. Numbered Highways, wIll not need to
be re~sed since the published control points and mileages are not significantly altered by
this proposal.
The majority of the proposed new routing is already part of the state high~.ay system,
with the remaining 1.S-mile segment to be added by transfer agreement condItIoned upon
approval of the U.S. Route re-designation. The regional traffic demand, accommodated
by both the alternate and main numbered route, should be enhanced by. t~e proposed
route relocation away from a congested downtown locale, thus provIdmg a more
attractive alternate route for motorists.

any road without the authorization, consent, or approval of the Standing Committee on Highways of the American
Association of State Highway and Transportation Officials, not withstanding the fact that the changes proposed are entirely

highway underpass structure shall be shown opposite the appropriate mileage point by the designation

Column 9: Vertical Sight Distance. Items to be shown in this column as a horizontal line, the length of which
will indicate the deficiency as determined in accordance with comparisons with comparable AASHTO
